Procedure: protest; asking of instruments

The same day compeared a noble lord John [Elphinstone], lord Balmerino, patron of the parish kirk of Leith and tacksman and titular of the teinds of Restalrig, parsonage and vicarage thereof, and protested that the act of ratification granted in this present parliament in favour of Henry Nisbet, portioner of Restalrig, of the decreets obtained by him against the said Lord Balmerino before the lords and others of his majesty's commission for the surrenders and teinds, and before the lords of session regarding the valuation of the teind sheaves of his lands in Restalrig and others contained in the said ratification, should in no way be hurtful nor prejudicial to the said John, lord Balmerino, but that notwithstanding thereof it shall be lawful and rightful to suit the benefit of the acts made in this present parliament ordaining and allowing any unjust valuations to be rectified and renewed. Which protestation his majesty and three estates of this present parliament have admitted and admit, and thereupon the said John, lord Balmerino, asked instruments.
