Ratificatione to the Laird of Barnes and James Maxwell
Our soverane lord and estates of this present parliament ratifies and approves the letters patent granted be his majestie wnder his hienes great seale of this kingdome, of the dait the tuentie tuo day of Apryle jM vjC therttie sex yeeres, to James Maxwell of Innerweeke, ane of his majesties bed chalmer, and to Johne Cunynghame of Barnes, thair aires and assigneyes, for erecting and menteyneing of ane lighte wpoun the Ile of Maii; and for mentinance therof, hes givine to theme ane impost and dewtie of tuo shilling Scottes to be payed upoun the tune of all shipes and vesshellis cuming within Dunnoter and St Tobes Heid be natives, and four shillingis money foirsaid to be payed be strangeres, for ilke veadge in maner and dureing the space conteyned in the saidis letters patent, as the samene of the dait abovewrittin at mair lenth proportes; togidder with ane act of conventione of burrowes of the dait at Edinburghe, the therteene day of September jM vjC therttie nyne yeeres, quhairintill the saidis patenteres being willing to give all reassonable satisfactione to the commissioneres of burrowes then conveined, they then restricted the foirsaid patent and duetie abovewrittin therineconteyned to this quantitie, viz: to eighteene penneyes Scottes to be payed be the natives and three shilling Scottes to be payed be strangeres wpoun ilke tune of shipes and otheres veshelles comeing within the foirsaidis boundis, as also declaired that all barkes, creirkes and otheres weschelles comeing from any pairt within this kingdome within the saidis boundis or passing to ony pairt within the kingdome dureing the monethes of Maii, Junii and Julii, and fyftene dayes of August farder for northland victuelles, shall bee free of all duetie whatsomevir; lykeas the saidis patenteres, be the foirsaid act, obleist them, there aires and assigneyes not to exact nor seeke any greater duetie nor the restricted duetie abovewrittin, bot renunced the samene greater duetie for evir, in respect wherof the saidis commissioneres of burrowes, in name of there burrowes, obleist them to cause ther neighboures make thankfull payment to the saidis patenteres of the foirsaid restricted duetie and to assist them in the wplifting and collectione therof fra the natives and strangeres whenever they shall come within ther boundis and liberties, as also to delyver to the saidis patenteres ane list and inventar of the haill shippes perteaneing to ther burghes, with the nomber and quantie of the tunes of ilke shipe, that conforme therto the patenteres and there foirsaidis may wplifte the said restricted duetie dureing the tyme of the patent, as the said act of the conventione of burrowes of the dait abovewrittin at mair lenth beeres, in the haill heedis, articles, clauss, priviledges, circumstances, conditiones and restrictiones mentionat in the foirsaids letters patent, and in the said act of conventione of burrowes respective foirsaidis, and that conforme to the restrictione abovewrittin mentionat in the samene act for the quantitie of the duetie and tymes conteyned therintill and remanent heedis and conditions of the samene, and according to the tennour therof and of the letters patentes foirsaidis sua fare as the saidis letters patentes are not restrict nor impaired be the foirsaid act of the conventione of burrowes in maner conteaned in the samene act. And allse oure said soverane lord and estates of parliament declaires that this present generall ratificatione is and shall be alse valied and effectuall in all poyntes as if the letters patent and act of burrowes foirsaid wer at lenth and word be word insert heerintill, albeit the samene be not sua done; quhairanent our said soverane lord and estates foirsaidis heerby dispenses for ever and ordeanes the foirsaidis letters patent and act of burrowes to be good, valied and effectuall to the saidis patenteres conforme to the tennours therof and conforme to the restrictione and relevant conditiones and obleismentes specified in the said act of burrowes, and this present ratificatione of the same, and ordeanes letters and executione to be directed wpoun the foirsaidis lettires patent and act of burrowes in maner to the effect respective therinmentionat and conforme therto, and for the restricted duetie conteaned in the said acte.
