Ratificatione in favoures of Doctour Chalmeres

Our soverane lord and haill estates of this present parliament ratifies, approves and, for his hienes and his successoures, perpetuallie confirmes the chartour of resignatione mad and granted be our said soverane lord, with consent of his hienes thesaureres, principall and deputie, and remanent lordis of his hienes exchekker of Scotland for the tyme, to his hienes trustie and weell beloved servitour Doctour James Challmer, phisitiane in ordinarie to his majestie and his darrest sone, the prince, his hienes, his aires and assigneyes whatsomevir heritablie, off all and haill the landis of Ballbithane, with the maner place thairof, houss, biggingis, yairdis, orchyairdis, sallmond fishings wpoun the water of Don, with the new place of Ballbithane, landis of Heddirwicke and Craigeforthie, with the moss, woodis, fishings, maner places, houss, biggingis, yairdis, orchyairdis, mures, midowes, pasturages, toftes, croftes, outsettes, insettes, pairtes, pendicles and pertinents therof whatsomevir, lyand within the parochine of Kinkell and shereffdome of Abirdeene, to be holdine of our said soverane lord and his hienes successoures in fewferme and heritadge for evir, for yeerlie payment of the fewferme dewties and fullfilling of the otheres clauss and conditiones therinmentioned, as the samene of the dait the tuentie fyfte day of Merche, the yeere of God jM vjC therttie fyve yeeres, haveing the great seale appended therto, at mair lenth beeres; togidder with the procuratorie and instrument of resignatione of the saidis landis, precept of seasing and seasing falloweing thairwpoun, with all former infeftmentes, chartoures, confirmationes, procuratories and instrumentes of resignatione, preceptes and instrumentes of seasing and otheres rightes, tytles and securities whatsomevir mad and granted to the said Doctor James Chalmer, his authores or predicessoures, of or conserneing the saidis landis, fishingis and otheres foirsaidis, or any pairt therof, be our said soverane lord or his hienes predicessoures, ther regentes or governoures for the tyme, off whatsomevir dait or daites, tennour or contentes the samen be of, and speciallie (but prejudice of the generalitie foirsaid) the chartour granted be his hienes wmquhile darrest father, of worthie memorie, to George Challmer of Ballbithane, brother germane to the said Doctour James Chalmer, his aires and assigneyes, of the saidis landis, fishingis and otheres abovewrittin, with the pertinentes, of the dait the fyfteenth day of Februar, the yeer of God jM vjC yeeres, and seasing falloweing therwpoun, in all and sindrdie the heedis, poyntes, clauss, articles and conditiones therincontenit and eftir the formes and tenours therof in all poyntes. And declaires, willes and grantes this act to bee alse sufficient as if the said chartor, procuratorie and instrument of resignatione, precept of seasing and seasing falloweing therone, and former infeftmentes and otheres speciallie and generallie abovewrittin wer all at lenth and word be word insert and conteyned heerintill, notwithstanding that the samene be not so done, quhairanent our said soverane lord and estates of this present parliament dispensed and, be thir presentes, dispenses for evir.
