Act anente the erectione of the kirke of Longsyide

Our soverane lord and estates of this present parliament, considdering that his majesties umquhile trust cusigne and counsellour Williame, erle of Mershall, lord Keeth and Altrie etc., being wndoubted patrone of the paroche kirkes and parochine of Petervgie and titulare of the teyndis thairof, lyand within the presbetrie of Deare and shereffdome of Abirdeane, be reasone of the spaciousnes and wydnes of the said parochine and of the many communicantes within the samene, causit build ane new kirke upon ane pairt thairof and named the samene the kirke of Longsyde; lykeas he presented Maister Alexander Irving therto dureing his lyftyme and, with consent of Maister James Merteene, minister at the said kirke of Peterugie, provydit him to the viccarage teyndis of the landis wnderwrittin, lyand nixt adjacent to the said newbuilt kirke, with ane hundreth merkis money of this realme of silver, payable be himselfe and his successoures yeerlie at Whitsonday, and that as ane constant and locall stipend for his service of the cuire at the said kirke. Lykeas the said umquhile erle hade ane great mynd to obteane the samene kirke erected in ane severall paroche kirke be itselfe and the tounes and landis wnderwrittin to be annexit therto, and to be the boundis therof and comprehendit within the samene, wnder the conditione and provisione allwayes falloweing: and that Williame, now erle Mershall, lord Keethe and Altrie etc., sone and air of the said umquhile Williame, erle Mershell, being most willing to forder and prosecute his said umquhile fatheres intentione, is content and consentes that the samene new built kirke be erected in ane severall paroche kirke be it selfe and diswnited fra the said mother kirke of Petervgie, and that the tounes and landis wnderwrittin be united and annexit to the samene new kirke, and be the boundis therof and comprehendit within the samene, wnder the provisione and conditione allwayes subsequent. Therfore, our said soverane lord and estates foirsaidis have made, constitute, create and erected and, be thir presentes, makes, constitutes, creates and erectes the said new built kirke in ane severall paroche kirke and parochine be it selfe, to be callit now and in all tymecomeing heereftir the paroche kirke and parochine of Longsyde, and have united and annexit and be thir presentes unites and annexis all and sindrie the tounes and landis of Rora, Fortrie, Achlie, Dumpstoune, Auchtidonald, Mint Law, Longmure and Inverquhauby2, mylne and mylne landis therof, and Yookishill, with ther haill pairtes, pendicles and pertinentes perteaneing to the said Williame, erle Mershell; and sicklyke all and haill the landis of Ludquherne, the tounes and landis of Auchtidore, Kleyhilles, Blexboige, Newtoune, Weshinpole, Tarrhendred, Lennabo, with the new and old mylnes of Ludquherne and mylne landis thairof and haill pertinentes, pairtes and pendicles of the saids tounes and landis respective perteaneing to Sir Williame Keith of Ludquherne, knight; as also all and haill the landis of Netherkinmundie, the tounes and landis of Tifrrie, Inverveddie, Thumertoune and Knockleith with the mylne, mylne lands, pairtes, pendicles and pertinentes thairof, perteaneing to Frances Fraiser of Kinmundie; as also all and haill the toune and landis of Fauchfeeld, Dennes, Over and Nether Savokes, with the mylne, mylne landis and all thair pairtes, pendicles and pertinentes perteaneing to Williame Fraisser of Fauchfeeld; as lykewayes all and haill the landis of Buthlaw, Cadgerhill, Thunnertoune and Longhill, with ther pertinents, perteaneing to Alexander Forbes of Boynlew; and all and haill the landis of Cangall, Hillheed, Boigsyd and Auchquhittrie, with the mylne, mylne landis and ther pertinentes perteaneing to Johne Arbuthnot of Carnegall, to the said new built and erected kirke of Longsyde, and declaires the samene tounes, landis and othere foirsaidis to be the boundis of the said parochine and comprehendit within the samene. And alse his majestie and estates foirsaidis makes, constitutes and ordeanes the said Williame, erle Mershall, his aires maill and successoures patrones of the said new erected kirke of Longsyd, and ordeanes and declaires him and them to be and remaine patrones therof in all tymeheereftir sicklyke and alse freelie in all respectes as he and they are patrones of the said mother kirke of Petervgie, notwithstanding of the disuniting of the samene fra the said mother kirke and that no mentione is made of the patronage of the said new erected kirke in his infeftment. And farder, his majestie and estates foirsaidis have ratified and approvine and, be thir presentes, ratifies and approves the presentatione, collatione and institutione made and granted to the said Maister Alexander Irving of the said kirke and stipend therof foirsaid, in the haill heedis and articles thairof, and willis and grantes that this present generall ratificatioune and approbatione of the samene is and shall be alse valied, effectuall and sufficient to the said Maister Alexander as if they and everie ane of them were at lenth word be word ingrossit and set doune heerintill, quhairanent his majestie and estates foirsaidis have dispenssit and be thir presentes dispenses for evir. Provyding allwayes, lykeas it is heerby provydit and declaired be express provisioune and conditione of this present act that the saidis Williame, erle Mershell and his aires maille and successoures nor ther landis nor teyndis within the said new erected parochine of Longsyde or within the said old parochine of Peterugie shall be burdeened with no farder stipend to the said Maister Alexander Irving and his successoures ministers serveing the cuire at the said kirke of Longsyde, nor his pairt of the viccarage teyndis of the landis foirsaidis within the said new erected parochine of Langsyde, and soume of ane hundreth merkes money foirsaid, quhairto the said Maister Alexander is allreddie provydit, sua that if any farder stipend be augmentatione be granted to him and his saidis successoures, it is heerby declaired that the said Williame, erle of Mershall and his foirsaidis and there landis abovewrittin within the parochine of Longsyde, as also his landis within the parochine of Peterugie and teyndis of the samene, are and shall be alltogidder free thairof, and only the remanent heritoris within the said parochine of Longsyde and ther landis foirsaidis and teyndis therof subject and lyable to the payment of the samene greater stipend or augmentatione whilke shall happine to be granted as said is, without ony releeffe aganest the said Williame, erle Mershell or his foirsaidis, wnder the quhilke provisione and conditione and no otherwayes it is heerby declaired that this present act and erectione foirsaid of the said kirke is made and granted.
