Act in favoures of the Universitie off Sanctandros
Oure soverane lord and estaittis off this present parliament, understanding the alteratioun and chainge whiche hes bene maid of the first fundatiounes of the colledges within the Universitie of Sanctandros to haif bred suche uncertantie in professioune of sciences and observatioun of ordoures appointit be the first fundatouris of the saidis collegis that the greitar pairt off the professoures ar negligent, making no professioune nor teiching as not knawing quhairto they sall betak thame selffis; nather can thair visitatiounes, whiche ar maid for reformatioun off disordoures, tak any proffitable effect in respect of the alteratiounes befoirmentionat; and that it semeth most equitable that the willis of the first fundatoures sould tak effect and be mantained, except quhair the samyn is repugnant to the trew religioune presentlie professit within this realme, thairfore oure said soverane lord and estaitis foirsaidis ratifies and apprevis the foirsaidis first fundatiounes off the saidis collegis in all the heidis, articles and clauses of the samyn so far as the samyne may stand with the estait of trew religioune, and ordanes the maisteris and professoures within the samyne colledges heireftir to observe the professiounes appointit be the first fundatoures to thame and conform thame selffis to the ordoures contenit and sett downe in thair first fundatiounes, this onlie exceptit: that the maisteris of the new colledge keip still the professioune of divinitie within thair scooles as presentlie is and hes bene usit and exercit thir yeiris bygane, and that in all uther thingis the maisteris of the said new colledge they observe the lawis of the first fundatioun according to the whiche all visitatiounes and tryallis heirefter salbe maid and no utherwayes. Discharging all actis and statutis maid in prejudice of thair first fundatiounes, reservand to the Erle of Cassillis all his rightis and priviledges whiche he hes in and to Sanct Salvatouris colledge and prebendaries within the samen. Als oure said soverane lord and estaitis foirsaidis ratifies and apprevis all giftis, mortificatiounes, patronages, priviledgis and immunities grauntit be his hienes or his noble progenitouris or by the archebischopes of Sanctandros to any of the saidis colledges or to the universitie in generall, and in speciall the right of conservatorie of the liberties and priviledges of the studentis within the samyne and the jurisdictioune belanging thairto, with ane speciall ordinance that executioun of horning, poynding and utheris salbe grauntit be the lordis of sessioune upoune all decreitis pronuncit be the rectour of the said universitie or the conservatour of the priviledge of the samen in suche maner as is grauntit upoune the decreitis of commissioneris, schireffis and stewartis of regalities within this realme; and als statutis and ordanes that all maisteris, professoures, studentis and foundit persounes within the said universitie sall heireftir walk in thair gownis throchout all the said universtie according to the forme that salbe prescryvit to thame by thair visitoures under the pane of expelling thame furth of the saidis colledgis and universitie that do wilfullie in the contrare thairof. Forder statutis and ordanes that all takis to be sett heireftir by the principall and maisteris of ony colledge exceid not the space of nyntene yeiris, bot prejudice alwayis of all takis alreddie sett be the saidis principall and maisteris for all the dayes of thair lyftymes and fyve yeiris thaireftir to quhatsumevir persoun or persounes, quhilkis takis alreddie sett the saidis estates declares to be guid, valid and effectuall in thame selffis, and als of sik takis of prorogatioune as ar sett be the lordis of parliament be vertew of thair commissioune grauntit for plantatioun of kirkis. And to the effect the maisteris and studentis within the colledges of the said Universitie off Sanctandros may be the bettir furnissit with all sortis of freche viveris and victuallis all the tymes and seasounes in the yeir, oure said soverane lord and estaitis (by and besyidis thair ordiner mercat day whiche is upoune ilk Settirday) grauntis be thir presentis full libertie and power to the said citie of Sanctandros to haif ane uther oulklie mercat upoune ilk Woddisday for bying and selling of all soirtis of victuallis and viveris. It is alwayes declarit that this present ratificatioune sall nawayes exeme the said universitie nor memberis thairof frome the jurisdictioune of the lordis of sessioun, secreit counsale, nor justice generall, and that nochtwithstanding any priviledges contened in the foundatiounes and originall mortificatiounes grantit to thame off before.
