Procedure: commission to Mr Alexander Foulis
Deputation to Mr Alexander Foulls to be subcollector of the loan and taxt
The convention, haveing red and considerit the deputation underwritten produced be the Lord Humbie, they doe allow therof and ordans the same to be registrat, quherof the tenor followis:
Be it kend till all men be thir present lettres, me, Sir Adame Hepburne of Humbie, knyght, ane of the senators of the college of justice and collector general of the loan and taxt laitelie appointed to be raised be the lait convention of estaits, forsamekell as the said convention of estaits, be thair act and commission of the dait the sevinteint day of August last bypast, did nominat and appoint me to be generall collector of the soume and loan of tuelff hundrithe thousand merkes, with ane hundrethe thousand merkes allowed be the said act of expenses for ingathering thairoff and for exemptiones mentionat in the said act, and of the taxt of ane hundrithe and tuentie thousand punds appointed be the said estaits to be raised and uplifted within this kingdome in maner and for the causes mentioned in ane uther act of the said convention of estaits, daited the fyfteint day of the said moneth of August last bypast, and be the quhilk act and commissione granted to me as general collector forsaid, the said convention of estaits have gevin power and warrand to me to nominat and appoint deputies and under receavers under me (for quhome I sall be answerable) for receaving of the said loan and taxt respective from the severall commissioners and subcollectors for schyres and perochines and uthers intromettors therwith and addebtit in payment of the samyne. As also to nominat and appoint subcollectors for the haill schyres of the kingdome quhair the samene are not alreddie nominat be the said act of convention, for receaving, collecting and inbringing thairof, as the said gift and commissione granted be the said convention of estaits to me as generall collector forsaid at mair lenth proports. And I having experience of the fidelitie and abilitie of Mr Alexander Fowles, sone lawfull to umqhill George Fowles of Ravelstoune, for exerceing and dischairging of the said office and place of generall collector deput to the said loan and taxt respective, thairfore, witt ye me, the said Sir Adame Hepburne, generall collector forsaid, to have nominat and appointed, lyikas I, be thir presents, nominats, appoints and constituts the said Mr Alexander Fowles, generall collector deput for me for receaving of the said loan and taxt respective from the severall commissioners and subcollectors for schyres, burrowes and perochins and intromettors thairwith and addebtit in payment of the samene, and gives and grants to him the said office of generall collector deput, with all privileges, liberties and imunities pertening and belonging thairto or quhilks may pertene or belong to the samene or hes pertined or belonged to the office of generall collector deput of any preceding taxationes. With power to the said Mr Alexander Fowles to crave, exact, receave, intromett with and uplift the foirsaid soumes appointed and ordained to be raised be way of loan and taxt respective furth of evrie schyir, burgh, perochin and land within this kingdome and from the severall commissioners and collectors for schyres and subcollectores for perochins and from all uthers lyable in payment of the samene or either of them respective, and to raise and direct letteres and all maner of executione requisite for collecting and payment thairoff, either in my name or his awne name or bothe, and to caus put the saids letters to dew executione, conforme to the tenour of the said act of convention. As lykwayes with power to the said Mr Alexander Fowles generall collector deput forsaid, to geve and subscryve acquittaces and dischairges in his awne name, quhilks I will be thir presents sall be als sufficient to the receavers as iff the samene wer subscryvit and delyvered be my selff; and als with power to the said Mr Alexander Fowles to nominat and appoint subcollectors for the whole shyres of the kingdome (if thair be any as yit not nominat) for receaving, collecting and inbringing of the said loan and taxt respective, and generallie all and sindrie uther things to do anent the premisses sicklyik and als frelie in all respects as I, be virtew of my said gift, or any uther collectors generall of any preceding taxatione, ther deputies, subcollectors and under receavers and all uther officers have done heretofore, provyding alwayes, lyikas it is heirby provydit and ordained, that the said Mr Alexander Fowles sall be comptable to me and the saids estaits of this kingdome or to the committee to be appointed be them having power for that effect for compt and rekning of his intromissione with the forsaid loan and taxt respective and for his diligens anent the samene. And for the mair securitie, I ordaine thir presentis to be registrat in the books of the forsaid conventione of estaits or in the books of the forsaid collectione and loane thairin to remaine ad futura rej memoriam, and for regisrating heirof, constituts [...] my procurators, promittendo de rato etc. In witnes quherof, writttin be Williame Wricht, servitor to Alexander Ogilvie, wryter in Edinburgh, and subscryvit by me at Edinburgh the thrid day of Januar the yeir of God jM vjC fourtie four yeiris befor thir witness, Robert Neill, my servitor, and the said Williame Wricht, wryter heirof, and Williame Cairnes, servitor to the said Sir Adame.
