Act in favour of James Scott of Gallowscheills

Oure soverane lord and estates of this parliament ordaines ane ratificatione to be maid thairine ratifiand, approvand and, for his hienes and his successors, perpetuallie confirmand, lykas be the tennor heirof our said soverane lord and estates of parliament ratifies, approves and, for his hienes and his successors, perpetuallie confirmes, the chartor maid, givin and grantit be our said soverane lord, with advyse and consent of his principall thesaurar, deputtie thesaurar and remanent lordes of his hienes exchecker of Scotland, his hienes commissioners, to and in favours of his hienes lovitt James Scott, eldest lawfull sone to Hew Scott of Dewcher, procreat betuix him and Jeane Pringle, his spous, dochter to Sir James Pringle of Gallowscheills, knicht, his airs male and assignais quhatsumever heretablie, of all and haill the lands and baronie of Gallowscheills, comprehending the particular townes, lands, burgh of baronie, advocatioun, donatioune, richt of patronage and uthers wnderwrittine, viz: all and haill the lands and steidings of Gallowscheills and Mosilie, with the pendicles thairof callit Nether or Eister Maynes; of Boylesyd Stobrig, with the tower, fortalice, mansioun, maner place, houses, biggings, wodes, cornemylnes and walkmylnes thairof, and with the fischings of salmond and uthers fischings upon the water of Tueed one baith the sydes thairof betuix the bridge of Melros and lands of Southerlandhall, quhair the water of Atrick rines in the said river of Tueid, with all and sundrie the annexis, connexis, tennents, tennandries, service of frie tennents, pairts, pendicles and pertinents thairof quhatsumever, with the burgh of baronie of Gallowscheills, and with all and sundrie mercatts, fairs, liberties, priveledges, immwnities, profeitts, commodities, easments and richteous pertinents perteining and belonging thairto; togider with the advocatione, donatione and richt of patronage of the viccarage of the kirk of Lymdane, with all priveledges, benefeits, liberties and commodities thairof, lyand within the lordschip of Atrickforrest and shirefdome of Selkirk, upon the resignatioun of the said Sir James Pringle of Gallowscheills, knicht, maid be him, with consent of Johne and Maistir George Pringles, his sones, and of the said Hew Scott and Jeane Pringle, his spous; and als the new gift and dispositioun contenit in the said chartor maid be his majestie to the said James Scott, his airs male and assignais forsaidis heretablie, of all and haill the saidis lands and baronie of Gallowscheills, comprehending the particular townes, lands, fischings, mylnes, wodes, burgh of baronie, advocatioun, donatioun, richt of patronage and uthers abonewrittine, with thair pertinents, and of all richt, title, entreis, clame of richt, propertie and possessioun quhatsumever quhilks his hienes, his predicessors or successors had, hes or anywayes may clame, pretend or have thairto or any pairt thairof, with the unioun, annexatioun and incorporatioun of the samyne in ane haill and frie baronie, to be callit now and in all tyme coming, as of befor, the baronie of Gallowscheills, quhairof the tower, fortalice and maner place of Gallowscheills is ordanit to be principall messwage, and thair ane sasing to be takine in all tyme coming to stand and be sufficient for the haill in maner specifiet in the said chartor, as the samyne beirand the saidis lands and uthers forsaidis, to be haldine of our soverane lord and his hienes successors in fie heretage, frie baronie and burgh of baronie for ever in maner specifiet in the said chartor, quhilk is wnder his majesties great seale, of the dait at Halyrudhous, the nynt day of Junii, the yeir of God jM vjC threttie tua yeirs at mair lenth beirs, with the precept of sasing following thairupon wnder the testimonie of the said great seale of the samyne dait, and instrument of sasing following thairupon, of the dait the [...] day of [...], the yeir of God jM vjC threttie [...] yeirs, in all and sundrie the heads, pointes, pases, clauses, articles, circumstances and conditiones thairincontenit, and efter the formes and tennors thairof in all points. And oure said soverane lord and estates of parliament wills and grants and, for his hienes and his successors, decernes and ordaines that this present ratificatioun of the said infeftment, chartor, precept and sasing is and sall be of als great force, strenth and effect to the said James Scott and his forsaidis for bruiking and joysing of the saidis lands and baronie of Gallowscheills, burgh of baronie, advocatioun, donatioun, richt of patronage and uthers abonewrittine thairin contenit, with all thair priveledges, liberties and pertinents in all tyme coming, as if the samyne infeftment, chartor, precept and sasing wer all at lenth word be word insert and contenit in this present ratificatioun; quhairanent, with all uther defects and imperfections quhilk may be proponit or alledgit againes the said infeftment, chartor, precept and sasing or this present confirmatione thairof and validities of the samyne, oure said soverane lord and estates of parliament hes dispensit and, be thir presents, for his hienes and his successors, dispenses for ever; and that the said ratificatioun be farder extendit with all clauses necessar, with provisione alwayes that this present ratificatioun grantit in favours of the said James Scott of Gallowscheill nor na pairt of the same sould be hurtfull or prejudiciall to Robert, earle of Roxburgh, nor to the shireff of Forrest, thair airs nor successors, in thair richt and title of the teinds, personage and viccarage, of the kirk of Lymden as titulars of the same or utherwayes howsoever, bot that the same sould remaine to thame as of befor wnhurt or prejudgit heirby.
