Act in favour of Sir Richard Murray of Cokpull

Oure soverane lord and estates of this present parliament, having consideratione of the trew and thankfull service done to his majestie and his hienes most noble progenitors of blissed memorie be Sir Richard Murray of Cokpull, knycht barronet, and his predicessors, ordaines ane act to be maid ratifiand and approvand and, for his hienes and his successors, perpetuallie confirmand that chartor and infeftment of fewferme grantit be oure umquhile soverane lord, King James the Saxt, of blissed and eternall memorie, wnder the great seale, of the dait at Edinburgh, the fyfteine day of Marche, jM vjC and fourteine yeirs, to and in favours of umquhile Sir James Murray of Cokpull, knicht, brother germane to the said Sir Richard, his airs and assignais quhatsumever, of all and sundrie the lands and uthers particularlie wnderwrittine, to witt: the fourtie schilling land of Searigis of auld extent, with the Forrester Medow possest for the tyme be Alexander Cairlell and his subtennents; the half merkland of Howthat, lyand withine the parochine of Mouschill; the tua merk land and half merk land of the towne and lands of Revell, with the saltcott, sandfluires and hous stead thairof; the ten schilling land of Kirkstyle, lyand within the said parochine; the tuentie schilling land of Lochmaben callit Lambertlands; and the fourtie schilling land of Innerfeild, lyand betuix the Castellet and Marjoriesyith, within the parochine of Lochmaben, all lyand within the stewartrie of Annandaill and shirefdome of Dumfreis, all unite and erected be the said infeftment in ane tennandrie, callit the tennandrie of Seariges, with the precept and instrument of sasing following thairupon, togider with ane decreit of improbatione recovered at the instance of his majesties advocat for the tyme. And the said umquhile Sir James Murray, befor the lords of counsall and sessioun upon the tuentie thride day of Marche, jM vjC and saxteine yeirs, againes Johne Caruthers of Howmaines, George Caruthers, his sone, Johne Fergusone in Rivell, Johne Patersone thair, Johne Clerk thair, Cudbert Gask in Kirkstyle, Johne Gask thair and Wilkeine Jonstoun of Elschescheills, decerning and ordaining all and sundrie pretendit infeftments, chartors, rentalls and uthers wreatts particularlie and generallie mentionat in the said decreit maid and grantit to the foirnamit persones, or any of thame, or thair umquhile fathers, guidsirs or any uthers thair predicessors to quhome they micht succeid jure sanguinis, of the lands and uthers particularlie abonewrittine or of quhatsumever pairts or portiones thairof, or of quhatsumever annuelrents or pensiones furth thairof be the foirnamit persones, thair authors and predicessors, or any of thame, to mak na faith in judgment nor outwith in tyme coming; togider also with the submissioun and decreit arbitrall following thairupon sett downe betuix the said Sir Richard one the ane pairt, and Dame Jonat Dowglas, relict of the said umquhile Sir James, Margaret, Elizabeth and Marion Murrayes, thair lawfull dochters, one the uther pairt, of the dait the tuentie nyne day of Junii, jM vjC tuentie ane yeirs, quhairby the saidis pairties submitted thame and all lands and heretages quhilks the saidis dochters as airs of lyne to the said umquhile Sir James micht clame, pretend or have richt to be successione or utherwayes, and anent quhat soumes of money the said Sir Richard sould pay to thame, thairfor to the decisione of Johne, earle of Annandaill etc., than designit Johne Murray of Lochemaben, as onlie judge arbitrator commounlie chosen be baith the saidis pairties, quha, be his said decreit arbitrall pronuncit thairintill be vertew thairof, and of ane prorogatione of the samyne submissione grantit be the saidis pairties, decernit and ordanit the saidis Margaret, Elizabeth and Marione Murrayes to renunce, dispone and overgive to and in favours of the said Sir Richard Murray, his airs male and successors all and sundrie lands, baronies, mylnes, wodes, fischings, advocationes, donationes and richt of patronage of the kirks, benefices, cheplanries, tennents, tennandries, service of frie tennents, annexis, connexis, pairts, pendicles and pertinents of the samen, steidings, taks of lands and teinds, alsweill personage as viccarage, reversiones, rowmes and possessiones quhatsumever quhilks pertenit to the said umquhile Sir James Murray, thair father, umquhile Charles Murray, thair guidssir, or any uthers thair predicessors to quhome they micht succeid jure sanguinis, as the same, conteining divers uthers heads, sett downe in favours of the said Sir Richard, of the dait the nynteine day of November, jM vjC tuentie tua yeirs, quhilk, with the said submissione and prorogatioun quhairupon the samyne proceidit, wer upon the first day of Februar, jM vjC tuentie thrie yeirs registrat in the buikes of counsall and sessioun, mair amplie proports. And inlykmaner that chartor and infeftment wnder the great seale, grantit be oure said umquhile soverane lord, King James the Saxt, of blissed memorie, in favours of the said umquhile Sir James Murray, his airs male and assignais quhatsumever, of the dait the threttie day of Januar, jM vjC and sevine yeirs, of all and haill the salmond fisching and uther fische within the water of Annand, betuix the marche of Brydkirk and the fute of the said water of Annand rinnand in the water of Sulway under the Barnekirk, comprehending the garthes and pules wnderwrittine, viz: the Kings Garthes, Blak Pule, Pule wnder Gallobank, Brig Pule and Mot Pule, togider with all uthers garthes, pules, halds, laiks and netts within the bounds forsaidis, lyand within the stewartrie of Annandaill and shirefdome of Dumfries; as also of all and haill the salmond fisching and uther quhyt fish of the skarris and coupes of Cumertries, betuix the burne callit the Meirbank of Newby rinand in the said water of Sulway, and the skar callit the Brewing Skar perteining to the Lord of Torthorwald, comprehending the skarres wnderwrittine, viz: the Hall Garth Skarre, Litle Hall Skarre, Duchall Skar, Pow Skar, New Skar and Watt Skar, with all uther skarres, drauchts, haulds, laiks and netts within the bounds abonewrittine, lyand withine the parochine of Cumertries and stewartrie forsaid of Annandaill, with all and sundrie uthers pairts, pendicles, priveledges, commodities, easments and richteous pertinents quhatsumever perteining and belonging to the saidis fischings, with the precept and instrument of sasing following thairupon, togider with the service and retour quhairby the said Sir Richard is servit and retourit air male to the said umquhile Sir James, his brother, in the saidis fischings, with the pertinents, with the precept direct furth of the chancellarie for infefting of him thairintill, of the dait the second day of Apryll, jM vjC tuentie ane yeirs, with the instrument of sasing givin conforme thairto; togider also with that act of parliament of the dait the tuentie fourt day of Junii, jM vjC and nyne yeirs, ratifiand to the said umquhile Sir James, his airs male and assignais the first infeftment abonewrittine grantit to him be our said umquhile soverane lord of the said fischings particularlie abonementionat in all and sundrie heads, articles, clauses, obleisments, pointes, pases, circumstances, articles and conditiones of the samyne quhatsumever specifiet and contenit thairintill, dispensand with the generalitie forsaid, and admittand, decernand and declarand the samyne to be als valeid and sufficient in all respects as if everie particular chartor, infeftment or uther writtine wer speciallie at lenth verbatim insert heirintill. Lykas our said soverane lord and estates of this present parliament willes, grants, declairs, statuites and ordaines that the infeftments and uthers richts particularlie and generallie abonementionat, alreadie grantit and quhilkes ar to be obtenit be the said Sir Richard and his forsaidis fra the saidis airs of lyne and uthers haveand entreis, of the lands, fischings and uthers abonewrittine, with the pertinents, ar and sall be ane valeid and sufficient heretable richt and secuiritie to the said Sir Richard Murray, his airs male and assignais forsaidis for bruiking, joysing and possessing of the samyne lands, fischings and uthers abonewrittine, with the pertinents, peaciblie in all tyme coming, as thair awin proper heretage, but any stope, trouble or impediment quhatsumever to be maid or moved in the contrair be any persone or persones, notwithstanding of any defect or infirmitie (if any be) contenit in the saidis infeftments and wreatts; quhairanent our said soverane lord, with advyse and consent forsaid, for his hienes and his successors, hes dispensit and dispenses, ordaining the forsaid act to be ane sufficient supplement of all faults and defects (if any be) contenit in the saidis infeftments, and againes all actione and questiones quhatsumever that can be maid or moved in the contrair; and to be registrat in the buikes of parliament to have the force of ane law and statuite in all tyme coming.
