Ratificatione in favoures of the toune of Brechine of there infeftmente with ane gifte de novodamus

Our soverane lord, with advyse and consent of the estates of parliament, ratifies, approves and perpetuallie confirmes the chartours, infeftmentes and other rightes granted be his majesties predicessoures in favoures of the burghe of Brechine, erecting the samene in ane free burghe royall with the priviledges conteanit thairin, and speciallie the chartour and infeftment granted be King James the Third, his majesties foirgransieres father, wnder the great seale, beering that the samene wes and is ane free burghe royall and payit there taxis and contributiones with other free burrowes as use is, and therfore gave to the proveist, baillies, counsell and commontie of the said burghe than present and to come the particulare customes, rightes and priviledges mentionat in the said chartour and infeftment, whilke is daited at Brechine, the tuentie eight day of Apryle jM four hundreth fourscoire eight yeeres. And sicklyke ratifies and approves the chartour and infeftment granted be King James the Sext, his majesties father of blissid memorie, wnder the great seale, to the saidis proveist, baillies, counsell and commontie of the said burgh of Brechine, than present and to come, and to the hospitall of the said burghe, of the haill landis, tenementes, houss, rentes and others whatsomevir perteaneing to whatsomevir prebendarrie, alterage or other chaiplanrie whatsomevir foundit within the said burgh and liberties thairof wherevir the saidis rentes dew thairto lyes, daited at Leith, the tuentie day of Junii jM vC threescoire tuelffe yeeres, in all and sindrie heedis, articles, clauss and circumstances therof, and willis and grantes and, for his majestie and his successoures, with advyse and consent foirsaid, decernes and ordeanes that this present confirmatione is and shall be alse effectuall and valied to the said burghe of Brichane, proveist, baillies, counsell and commontie thairof and ther successoures in all tymecomeing as if the foirsaidis chartores, infeftmentes and otheres rightes respective foirsaid wer word be word insert herein; quhairanent, and with all defectes and inconvenientes that may fallow theron, his majestie, with consent foirsaid of the estates of parliament, hes dispensit and be thir presentes dispenses for evir. And farder his majestie, with advyse and consent foirsaid, off new gives, grantes and dispones to the proveest, baillies, counsell and commontie of Brechine, now present and ther successoures in all tymecomeing, all and haill the said burghe of Brichine, with the haill priviledges, liberties and immunities therof, and all and sindrie the foirsaidis landis, tenementes, houss, customes, rentes and others respective abovespecified, with the pertinentes, and willis and grantes that the full and only libertie of electing and choosing of ther proveist, baillies, deane of gild, thesaurer and counsall of the said burghe in all tymecomeing shall perteane to the said burgh, conforme to the use, priviledge and custome of other free burrowes within this kingdome, notwithstanding of whatsomevir power, priviledge and libertie quhilke the beshopes of Brichine for the tyme hade or pretendit in the electione and choosing of any of the baillies or magistrates of the said burgh at ony tyme bygone, quhilke power and priviledges of the saidis beshopes his majestie, with consent foirsaid, declaires to be null and abolished, reserveing allwayes to Patrike Maule of Panmure and his aires the choosing of ane of the baillies of the said burgh who shall be constable and justiciarie therin as use is yeerlie in tymecomeing, conforme to the contractes and indentores past betuixt the said Patrike Maule and the said burghe of Brichine thairanent and in maner and wpoun the conditiones mentionat thairin, quhilke his majestie, with consent foirsaid, ratifies and approves in the haill clauss and circumstances therof; and als gives to the said burghe of Brechine, proveist, baillies, counsell and commontie thairof present and to come full and free power, priviledge and libertie as baillies to his majestie and his successoures to receive resignationes of whatsomevir houss, tenementes, ruidis and aikeres of land within the said burgh, libertie and territorie thairof, whilke wer haldine of befoir of whatsomevir beshope, prelat, chapter and other ecclesiasticke persone quhatsomevir at ony time bygone, and to give seasing thairwponn sickelyke as of ony other houss and tenementes holdine of his majestie in free burgage in dew and competent forme, and alse to give and grant seasingis to the aires of the last deceist vasselles of the samene be hespe and stapill according to the use and custome of burghe, quhilke his majestie, with consent foirsaid, declaires to be lauchfull, valied and sufficient to the ressaveres.
