Act in favour of the Lord Napeir

Oure soverane lord and estates of this present parliament ordaines ane ratificatioun to be maid thairin to and in favours of Archibald, lord Napeir of Merchingstoun, ratifiand and approveand and, for his hienes and his successors, perpetuallie confirmeand the decreit of valuatione givin at Halyrudhous, the tuentie ane day of Marche, the yeir of God jM vjC tuentie aucht yeirs, be the commissioners nominat be the king's majesties for the treattie anent the erectiounes, surranders and teinds, quhairby the saidis commissioners valide and estimat the said Lord Napeir his lands wnderwrittine to be worth yeirlie in constant rent in stock and teind as followes, viz: the lands of Mayresyde to be worth yeirlie in constant rent in stock and teind fyve chalder, fyve bolles beir and quheit; the lands of Gorgiemure to be worth yeirlie in constant rent in stock and teind sax chalders beir; and the threttie thrie aikers of land possest be Williame Hoge and Thomas Fairholme to be worth in constant rent yeirlie in stock and teind thrie chalders and aucht bolls beir; the lands possest be Heleine Tok, Johne Stevinsone and Johne Jobe to be worth yeirlie in constant rent in stock and teind tuentie bolls beir; and the fourtie sax aikers of land occupyit be Johne Broun to be worth yeirlie in constant rent in stock and teind four chalder, tuelff bolls beir; and the lands of Tipperline to be worth yeirlie in constant rent in stock and teind thrie chalders, aucht bolles beir; and the portioun of the maynes of Merchingstoun possest be the said Lord Napeir himselff to be worth yeirlie in constant rent in stock and teind aucht chalders beir; and accordinglie the haill lands of Merchiestoun to be worth yeirlie in constant rent in stock and teind threttie tua chalders victuall of the kinds abonewrittine in maner specifiet in the said decreit, as the samyne in it selff at mair lenth beirs; and als the decreit givin be his hienes exchecker of Scotland upon the nynteine day of Junii, the yeir of God jM vjC threttie tua yeirs, proceiding upon ane suspensioun obtenit at the instance of the said Archibald, lord Napeir of Merchingstoun, againes his hienes principall thesaurar, deputtie thesaurar and thair deputtes having thair power to receave the annwitie of the teinds eftirspecifiet and thair chairges quhairby they war chairgit for payment of the annwitie of the teinds of the saidis lands thairin mentionat yeirlie, the yeirs of God jM vjC tuentie aucht, vjC tuentie nyne, vjC threttie and vjC threttie ane yeirs, extending in the haill the said four yeirs to the soume of ane hundreth thriescoir sevine punds tua schillings money, be the quhilk decreit the saidis lords of exchecker fand the saidis letters raisit at the instance of the saidis thesaurers principall and deputtie againes the said Lord Napeir in the said mater to be ordourlie proceidit, and ordanit the said soume of ane hundreth thriescoir sevine punds tua schillings money consignit as the annwitie of the saidis teinds the saidis yeirs to be deliverit up to Williame Butter, receaver of the annwitie of the saidis teinds, in the saidis thesaurers names, upon ane sufficient discharge, in recompence quhairof the saidis lords ordanit the said Lord Napeir to have retentioun in his awin hand of sa meikle of the tak dewtie of fourteine punds four schilling payable be him to Johne, lord Halyrudhous for the saidis teinds of the cropt and yeir of God jM vjC threttie ane yeirs, as may be equivalent and ansuerable to the annwitie thairof for the saidis four cropes and yeirs of God abonespecifiet, for the reassones and causes contenit in the said decreit, as the samyne also beirs, in all and sundrie the heads, pointes, clauses, articles, circumstances and conditiones thairin contenit, and eftir the formes and tennors thairof in all pointes. And our said soverane lord and estates of parliament wills and grants, decernes and ordaines that this present ratificatioun of the saidis decreits and ather of thame is and sall be of als great force, strenth and effect to the said Lord Napeir, his airs and successors as if the saidis tua decreittes wer all at lenth speciallie and particularlie ratifiet, insert and contenit de verbo in verbum in this present ratificatioun; quhairanent oure said soverane lord and estates of parliament hes dispensit and be thir presents dispenses for ever.
