Act in favour of the minister of Coldinghame
Oure soverane lord and estates of this present parliament, considering that the augmentatione of the stipend eftermentionat is grantit to Maister Cristopher Knowes, minister at Coldinghame, and his successors, for thair service of the cure at the said kirk, thairfor they have ratified and approvine and, be the tennor heirof, ratifies and approves the letters of assignatione and augmentatione of the stipend wnderwrittine maid, givine and grantit be Johne Stewart of Coldinghame, Alexander Cranstoun of Morestoun and Robert Dowglas of Blaikerstoun, heretable proprietars and haveand sufficient richt and title to the lands and lordschip of Coldinghame, kirk and teinds belonging thairto, with expres advise and consent of Johne Home of Rentoun, procutor, factor and commissionar for the said Johne Stewart, for augmentatione of the samyne stipend, as the procuratorie, commissioun and power givin be the said Johne Stewart to him thairanent, of the dait the nynteine day of July, jM vjC threttie tua yeirs, and registrat in the buikes of counsall and sessione upon the nynteine day of July, the yeir of God forsaid, at mair lenth beirs. As als with advyse and consent of Francis Stewart, sone to umquhile Francis, sumtyme earle of Bothuell, and of the uther persones, subscryvers of the said assignatione and augmentatione of the stipend eftirspecifiet, in favours of the said Maister Cristopher Knowes, minister at Coldinghame, and his successors ministers at the said kirk, of the dait at Blakerstoun, Edinburgh and Canongate, the nynt, thretteine and sevinteine and auchteine dayes of July, jM vjC threttie tua yeirs forsaid, and registrat in the saidis buikes of counsall and sessioun and decernit to have the strenth of ane act and decreit of the lords thairof upon the thride day of Junii, jM vjC threttie thrie yeirs instant, be the quhilk, for the causes thairinspecifiet, they condiscendit and agriet to give to the said Maister Cristopher Knowes and his successors ministers at the said kirk, in augmentatione of thair present stipend of tua chalder victuall, half aites, half beir of the mett and measure usit of auld in Dunse, payit to him furth of the teinds of the towne of Coldinghame and teind barneyeard thairof, with the viccarage teinds of the said parochine ipsa corpora yeirlie in tyme coming, all and haill thrie chalders victuall, half beir, half mukitland aittes of the mett and measure usit of auld in Duns, to be payit to the said Maister Cristopher and his successors furth of the teinds of the said parochine in maner efter specifiet, by and attoure the saidis tua chalders victuall of the said auld mett and measure of Duns quhilk he hes to be uplifted out of the teinds of the towne of Coldinghame and teind barneyeard thairof and viccarage teinds of the said parochine modifiet to the said minister of Coldinghame be the infeftment of erectione of the said lordschip in maner specifiet in the said assignatione and augmentatione; and be the quhilk, for the causes specifiet thairin, they assignit the saidis thrie chalders victuall of augmentatione to be locallie payit to the said Maister Cristopher and his successors ministers at the said kirk furth of the teinds wnderwrittine lyand within the said parochine of Coldinghame, according to the localitie following, viz: furth of the teindscheaves of the haill towne and lands of West Reston, with thair pertinents, lyand within the said parochine of Coldinghame and shirefdome of Bervick (except the teindscheaves of thes fyve husband lands and ane half husband land, with the pertinents, lyand in the said towne of West Reston perteining heretablie to Patrick Craw in Huchead and occupyit be him and his tennents); and incaice the saidis teindscheaves of the said towne and lands of West Reston, with the pertinents (except befor excepted), sall not extend to and be able and sufficient to pay the saidis thrie chalders victuall of augmentatione yeirlie or in any yeir in tyme coming, than and in that caice the superplus thairof quhilks the saidis teinds of the said towne and lands of West Reston (except befor excepted) be is not able to pay yeirlie or in any yeir in tyme coming, to be uptakine furth of the teindscheaves of thes fourteine husband lands lyand in Swynwood, with the pertinents, lyand withine the parochine and shirefdome forsaid perteining to James Craw of Quhytfield and Maister Alexander Smith, minister at Shirinesyde, and the airs and successors of umquhile Williame Craw of Fallowbank for payment of the saidis thrie chalder of victuall of augmentatione abonewrittine of the said ald measure of Duns as said is, beginnand the first yeirs payment thairof of the crope and yeir of God jM vjC threttie tua yeirs, and sua furth yeirlie in all tyme coming in maner specifiet in the said augmentatione and assignatione to the localitie thairof, as in the samyne beirand consent to be ratifiet and allowit be the lords commissioners for the surranders and teinds, and that decreit be givin thairupon be thame in favours of the said Maister Cristopher and his successors according to the localitie forsaid in sick dew and suire forme as effeirs. And als that the said augmentatione and assignatione to the localitie thairof, and decreit to have followit thairupon, wer ratifiet and approvine in this his hienes present parliament, with sundrie uthers heads, conditiones, articles and clauses at mair lenth is contenit, togider with the saidis lords of counsall and sessioun, their decreit and authoritie interponit thairto, and with the said procuratorie, commissioun and power givin be the said Johne Stewart to the said Johne Home of Rentoune for agreing and consenting to the said augmentatione, with the decreit of the saidis lords interponit thairto, in all and sundrie the heads, articles, clauses and conditiones thairof respective. And wills and declairs that this present generall act, ratificatione and approbatione thairof is and sall be als lawfull, effectuall and sufficient, as if the samyne wer at lenth word be word heirin exprest; anent the quhilks and all faults and imperfectiones thairof, if any be or that may be proponit or alledgit againes the validitie thairof or this present act, ratificatioun and approbatioun of the samyne, his majestie, for him and his successors, with advyse and consent of the estates of this present parliament, hes dispensit and, be the tennor of this present act, dispenses for ever; and statuites and ordaines that the said augmentatione of stipend and assignatione to the localitie thairof sall stand as ane perpetuall law and act of parliament and have full executione for payment thairof in all tyme coming.
