Ratificatione to the toun of Edinburgh of the libertie off beiring of a sworde, of justiciarie of peace, of unlawis, the exsyis of vine, the jadgerie etc.
Oure soverane lord and estaittis of this present parliament ratifeis, approvis and confermes the particular and severall giftis underwrittin maid and grantit be his majestie under his gryit seall to and in favouris of the provest, bailyeis, counsell, deaconis of craftis and communitie of the burgh of Edinburgh for the tyme and thair successoures for evir, off all and sindrie offices, custumes, liberties and utheris particularlie thairin contenit; that is to say: the gift maid and grantit be oure soverane lord under his gryit seale to the provest, bailyeis, counsell and communitie of the said burgh of Edinburgh of beiring ane sworde before the provest of Edinburgh within the liberties of the said burgh, ryding of the merchis of the samine, off the office of justiciaries of peax in maner thairincontenit, and of all and sindrie utheris liberties and immunities thairin specifit, off the date at Quhyithall, the tent day of November, jM vjC and nyne yeiris; and siclyik the gift of justiciarie of peace grantit be oure said soverane lord to the saidis provest, bailyeis, counsell and communitie of the said burgh of Edinburgh within the toun of Edinburgh and Leithe and boundis thairin contenit, of the date at Hamptoun Court, the tuentie nyne day of September, jM vjC and tuelff yeiris; and siclyik the gift grantit be his majestie to the saidis provest, bailyeis, counsell and communitie of the said burgh of Edinburgh of all unlawes, amerciamentis and unlawes2 pertening to the office of schirrefschip and justiciarie of peace within the boundis of thair schirrefschip and justiciarie of peace, of the date at Quhyithall, the sevintene day off Apryill, the yeir of God jM vjC and threttene yeiris; and siclyik the lettres of gift grantit be his majestie under the gryit seale to and in favores of the saidis provest, bailyeis, counsell and communitie of the said burgh off Edinburgh and thair successouris off the custome and exsyise of the soume of four pundis usuall money of Scotland of ilk tune of wyne to be toppit, ventit and sauld in smallis within the said burgh, libertie and jurisdictioun thairoff to be upliftit be thame, thair thesaureris, collectouris and utheris in thair names fra the ventineris, topsteris and selleris thairoff in all tyme cuming, off the date at Quhyithall, the tent day of November, the yeir of God jM vjC and nyne yeiris; togidder with the ratificatioun off the said gift and new dispositioune of the said custome and excyse of four pundis of ilk tune of wyne to be toppit, ventit and sauld in smallis within the said burgh, libertie and jurisdictioun thairoff and within the toun of Leithe in all pairtis of the same on the southe syid of the water of Leith, to be upliftit fra the ventineris and topsteris of the said wyne in all tyme cuming, of the date at Hamptoun Courte, the tuentie fyift day of September, the yeir of God jM vjC and tuelf yeiris; and siclyik the gift and priviledge grantit be oure said soverane lord under the quarter seale to the saidis provest, bailyeis, counsell and communitie of the said burgh of Edinburgh and thair successouris of erecting of ane weyhous at the over trone of this burgh, with sindrie liberties, priviledgis and immunities and dewties thairin contenit, of the date at Roystoun, the nynt day of December, jM vjC and ellevin yeiris; and siclyik ratiefies, approvis and confermes the gift made and grantit be oure said soverane lord under his gryit seale to the saidis provest, bailyeis, counsell and communitie of the said burgh of Edinburgh of the jadgerie of salmond, herring and quhyitfische packit and peillit within the kingdome of Scotland, of the date the auchtene day off October, jM vjC auchtene; and siclyik ratifies, approvis and confermes ane gift grantit be oure said soverane lord under his gryit seill to the saidis provest, bailyeis, counsell and communitie of the said burgh of Edinburgh of making of thame oversearis of all warkis and visitouris, seirchearis, aulnagers and sealleris of all cloath, stemming, stuffes and stokkingis maid in thair said burgh, the toun of Leith and schirefdome of Edinburgh in maner conteanit in the said gift, contening dyverse and sindrie utheris liberties, immunities and dewties, of the date the 8 day of Merche 1621, in all and sindrie passis, heiddis, articles, clauses, conditiounes, priviledgis, immunities and utheris circumstances quhatsumevir contenit in the giftis and utheris particularlie abovespecifit, and everie ane of thame, efter the forme and tennour thairoff. Lyik as his majestie and estaittis foirsaidis statutes and ordanis that this present ratificatioune is and salbe als valide, effectuall and sufficient in all respectis as gif the foirsaidis haill giftis and utheris abovewrittin off the daittes respective abovespecifit wer at lenth worde be worde ingrossit in this present act. And siclyik, his majestie and estaittis foirsaidis willes, grantis, statutes and ordanis that the foirsaidis giftis and this present ratieficatioun thairoff ar and salbe guide, valide, effectuall and lauchfull rightis and securities to the saidis provest, bailyeis, counsell and communitie of the said burgh of Edinburgh and thair successoures for bruiking and joising of the particular giftis respective abovespecifit, ordaning the clerk of register and his deputtes to extend ane act of parliament heirupone and to insert and ingrose thairintill, ather joyntlie or severalie, the haill giftis abovespecifit in ampill forme. Lyik as his majestie, with the advyse of the estaittis of this present parliament, off new gevis, grantis and disponis to the saidis provest, bailyeis, counsell and communitie of the said burgh of Edinburgh and thair successouris the particuler giftis conteaning the severall priviledges, liberties and immunities contenit in the samene giftis and utheris abovespecifit, to be haldin of his majestie and his successouris in maner contenit and expressit in the severall giftis abovespecifit. And for thair farder securitie, his majestie and estaittis hes dissolvit and dissolvis the foirsaidis haill giftis and utheris particularlie abovespecifit fra his majesties croun and fra all actis of parliament maid thairanent in sua far as the same, or onye pairt thairoff, is or may appeir to have bene annexit thairto in all tyme bygane, to the effect particularlie abovespecifit; and annulles all and quhatsumevir actis and statutes quhilkis may be prejudiciall or dirogatorie to the premisse, and, gif neid beis, ordanis new giftis to be exped thairupoun, but prejudice to the toun of Abirdene of thair right of the jadgerie and measour off salmond conforme to ane act of secreit counsell conceavit in thair favoures; as also but prejudice to the haill remanent burghis royall within this kingdome of all thair fredomes, priviledges and immunities dew to thame and quhilk they have heirtofoir enjoyed, quhilkis ar nowayes heirby derogate.
