Act in favour of Sir James Hamiltoune of Preistfield
Oure soverane lord, with advyse and consent of his majesties thrie estates of parliament, ordaines ane act of parliament to be maid ratifiand, approveand and, for his hienes and his successors, perpetuallie confirmand, lykas his majestie, be the tennor heirof, with advyse and consent forsaid, ratifies, approves and, for his hienes and his successors, perpetuallie confirmes the actes, decreitts, ratificationes, allowances and uthers eftirspecifiet, viz: ane act of the lords of his majesties high commissioun of the dait the nynteine day of Februar, the yeir of God jM vjC threttie yeirs, quhairby the saidis commissioners, for the caus specifiet in the said act, dismemberit the lands of Preistfield besyde Edinburgh, perteining heretablie to Sir James Hamiltoun of Preistfield, knicht, frome the kirk and parochine of Sanct Cudberts, and uneit, joynit and annexit the saidis lands of Preistfield to the kirk and parochine of Dudingstoun, and ordanit the heretors, tennents and inhabitants of the lands of Preistfield to resort and repair at all necessar occasiones thaireftir to the said kirk of Dudingstoun as to thair ordinar paroche kirk for heiring of the word, participating the sacraments and receaveing the uther benefeits of the kirk. And als ane act of the presbitrie of Edinburgh, daitit the auchteine day of Maii, jM vjC threttie ane yeirs, quhairby for the ornament and inlarging of the said kirk of Dudingstoun thair was ane ile appointit to be built for the use of the said Sir James Hamiltoun, his familie and tennents of the saidis lands of Preistfield one the north wall of the kirk, frome the chancellar wall one the east to the church doore towards the west, of bread and lenth and hight specifiet and contenit in the said act, quhilk act is allowit, ratifiet and subscryvit be the Archibischope of Sanctandrois at Scoone, the tuentie day of Maii, jM vjC threttie ane yeirs, as the saidis actes and ratificatioun thairof of the daits respective abonewrittine in thameselffes at lenth proports, with all that hes followit or may follow thairupon, in all and sundrie heads, articles, circumstances and conditiones specifiet and contenit thairin. And his majestie wills and grants and, for his hienes and his successors, with advyse and consent forsaid of his majesties thrie estates of parliament, wills and grants and, for his hienes and his successors, decernes and ordaines this present confirmatione to be of als great availl, force and effect to the said Sir James Hamiltoun, his airs, assignais and successors as if the forsaidis actes and ratificatioun thairof wer word be word insert heirintill; anent the quhilks, and with all defects and inconvenients that may fallow thairupon, his majestie, with advyse and consent forsaid of his hienes thrie estates of parliament, hes dispensit and, be thir presents, dispenses for ever. And farder his majestie, with advyse and consent forsaid of his hienes thrie estates of parliament, statuites, decernes and ordaines that the forsaidis actes and ratificatioun thairof is and sall be ane good, valeid, effectuall and sufficient richt and secuiritie to the said Sir James Hamiltoune and his forsaidis for bruiking, joysing, using and possessing in all tyme coming of the forsaid ile in the said kirk of Dudingstoun within the bounds mentionat in the forsaidis actes, with the liberties, commodities, priveledges and uthers mentionat and contenit thairin efter the forme and tennor thairof in all pointes. And his majestie, with advyse and consent forsaid, ordaines thir presents to be ane sufficient warrand to the clerk of register for extending of the forsaid act of ratificatioun in dew and competent forme and for inserting the samyne with the rest of the actes of parliament maid and to be maid and sett downe in this instant parliament haldine withine this kingdome of Scotland.
