Judicial proceedings: acts of the lords auditors of causes and complaints

3 August

The lords decree and deliver that Alan Forster and his wife shall withdraw from and clear the 16s and 8d worth of the lands of Cleghorn for Alan Cochrane and William Cochrane, and that they shall have no interference therewith in the future, and the said Alan has promised the lords that he will give the said Alan and his wife 20s within 15 days.

The lords decree and deliver that the laird of Craigie and the laird of Dundas shall satisfy and pay [John Woodman], abbot of Jedburgh the sum of 100 merks for the teinds of the church of Dunmannin for the past year, and that letters be written to distrenzie [them of] their lands and goods for that.

In the action and cause pursued by a venerable father Henry [Abercrombie], abbot of Cambuskenneth, and his convent, on the one part, against Thomas Somerville, on the other part, concerning the wrongful detention and withholding from him of £5 of the rest of a yearly annual of £5 owed to the abbot and convent of certain past terms of half of the lands of the Plane, both the said parties being present in person and their evidence, rights, reasons and allegations seen, heard and understood at length, the lords decree and deliver that because the said Thomas impeded the said abbot and convent and their officers from distrenzieing for the said annual and took the poinds from them, considering that the said annual of £5 is owed for the said half lands of the Plane, that therefore he shall content, restore and pay to the said abbot and convent the said sum of still owed as is said, and that letters be written to distrenzie him of his lands and goods for that.
