Act in favour of the Maister of Elphingstoun

Oure soverane lord and estates of this present parliament ordaines ane ratificatioun to be maid thairin ratifiand, approvand and, for his hienes and his successors, perpetuallie confirmand the chartor maid, givin and grantit be his hienes umquhile darrest father James, be the grace of God, king of Great Britane, France and Ireland, defendar of the faith etc., to his hienes lovitts Alexander, maister of Elphingstoun, for the haill, and Dame Elizabeth Drumond, his spous, the langest leivar of thame tua in conjunctfie, for ane pairt, and the airs male lawfullie gottine or to be gottine betuix thame, quhilks failyeing, the said Alexander, maister of Elphingstoun, his airs male, beirand the surname and armes of Elphingstoun in fie heretablie, of all and haill the lands, lordschip and baronie of Elphingstoun, with the castell, tower, fortalice, maner place, houses, biggings, yeards, orcheards, dowcatts, mylnes, mylne lands, multors, sequells, knaveschips, coalles, coallheuches, wodes, forrests, parkes, haynings, medowes, fischings alsweill of salmond as uther fisches, with all years, cruifes as all uther ingines of fisching in all the pairts of the water of Forth, pairts, pendicles, annexis, connexis, dependences, tennents, tenandries, service of frie tennents thairof and all thair pertinents, with full power, priveledge and libertie to bigge and have ane ferrie boatt and coble at Elphingstoun for transporting of his hienes lieges and all uther straingers one baith the sydes of the said water in all tyme coming; the fourt pairt of the lands of Arthbege, with the dowcatts, colles, collheuch, and pertinents; all and haill the lands of Bannokburne, mylnes, multors, dowcatts, colles, coallheuches and pertinents thairof, togider with ane oxingait of land in the hill of Airth, callit the Roschill, with the dowcatts, coalles, coallheuches and pertinents; all and sundrie the lands of Carnok, quarrell and plaine, with the dowcatts, coalles, coallheuches and pertinents thairof; the lands of Craigeforth with the mylnes, mylne lands, multors, wodes, parkes, schawes and fischings of salmond, alsweill as uthers fischings, in all pairts of the said water of Forthe, with the cruiffes and yairs, dowcatts, coalles, coallheuches and all uthers pertinents, with the toures, fortalices, maner places, yeards, orcheards, houses, bigginges, medowes, parkes, schawes, mylnes, multurs, wodes, docatts, fischings, cruifes, coalls, coallheuches, pairts, pendicles, annexis, connexis, dependences, tennents, tennandries, service of frie tennents of all and sundrie the saidis lands and uthers particularlie abonewrittine, with all thair pertinents, all lyand within the shirefdome of Striveling; and all and haill the half of all and sundrie the lands and baronie of Calder, with the tower, fortalice, maner place, tennents, tennandries, service of frie tenents thairof and all thair pertinents, in speciall warrandice and secuiritie of all and haill the saidis halles of Arthe, with the fischings thairof, and of certane uthers lands mentionat in the said chartor, lyand within the shirefdome of Perth, and of divers and sundrie uthers lands, lordschipes, baronies, mylnes, wodes, fischings and uthers mentionat in the said chartor; reserving alwayes to Alexander, lord Elphingstoun his frank tenement or lyfrent of all and sundrie the saidis lands, lordschip, baronie and uthers contenit in the said chartor, except thes lands and uthers thairin mentionat quhairin the said Dame Elizabeth Drumond is provydit and infeft in conjunctfie in maner thairin mentionat, and the unioun and incorporatioun of all and sundrie the saidis townes, lands, mylnes, wodes, fischings and uthers abonewrittine thairin contenit in all and haill ane frie lordschip and baronie, callit the baronie of Elphingstoun, to be haldine of our soverane lord and his hienes successors in fie heretage, frie lordschip and baronie for service of waird and releiff, quhilkes, with the mariage, quhen it sall happine, ar taxit and liquidat to the particular soumes of money to be payit thairfor in maner specifiet in the said chartor, as the samen wnder his majesties great seale, of the dait the fyft day of July, jM vjC and aucht yeirs, at mair lenth beirs, with the precept of sasing following thairupon wnder the testimonie of the great seale of the samyn dait and instrument of sasing following thairupon of the dait the fyfteine day of December, the yeir of God jM vjC and aucht yeirs, in all and sundrie the heades, pointes, pases, clauses, articles, circumstances and conditiones thairin contenit, and efter the formes and tennors thairof in all pointes. And our said soverane lord and estates of parliament wills and grants and, for his hienes and his successors, decernes and ordaines that this present ratificatioun of the said infeftment, chartor, precept and sasing is and sall be of als great force, strenth and effect to the said Alexander, maister of Elphingstoun, his airs male and assignais forsaidis, for bruiking of all and haill the saidis lands, lordschip and baronie of Elphingstoun, comprehending the particular townes, lands, mylnes, fischings, coalles, coallheuches and uthers abonewrittine, with the pertinents, unite and annexit in the said lordschip and baronie of Elphingstoun, as if the said chartor, precept and instrument of sasing wer all at lenth de verbo in verbum insert, ingrossit and contenit in the said ratificatioun; quhairanent, and with all uther defects and imperfectiones quhilkes may be proponit or alledgit againes the said infeftment, chartor, precept and sasing and this present ratificatione thairof and validities of the samyne, oure said soverane lord and estates of parliament hes dispensit and, for his hienes and his successors, be thir presents, dispenses for ever, and that the said ratificatioun be farder extendit in the best forme with all clauses necessar.
