[Observations of the committee for the overtures to the kirk on the commission for plantation of kirks, valuation of teinds and ministers' stipends]

Observatioune of the comittie of parliament

27 October 1641

That the narrative mak onlie relatioune to the commissionaris of the assemblie thair desyre, and that thairfoir the kingis majestie and estates hes of new grantit commission with the addition and restrictions in maner eftirspecifit:

1. That power be grantit to the commissionaris to provyde everie kirk not yit provydit with aucht chalderis victuall or viij^C merkis of stipend to the said quantatie of aucht chalderis victuall or aucht hundreth merkis of stipend yeirlie, except suche particular kirkis occurre quhairin the commissionaris eftir consideratioune of the charge of the cure thairof and of the worthe and estate of the teindis of these kirkis sall find ane just, ressonabill and expedient caus to provyde the samene kirkis with stipendis beneath the quantaties foirsaid.

2. That augmentatioune may be grantit to all ministeris whose kirkis come not in to be provydit be the formar commission and hes not the full quantatie of aucht chalderis victuall or viij^C merkis alreddie. And that all kirkis quhilkis war provydit be the formar commission bot to a less quantatie nor aucht chalderis victuall or aucht hundereth merkis may be now supplied with that full quantatie in the caises following viz: 1. Quhair the teindis in haill or in pairt ar fewit with the landis cum decimis inclusis. 2. Quhair the valuatiounes alreddie led the tyme of the provision of these kirkis sall happine to be reducit upon the ressones contenit in the actis of parliament and formar commissions and conforme thairto. 3. Quhair it can be provin be writ or aithe of partie that the less quantatie foirsaid proceidit from pactione betuix the titularis and the ministeris in prejudice of the ministeris successouris.

3. Item, that all bishopis kirke (albeit provydit be formar commissions bot to a less quantatie) salbe supplied and get the full quantatie gif the samene may be had within thair awne parochines. And quhair the samene can not be had within thair awne parochines, sall have the samene supplied out of the teindis of the uthair kirkis of these bishoprikis quhairof thir ar kirkis.

4. Item, that all kirkis that had a greater quantitie of stipend before the restitution of bishopis nor they now have salbe supplied and brocht to that same quantitie quhairof they war in possessioune before the restitution of bishopis, to be payit out of thair awne parochines. And quhair not, to be payit out of the teindis of bishopis kirkis ut supra.
