Commissioun anent the Lord Spynie
In the parliament haldin at Edinburgh, the tuentie aucht day of Junii the yeir of God jM vjC threttie thrie yeirs, anent the signatur givin in and presented to oure soverane lord and estates of parliament be his hienes traist cowsigne Alexander, lord Spynie, off the quhilk signature the tennor followes de verbo in verbum: Oure soverne lord and estates of this present parliament ordaines ane ratificatioun and act to be maid thairine to, and in favours of, his hienes traist cowsigne Alexander, lord of Spynie, ratifiand, approveand and, for his hienes and his successors, perpetuallie confirmand the letters patent and gift maid and grantit be his majestie to him wnder his hienes great seale of the dait the second day of Junii, the yeir of God jM vjC tuentie and sax yeirs, quhairby, for the reassonable causses thairin contenit, oure said soverane lord maid, constituit and ordanit the said Alexander, lord of Spynie, during all the dayes of his lyftyme, general musterdmaister and colonell of all and sundrie troupes and trainit bands of the haill kingdome of Scotland and haill Yles adjacent and perteining thairto, with ample powers and priveledges in maner thairincontenit, as the samyne letters of gift and patent of the dait forsaid in thameselffes at mair lenth beirs in all and sundrie the heads, pointes, clausses, articles, circumstances and conditiones thairincontenit, and eftir the formes and tennors thairof in all pointes. And oure said soverane lord and estates of parliament willes and grants and, for his hienes and his successors, perpetuallie decernes and ordaines that the generalitie of this present ratificatioun is, nor sall nowayes be, hurtfull nor prejudiciall heirwnto in any sort, bot the samyne sall be alls effectuall and sufficient as if the haill tennor of the saidis letters patent and gift wer all at lenth insert in the said ratificatioun, quhairanent oure said soverane lord and estates of parliament hes dispensit and be thir presents dispenses for ever. And becaus his majestie and estates wnderstands assuredlie that the attendance and discharge of the said office and place will require great paines and chairges, quhairthrow his majestie resolvit to have gratifiet the said Alexander, lord of Spynie with some rent ansuerable to his chairges and expenses, and his majestie being wncertane be himselff to modifie any certane or proportionall rent thairfor at the present, not wnderstanding the travell and expenses he may susteine in perfyte discharging of the said office and place, thairfor oure said soverane lord, with advyse of the thrie estates of parliament, hes fund it expedient that the managing of the bussines and modificatione of the rent ansuerable to the charge sall be referrit to the lords of his hienes secreit counsall of Scotland, quha be thair cair may better informe thameselffes of the estate of that mater nor his majestie can doe upon ane suddentie now at his being within this realme, having soe many wechtie adoes and soe short tyme to abyde heir. Inrespect quhaireof, oure said soverane lord, with advyse of the saidis estaits of parliament, hes committed and heirby committes to the saidis lords of his majesties said secreit counsall of Scotland the ordering of that bussines, and gives and committes to thame full powar and commissioun to sett downe and modifie sick soumes of money yeirlie to be payit to the said Alexander, lord of Spynie during his lyftyme as they sall think expedient, and to appoint and impose the same to be payit ather out of his majesties rents or be sick persones as eftir tryell they sall think expedient; and als with power to thame to sett downe sick articles and injunctiones as they sall think expedient for advancement of that service and generallie all and sundrie uther things in the premises to doe that his majestie, with advyse of the saidis estates of parliament, micht presentlie doe. And siclyk, with powar to the saidis lords of secreit counsall to direct out warrands for compelling of the schireffs of the schyres, stewarts of the stewartries, baillies of the bailliaries and regalities, proveist and baillies of borrowes and all uthers judges and ministers of his hienes lawes, alsweill to burgh as land, for performance of sick articles as sall be sett downe be the saidis lords of secreit counsall thairanent, and for that effect to direct out letters of horning and uthers in forme as effeirs, quhairanent thir presents and act to be maid heirupon sall be als sufficient ane warrant as if the same had beine done and past in this present parliament; and ordaines the said ratificatioun and act to be exped in the best forme. Oure said soverane lord and estates of parliament abonewrittine having red, seine and considerit the forsaid signature and commissioun thairincontenit and haill contents thairof, and the samyne being voted in parliament, have given and grantit and, be the tennor heirof, gives and grants full power and commissioun to the lords of his majesties privie counsall, eftir consideratione of the forsaid signature and haill contents thairof, to decreit and determine thairanent as they sall think fitt and expedient, they alwayes causing warne and call befor thame some commissioners for ilk estate to treatt and reassoun in the particulars abonewrittine contenit in the said signature befor they mak any finall determinatione or conclusione thairine.
