Ratification to [George Hay], earl of Kinnoull of his tack of the teinds of Cousland

Our sovereign lord and estates of this present parliament ratify and approve the letter of tack and assedation made, set and granted by our sovereign lord, the king's majesty, for himself and as lord of the lordship and regality of Dunfermline, with advice of his highness's great treasurer, comptroller and collector of the said kingdom of Scotland, his highness's depute in the said offices, and also of the other lords of his highness's exchequer of Scotland, his highness's commissioners, to his highness's right trusty cousin and councillor George, earl of Kinnoull and his assignees and subtenants for the days, years, terms, time and space of the lifetime of the said George, now earl of Kinnoull; and after the decease of the said George, earl of Kinnoull, to his male heirs and assignees for all the days, years, times, terms and space of the lifetime of his first male heir; and after the decease of the first male heir for all the days, years, time, terms and space of the lifetime of the male heir of the said George, earl of Kinnoull, his first male heir foresaid; and after the decease of the second male heir for all the days, years, terms, time and space of nineteen years next and immediately following the time of the said second male heir; and after the expiring of the first nineteen years, for all the days, years, time, terms and space of other nineteen years next and immediately thereafter following; and after the expiring of the said second nineteen years for all the days, years, time, terms and space of other nineteen years thereafter following, so that the said tack and assedation shall endure for the whole space of three lifetimes and three nineteen years thereafter above-specified, successively after others, for all and sundry the teind sheaves of all and sundry the town and lands of Cousland, with the parts, pendicles and pertinents thereof, lying within the parish of Inveresk and sheriffdom of Edinburgh, beginning the entry of the said tack at the date thereof underwritten, for yearly payment to his highness and his successors having right to the said lordship and regality of Dunfermline, their chamberlains and factors present and to come, during the spaces respectively above-specified of the sum of £66 13s 4d money of this realm of Scotland of mail at the feast of Candlemas [2 February], as the said letter of tack and assedation under his majesty's privy seal of the date 7 May 1637 at more length bears, in all and sundry the heads, points, clauses, articles, circumstances and conditions contained therein and after the form and tenor thereof in all points. And our said sovereign lord and estates of parliament will and grant and, for his highness and his successors, decree and ordain that this present ratification of the said tack is and shall be as valid and sufficient and of as great force, strength and effect to his highness's said trusty cousin and councillor George, earl of Kinnoull, his heirs, assignees and others having right to the said tack from him for possessing of the said teinds contained therein during the space and years above-specified mentioned therein as if the said tack were all at length specially engrossed and inserted herein word for word, notwithstanding that the same be not so done; concerning which, and with all other defects and imperfections which may be proposed or alleged against the said tack, or this present ratification thereof and validity of the same, our said sovereign lord and estates of parliament, for his highness and his successors, have dispensed and by this ratification dispense for ever.
