Ratificatione to Thomas Forbes of Watertoune

Our soverane lord and estates of parliament ratifies and approves the charter and infeftment granted be the kingis majestie to Thomas Forbes of Watertoun, his aires and assigneyes therincontenit, of all and haill the landis, fortalice and maner place of Abbotshall of Ellon, with the greene yairdis and midow thairof, the landis of Candiland with the mylne, mylnelandis and pertinentes therof, and teyndshaves of the samene, and als of all and sindrie the teyndshaves of all and haill the landis of Watertoune, Eister Ellon, Creheid, with the mylne landis therof, Billmakessie, Coillhill, Cassigillis, Pyktillhim, Smiddie Crofte, Rudes of Ellon and Fuirdaill House, and of the auchteene pairtes of the fauldis of Carmucke, with the pertinentes of the samene, and alse of the teyndis of his salmond fishing wpoun the water of Ythane, alsweell be cobillis and nettes as cruves, begineand at Netherfuird and ascending wpward to Segefuird of Fyve, all lyand within the shereffdome of Aberdene, wnder his hienes greate seale, of the dait the tuentie nynt day of Merch, the yeere of God jM vjC threttie four yeeres, with the resignationes therof wheron the samene proceidit and precept and seasing falloweing therwpoun; and alse the infeftmentes, chartoures and rightes made and granted be Charles, erle of Dumfermeling and his predicessours to the said Thomas Forbes and Jeane Ramsay, his spous, the langest liver of them tuo, in conjunctfie, there aires and assigneyes therin conteyned, or to any of the said Thomas, his predicessours and authoures, off all and haill the landes of Watertoune, Eister Allone and Oreheide2, with the corne and walkemylnes thairof, mylnelands, astricted multores, suckine and knaveshipes of the saidis landis, with all and sindrie ther houss, biggingis, yairdis, toftes, croftes, outsettes, insettes, pairtes, pendicles and pertinentes therof lyand as said is; and sicklyke the chartoures, infeftmentes and rightes mad and granted be the kingis majestie and James, than lord of Deskefoord, now erle of Findlater, and ther predicessoures, to and in favoures of the said Thomas Forbes and his authores, ther aires and assigneyes of the said sallmond fishing upoun the said water of Ythane, alsweell bee cobillis and nettis as in the cruves therof, beginand at the said Netherfoord and ascending wpward to the said Segefurde of Fyvie; as lykewayes the chartoures, infeftmentes and rightes mad be the laite pretendit Archbeshope of Saint Androwes and his predicessoures to the said Thomas Forbes and his authoures, thair aires and assigneyes of all and haill the saidis landis of Ballmakessie, Coillhill, Cassigillis, Pyktillhim, Smiddie Crofte, Rudis of Ellone and Fuirdaillhouse and auchteene pairtes of the saidis fauldis of Carmuke and haill houss, biggingis, yairdis and wtheres pertinentes of the samene lyand as said is, togidder with all preceptes and seasingis fallowing therwpoun and haill grounds wheron the samene proceidis, of whatsomevir daites, tennor and contentes the samene be of, in all and sindrie the heedis, poyntes, clauss, articles, circumstances and conditiones therinconteaned, and efter the formes and tennors therof in all poyntes, togidder with the said Thomas Forbes, his possessione apprehendit be him of the saidis landis, mylnes, teyndis, fishingis and otheres abovewrittin with the pertinentes be vertewe of the saidis rightes. And our said soverane lord and estates of parliament willis and grantes, and for his hienes and his successoures decernes and ordeanes that the generality of this present ratificatione is, nor shall nowayes, be hurtfull nor prejudiciall therwnto in any sort, bot the samene to be alse effectuall and sufficient and of alse great force, strenth and effect as if the saidis haill infeftmets and rightes speciallie and generallie abovewrittin heirby ratified ware all at lenth de verbo in verbum ingrossit and conteyned in this present ratificatione; quhairanent, and withall other defectes, imperfectiones and objectiones quhilkis may be proponit or alledged in the contrair againes the saidis rightes or any of them and validity of the samene, or this present ratificatione therof, our said soverane lord and estates of parliament hes dispensit and, be thir presentes, dispenses for evir.
