Commissioun anent the admiralitie and chamberlanrie
Oure soverne lord and estates of this present parliament, considering and acknowledging that the wndoubted heretable richt of the offices of admiralitie and chalmelanrie of the haill kingdome of Scotland does properlie apperteine and belong to his hienes darrest cowsigne James, duke of Lennox, and that for the advancement and furtherance of his majesties service be his officers bruiking and joysing of the saidis offices, and for the honour, weill and commoditie of the said Duke of Lennox, his airs and successors, anent the bruiking and joysing of the saidis offices and exerceing of the liberties and priveledges perteining thairto, and als inrespect that sundrie communities and uther particular persones and judicatories have incroatchit upon the saidis offices of admiralitie and chalmerlanrie, or ane or uther of thame ather generallie or within some particular bounds, it is requisit and expedient that cognitioun and tryell be takine of the auncient honors, dignities, preeminences, priveledges, liberties, immunities, fies, casualities, proffeits and dewties perteining and belonging to the saidis offices or ather of thame in maner and to the effect wnderwrittine. Thairfore, his majestie, with advyse and consent of the estates of this present parliament, be the tennor heirof, give, grant and committe to George, erle of Kinnowll, chancellar, Johne, erle of Marre, Alexander, erle of Linlithgow, Johne, earle of Wigtoun, Johne2, earle of Southask, Johne, erle of Traquair, Sir Archibald Atchesone, secretarie, Sir Johne Hay, clerk of register, Sir Thomas Houp, knicht baronett, advocat to his majestie, Sir George Elphingstoun, justice clerk, Sir Walter Stewart of Mynto, Sir Andro Fletcher of Inverpeffer, Sir James Learmonth of Balcolmie, Sir George Achinleck of Balmanno and Sir James Makgill of Cranstoun Riddell, senators of the colledge of justice, (or to any sax or more of thame, off the quhich number thair sall alwayes be present the said lord chancellour, the Earles of Linlithgow, Southesk and Traquair, at the least tua of thame) to cognosce, sette downe and determine the auncient honors, dignities, priveledges, prerogatives, preeminences, immunities, jurisdictiones, fies, casualities, proffeits and dewties perteining and belonging to the saidis offices or any of thame, and how far and in quhat places the samyne offices and jurisdictiones thairof and uthers forsaids sall be extendit and observit in all tyme coming, and be quhat order and maner the saidis offices, with the auncient honors, dignities, priveledges, preeminences, immwnities, jurisdictiones, fies, casualities, proffeitts and dewties perteining and belonging thairto may best be bruiked and joysed be the said Duke of Lennox, his airs and successors, and how all commwnities and uther privat persones and all uther judicatories may best be hinderit and impedit in incroatching thairupon, and to rectifie and suppres all abuses that hes incroatchit or creipin in or that may incroatche or creipe in upon the saidis offices or ather of thame or judicatories perteining thairto. With power also to the said James, duke of Lennox, heretable great admirall and chalmerlane forsaid, and his airs and successors and such persones as sall please him or thame to appoint for that effect, with advyse and concurse of the saidis commissioners, or any sax of thame, to reveis and peruse the haill admirall and chamberlane lawes, statuites and practickes thairto belonging within this kingdome, and to rectifie, correct and allow the samyne, and to sett downe new lawes, statuites and formes perteining and concerning or quhilks may perteine and concerne the saidis offices, honors, dignities, priveledges and uthers abonewrittine thairto belonging or any pairt thairof quhatsumever in any maner of way; with powar to the saidis commissioners to conveine at sick tymes and places as they sall think expedient, and to conveine befor thame all pairties in generall or particular having entreis in the said mater if they sall think expedient, and generallie to do all uther things anent the premisses that to the office of commissioners in sick caices of the law ar knawen to apperteine, promittens de rato etc. Lykas his majestie, with consent forsaid, be thir presents, statuites and ordaines that all things to be done be the saidis commissioners anent the premisses sall have the full strenth, force and effect of ane act and statuit of this present parliament. And to the effect the samyne may be the better notifiet to his majetties liedges and uthers having entreis, ordaines the samyne haill determinationes and declarators to be reportit to the clerk of register and his deputtis to be inrolled in the bookes of this present parliament, at the least to be reportit to the lords of secreit counsall and inrolled and markit in thair bookes; and that with all convenient diligence thaireftir publicatioun be maid thairof to all his hienes liedges and uthers having entreis in forme as effeirs, ordaining thir presents to be ane sufficient warrant to the clerk of register and his deputtes for extending of ane act of parliament heirupon in forme as effeirs.
