Commissioun anent the ladell of Dundie etc.
Oure soverane lord and estates of parliament, having considerit the particular articles and petitiounes wnderwrittine, produicit and givin in parliament viz: ane petitioun givin in be the commissioners of the Shirefdomes of Pearth, Angus and Fyffe againes the burgh of Dundie and magistrates thairof, for the great extortioun usit be thame in exacting ane ladell full of all kynd of victuall, grund and wngrund, presentit to the mercatt of Dundie, having no definit measure nor quantitie quhilk is ane heavie oppressioun; and thairfor desyring oure soverane lord and estates to have respect thairto and to tak sick good ordour thairanent as sall be thoght expedient for the saidis supplicants thair liberatioun in tyme coming. Item, ane petitioun givin in be the tanners and barkars within the kingdome of Scotland desyring that they may be frie and releivit of the burdeine and impositioun imposit upon thame for tanning and barking of hydes, and that the same impost may be dischargit in respect of the great damnage sustenit be the whole cuntrie thairthrow. Item, ane petitioun givin in be Maister David Wedderburne, maister of the grammer skoole of Abirdeine, desyring that the short and facile grammer drawn up be him and his paines may be allowit and ordanit to be taucht universallie through all the skooles of the kingdome of Scotland and all uthers grammers dischargit to be taught withine the samyne. Item, ane article in favours of ministers for friedome of foggage, pasturage, fewell, feall and devatt, and for declaring that the samyne sall be such friedome as the minister hes beine in possessioun of thir ten yeirs bygane; and that thes said pasturage sall conteine sax soumes gress at least out of the kirk lands of the paroche neirest and most ewest quhair they serve, quhairever the samyne may be had, wnles they have prejudgit thameselffes be posterior transactioun, pactioun or conditioun; and that thes quha hes done sua, thair friedome to be such as the transactioun beires; and for declaring that quhatever kirk rent, kirkland, pasturage, fewall, feall, devatt loning frie ische and entrie or uther priveledge hes beine possest be the kirk and ministers serving the cure for thair maintenance out of kirklands, kirk rents or teinds be the space of ten yeires bygane sall stand as ane good richt for broocking thairof in tyme coming. Item, ane article craving that the act anent the pryces to be takin be the maltmen be reformed. Item, ane article desyring some course to be takine for establisching of correctioun houses within severall partes of this kingdome. Item, ane article bearing that since forbidden goodes ar incontrollabillie transportit out of Scotland into England for the benefeit of that kingdome, that the lyke course be also takine that these thinges forbidine in England may in lyke maner be transportit into Scotland without controlement. Item, ane article desyring that some course be takin for inbringing of manufactories and incouraging of such as sall enterpryse the samyne. Item, ane article craving that it may be enacted that all plaiding be presentit to mercattes heireftir in foldes, and that the rolling thairof be dischargit inrespect of the fraud conceillit by the rolling of the same. Item, ane article craving that Buchanes patent anent the pearle be dischargit with all uther monopolles. Item, ane article craving that the bleatchers of lining cloath and uther cloath be inhibited frome bleiching any cloath with lyme wnder paine of punischment of the persones of these that sall bleach with lyme and uther pecuniall soumes to be exacted frome thame. And last, ane article desyring that all actes and impositiones maid and imposit for restraining of the inbringing of victuall may be dischairgit, it being without example in any pairt of the world, and soe much the more that the haill schirrefdomes of Dumbartane, Renfrew, Argyll, Air, Wigtoun, Nithisdaill, Stewartries of Kirkcudbricht and Annandaill and uther pairts ar not able to interteine thamselffes in the most plentifull yeirs that ever fell out without supplie from forraine pairts; as also desyring that sieing victuall is become the greattest commoditie now in Europe, that it may be declarit lawfull to merchands to import the samyne frielie within this kingdome at all tymes without any impositioun as for ane place of rest to be transportit againe be the inbringers (the cuntrie in the meane tyme having no neid thairof), as the saidis petitiones and articles forsaids in thameselffes proportis. Oure said soverane lord and estates of parliament forsaids, to the effect the particulars abonementionat and everie ane of thame may be the more cairfullie and exactlie considerit and tryit, baith in the benefeit and prejudices thairof quhilk may thairby ensew to his hienes liedges in particular or generall, hes remittit and remittes the tryall and cognitione of the forsaids haill particular petitiones and articles respective abonementionat to the lords of his majesties secreit counsall of the kingdome of Scotland, thair consideratioun, to be determinat and decydit be thame. And for this effect, oure said soverane lord and estates of parliament forsaids hes givin and grantit, and, be the tennor heirof, gives and grants full powar and commissioun to the saidis lords of his hienes secreit counsall to tak sick tryell and cognitione anent the forsaid first petitione and article abonementionat, givin in againes the burgh of Dundie and anent the abuse of thair said ladell and oppressioun forsaid thairby sustenit be the saidis petitioners, as the saidis lords of secreit counsall sall think necessar and expedient for trying of the forsaid abuse and oppressioun and for making constant and knawine quhat is and sould be the just measure and quantitie of the said ladell in tyme coming; with powar to the saidis lords of secreit counsall eftir tryell as said is and sua to decerne and determine anent the particular forsaid as they eftir consideration of the forsaid tryell and cognitione to be takin be thame as said is sall think just and equitable. And als oure said soverane lord and estates of parliament hes lykwayes givin and grantit, and heirby gives and grants, full power and commissioun to the saidis lords of his hienes secreit counsall of the kingdome of Scotland to consider and tak sick tryell and informatioun anent the haill remanent articles and petitiones abonementionat, and everie ane of thame, as the saidis lords of secreit counsall sall think expedient and necessar; and thaireftir to tak sick course and to decerne and determine anent the forsaids remanent particular articles and petitiones, and everie ane of thame as said is, according as the saidis lords eftir tryell and consideratione sall find most expedient and agriable with reassoun and equitie, and for the weill and good of all his majesties liedges. And ordaines the decreitts, sentences and determinationes to be pronuncit and givin be the saidis lords of secreit counsall in all the forsaids particulars, and everie ane of thame, to have the strenth, force and authoritie of ane decreit, sentence and act of parliament; for obedience quhaireof, ordaines letters to be direct according as sall be necessar.
