Ratificatione in favoures of the Duke of Lennox

Our soverane lord and estates of parliament ratifies, approves and confirmes the signatoure and gifte granted be his majestie, as now haveing right to the landis, barrony and otheres eftirspecifeit of the temporalitie of the late archbeshoperike of Glasgow, as vacand and become in his majesties handis and at his hienes dispositione throw the abolishing of the estate of archbeshopes and beshopes within this realme for the causes onerous contein[it] in the said signatour, to and in favoures of his hienes darest cusigne and counsellor James, duke of Lennoxe and Richmond etc., and his aires maill mentionat and conteyned in his infeftment of the dukedome of Lennox, quhilkis failyeing, to his aires and assigneyes whatsomevir, viz: off all and sindrie the landis, lordshipe, burghe, barronyes, regalitie and otheres eftirspecifeit, that is to say: all and haill the landis and barrony of Glasgow, castle, citie, burghe and regalitie of Glasgow, with all landis, boundis and tenementes, houss, biggingis, orchyairdis, yairdis, tailles, killis, barnes, brewhouss and other biggingis within the said burgh, with all other castles, toures, fortalices, maner places, orchyairdis, yairdis, wodis, mylnes, fishingis, annexis, connexis, pairtes, pendicles, tennentes, tennendries, service of free tennentes and all other ther pertinentes; off all and haill the landis and barrony of Cairstaires, with the castelles, toures, fortalices, maner places, orchyairdis, yairdis, wodis, mylnes, fishings, annexis, connexis, outsetis, pairtes, pendicles, tennentes, tennendries, service of free tennentes and all ther pertinentes; all and haill the landis and barrony of Erlestoun2, with castles, toures, fortalices, maner places, orchyairdis, yairdis, wodis, mylnes, fishingis, annexis, connexis, outsetts, pairtes, pendicles3, tennentes, tennendries, service of free tennentes and all ther pertinentes, lyand within the shereffdome of Peibles; all and haill the landis and barrony of Ancrume with castles, toures, fortalices, maner places, orchyairdis, yairdis, wodis, mylnes, fishingis, annexis, connexis, outsetes, pairtes, pendicles, tennentes, tennendrees, service of free tennentes and all ther pertinentes; all and haill the landis and barrony of Stobo, with the castles, toures, fortalices, maner places, orchyairdis, yairdis, wodes, mylnes, fishingis, annexis, outsetes, pairtes, pendicles, tennentes, tennendries, service of free tennentes and all ther pertinentes; all and haill the landis and barrony of Lilisleiffe, with castelles, toures, fortalices, maner places, orchyairdis, yairdis, wodis, mylnes, fishingis, annexis, connexis, outsettes, parts, pendicles, tennentes, tennendries, service of free tennentes thairof, and all ther pertinentes; all and haill the landis and barrony of Eskirke, with castelles, toures, fortalices, maner places, orchyairdis, yairdis, mylnes, fishingis, annexis, connexis, outsettis, pairtes, pendicles, tennentis, tennendries and service of free tennentes therof, and all ther pertinentes, lyand within the shereffdome of Roxburghe; all and haill the landis of Beshopes Forrest, and right and priviledge of regality within the samene; all and haill the landis of Niddrie Forrester; the landis callit Halfepenny Land of Carrike; the kirke landis of Cambusnethane; and all and whatsomevir landis perteaneing of old to the archbeshoprike of Glasgow wherevir the samene ly within this realme, priviledges and immunities thairof quhatsomevir. Togidder also with the heritable right of the nominatione and yeerlie electione of the proveist, baillies and other officeres of the magistracie of the said burghe and citie of Glasgow alse ample as perteaned to the archbeshopes of Glasgow of before, and makeand, constitutand and ordeaneand the said Duke of Lennox and his successoures lordis of the regalitie of the barrony of Glasgow and of the Beshopes Forrest within the haill boundis therof, alsweell propertie as tennendrie, and of all other lands and barroneyes within the whilks the saidis archbeshopes of Glasgow had regalitie of before, with ample poures and priviledges to the said Duke of Lennox and his successoures thairanent in maner at lenth set doune in the said signatoure and gifte, and unitand, anexand, creatand and incorporatand all and sindrie the landis, lordshipe, barronies, burgh and regalitie abovementionate with castles, toures, fortalices, maner places, orchyairdis, yairdis, midowes, wodis, mylnes, fishingis, offices, tennentes, tennendries, service of free tennentes, outsettes, pairtes, pendicles and otheres generallie and particularlie abovespecifeid, and all ther pertinentes, in ane haill and free barrony, temporall lordshipe and regalitie, with the priviledge of free chapell and chancellarie and other priviledges, immunities, liberties, honoures, dignities, casualities, proffittes, dewties and commodities whatsomevir perteaneing to ane free regalitie, within the said barrony of Glasgow and Beshops Forrest, and within all other landis, barronyes and otheres wherin the saidis archbeshopes of Glasgow had regalitie of befor to the said James, now duke of Lennox and Richmond and his foirsaidis, to be callit now and in all tymecomeing the lordshipe of Glasgow, ordeaneing ane seasing now to be tane be the said James, duke of Lennox and Richmond, and be his aires foirsaidis in all tymecomeing, at the castle and fortalice of Lochewode to stand and be ane sufficient seasing for all and sindrie the saidis landis, lordshipe, barronyes, office and otheres abovewrittin, to be ane sufficient seasing with dispensatione thairanent in maner specified in the said signatour, all to be holdine of our soverane lord and his hienes successoures in fewferme and heritadge for evir, for yeerlie payment to his hienes and his successoures, ther chalmerlanes and factoures in ther names, for the saidis landis, lordshipe and barrony of Glasgow, castle, citie, burgh and regalitie thairof, with the priviledges and pertinentes abovespecifeid, the soume of tua hundreth merks money of Scotland; for the saidis landis and barrony of Carstaires, with ther pertinentis, fourtie merkis money foirsaid; for the saidis landis and barrony of Stobo, with the pertinentes, threescoir merkis money foirsaid; for the saidis landis and barrony of Erlstoun4 the soume of therttie merks; for the saidis landis and barrony of Ancrum, with the pertinentes, the soume of fourtie fyve merks; for the saidis landis and barrony of Leillisleiffe, with the pertinentes, the soume of fourtie four merks; for the saidis landis and barrony of Eskirke the soume of fourtie fyve merks money foirsaid; for the saidis landis of Beshops Forrest, with the pertinentes, the soume of tuelffe merks; for the saidis landis of Niddrie Forrester, with the pertinentes, the soume of ten merks; for the landis callit Halfepenny Land in Carrike, aucht merkis; and for the saidis landis of Cambusnethane, ane merke; extending in the haill to the soume of fyve hundreth merks usuall money of this realme of Scotland, at the terme of payment specifeit in the said gifte in name of fewferme allenerlie, as the said signatour and gifte granted be his majestie to the said Duike of Lennoxe and his foirsaidis, therwpoun signed and superscryed with his majesties hand of the daite the sext of September last, at mair lenth beeres; with the chartour, infeftment and seasing to fallow thairwpoun, in all and sindrie the heedis, poyntes, clauss, articles, circumstances and conditiones thairincontenit, and eftir the formes and tennoures therof in all poyntes. Lykeas our said soverane lord, with advyse and consent of the saidis estates of parliament, be thir presentes, gives, grantes and dispones to the said James, duke of Lennox, his aires foirsaidis, all and sindrie5 the saidis landis, lordshipe and barony of Glasgow, castle, citie, burgh and regalitie of Glasgow, with the right of nominatione of the proveist, baillies and magistrates of the said burghe as said is, landis and barronyes of Carstaires, Stobo, Erlestoun6, Ancrum, Leillisleeffe, Esskirke, the saidis landis of Beshopsfrorrest, the landis callit Halfe Penny Land of Carrike, the lands of Niddrie Forrester, and kirke landis of Cambusneth, and all other tounes and landis particularlie and generallie abovementionate, with castles, toures, fortalices, maner places, orchyairdis, wodis, mylnes, fishings, annexis, connexis, pairtes, pendicles, tennentes, tennendries, service of free tennentes and all ther pertinentes, all to be unit, annexit and incorporate in the haill and free lordshipe and regalitie, with free chappell and chancellarie, with the heritable right of the nominatione of the magistrates of the said citie of Glasgow, and other priviledges conteyned in the said signatour, to be holdine of our soverane lord and his hienes successoures in few ferme, heritadge, free temporall lordshipe and regalitie for payment of the yeerlie few duetie abovewrittin in maner, forme and withall the liberties and priviledges mentionat and set doun in the said signatoure. And our said soverane lord and estates of parliament for this effect ordeanes the said signatour to be past and expede throw the haill registeres and seales without the advyse and consent of his hienes thesaureres, comptrolleres and collectoures principall or deputie and remanent commissioneres of exchekker to be sought or craved therto, as is appoynted be the said signatour, quhilke is heerby declaired to be supplied be this present generall ratificatione and consent of the estates of parliament heerunto in maner foirsaid; and ordeanes the writteres and keeperes of the registeres and seales to proceed in passing of the said signatour throw the haill seales and registers, and expeding ane chartour thairon at the great seale, and in derecting of preceptes of seasing to fallowe thairon, notwithstanding the samene be not past and subscryved be the commissioneres of excheker, nor ther consent craved therto, as was appoynted be the said signatoure; quhairanent our said soverane lord and estates of parliament dispenses be thir presente. And our said soverane lord and estates of parliament willis, grantes, decernes and ordeanes that the said infeftment sua to be past wpoun the said signatour is and shall be ane good, valied and sufficient right to the said James, duke of Lennox and his foirsaidis for bruiking and joysing of all and sindrie the forsaids landis, lordshipe, barronyes, burgh and regalitie abovementionat, with the castelles, toures, fortalices, maner places, orchyairds, yairdis, midowes, wodis, mylnes, fishingis, offices, tennentes, tennendries, service of free tennentes, outsettes, pairtes, pendicles and wtheres generallie and particularlie abovespecifeid, and all thair pertinentes, in ane haill and free barrony, temporall lordshipe and regalitie with the priviledge of free chappell, chancellarie and other priviledges, immunities, honoures, dignities, casualities, proffites, dueties and commodities whatsomevir perteaneing to ane free regalitie within the barrony, forrest and otheres boundis speciallie and generallie abovewrittin, in fewferme heritablie, irredeemablie and perpetuallie in all tymecomeing, but obstacle, impediment, contradictione or againe calling whatsomevir.
