Erectioun of Coldinghame in favoures of Johne Stewart

Oure soverane lord and estaittis of this present parliament, considdering that Johnne Stewart, sone lauchfull to umquhile Frances, sumtyme earle Bothuell, wes lauchfullie prowydit to the benefice of the pryourie of Coldinghame, spiritualitie and temporalitie thairoff, and that his majestie and estaittis foirsaidis in this present parliament hes alreddie restoired the said Johnne Stewart aganis quhatsumevir lawes, actis of parliament, statutes and constitutiounes quhatsumevir made anent the disshabilitatioun of the bairnes and posteritie of umquhile Frances, sumtyme erle Bothuell in sa far as the same may be extendit to the said Johnne Stewart and the aires lauchfullie gottin or to be gottin of his bodie, and in sa far as thairby the said Johnne Stewart wes in anywayes maid unhable to bruke, use and posses the said benefice of the pryourie of Coldinghame or ony uther benefices, landis, roumes, possessiounes, dignities or honoures; lyikas the said Johnne Stewart, be his lettres of procuratorie and dimissione seillit and subscrivit with his hand, and be his procuratouris speciallie constitute for that effect, is to mak lauchfull resignatioune and dimissioun in the handis of oure said soverane lord of the said benefice of the foirsaid pryourie of Coldinghame, with the monasterie and abbaye place of Coldinghame, closter, houssis, biggingis, yairdis, orcheartis, close and haill boundis, commodities and easmentis within the precinct of the same and all thair pertinentis, with the haill landis, baronies, milnes, woddis, fischeingis, kirkis, teyndis, castellis, toures, fortalices, tenementis, annuelrentis, croftis and aikeris pertening to the said pryourie of Coldinghame, alsueill temporalitie as spiritualitie of the same, quhairevir the samene ly within this realme, to the effect that his majestie may dissolve, extinguische and suppres the said pryourie, name and memorie thairoff, and of new erect the samene in ane temporall lordschip and dispone the same heretablie to the said Jhonne Stewart, his aires and assigneyis in dew and competent forme as effeiris, as the said procuratorie and instrument of dimissioun mair fullie proportis. Thairfore his majestie and estaittis foirsaidis hes dissolvit and, be thir presentis, dissolvis fra the said pryourie and monasterie of Coldinghame and fra all and quhatsumevir statutes and actis of parliament quhairby the said pryourie or ony pairt of the samene, spiritualitie or temporalitie thairoff, wes annexit to his majesties croun, all and sindrie landis, barronies, milnes, woddis, fischeingis, tenementis, croftis, aikeris, annuelrentis, castellis, toures, fortalices, maner places, yairdis, orcheardis, kirkis, teindschevis and uther teindis, fructis, rentis, emolimentis, feufermes, kaynes, custumes, casualities, profittes and dewties quhatsumevir, with tennentis, tenandries and service of frie tennentis quhilkis pertenit off auld to the said pryourie of Coldinghame, and quhairoff the commendatouris of the said pryourie hes bene in possessioun in any tyme bygane, quhairevir the same ly within the kingdome of Scotland, and namelie all and haill the maner place of Coldinghame, closter, housis, biggingis, yairdis, orcheartis, clausteris and haill boundis, commodities and easmentis within the precinct of the same, with all thair pertinentis; And siclyik, his majestie and estaittis foirsaidis hes dissolvit and dissolvis all and sindrie the teyndschevis, uther teyndis, fructes, rentis, proventis, emolumentis and dewties, alsueill personage as viccarage, of all and sindrie the paroche kirkis underwrittin pertening to the said abbacie and pryourie of Coldinghame, viz: all and sindrie the teyndschevis and uthair teyndis, personage and viccarage, of the kirk of Coldinghame, the kirk of Aytoun, the kirk of Fischeweik, the kirk of Swyntoun, the kirk of Eddreme, the kirk of Ednem, the kirk of Stitchell, the kirk of Ersiltoun, the kirk of Auldcambus, the kirk of Lambertoun and als all and sindrie the teindschevis and uther teyndis, personage and viccarage, of the landis of Edringtoun with thair pertinentis, with all uther kirkis and teyndis pertening of auld to the said pryourie and abbacie of Coldinghame as spiritualitie thairoff and patrimonie of the said abbacie, and quhairoff the pryouris and commendatouris of the said abbacie and thair conventis hes bene in possessioun, quhairevir the same ly within the said kingdome, fra the said abbacie and monasterie of Coldinghame and first fundatioun and erectioun thairoff, and fra all and quhatsumevir the saidis actis and statutes of parliament quhairby the said pryourie of Coldinghame, landis, kirkes or teyndis of the same, temporalitie or spiritualitie thairoff, wes annexit to his majesties croun in ony tyme bygane; and hes suppressit and extinguischit and, be the tennour of this present act, suppressis and extinguisches the name, title and memorie of the said pryourie for evir, to the effect that his majestie may giff, grant and dispone to the said Johne Stewart, his aires and assignais heretablie all and sindrie the foirsaidis landis, baronies, mylnes, fischeingis, rentis, kaynis, custumes, casualities, castell, wairdis, fewfermes, portis, hevening places, annuelrentis, croftis, aikeris and utheris specialie and generalie abovewrittin, with thair castellis, toures, fortalices, maner places, housis, biggingis, yairdis, orcheartis, doucattis, milnes, woddis,³ fischeingis, outseattis, pairtis, pendicles, tennentis, tenandries and service of frie tennentis, fewfermes, annuelrentis, kaynes, custumes, casualities and dewties quhatsumevir, of all and sindrie the foirsaidis townes, landis, baronyes and utheris speciallie and generalie above expremit, and all thair pertinentis, togidder with all and sindrie the foirsaidis teindschevis, uther teindis, fructis, rentis, proventis, emolumentis and dewties of all and sindrie the foirsaidis paroche kirkis and parochines abovementionat, personage and viccarage of the same, and all rycht, tytill, entres and clame of right quhilk his majestie, his predicessouris or successouris had, hes or ony wayes might have, clame or pretend thairto, or to ony pairt of the same be ony maner of waye in tyme cuming; and als to the effect the same may be erectit, unite, create and incorporat in ane haill and frie baronie to be callit now and in all tyme cuming the barony of Coldinghame, ordaning the maner place of Coldinghame to be the principall messuage for taking of seising thairat in all tyme heirefter; and that the said seasing salbe sufficient for all and sindrie the foirsaidis landis, baronies, milnes, multouris, woddis, fischeingis, tenementis, annuelrentis, croftis, aikeris, castellis, toures, fortalices, maner places, housis, biggingis, tennentis, tenandries, service of frie tennentis, kirkis, teyndis and utheris generalie and particularlie abovementionat, without any uther particular seasing to be takin at ony uther place or pairt thairoff, nochtwithstanding that thai ly not contigue togidder, to be haldin of oure said soverane lord and his majesties successouris in frie blensche ferme, fee and heretage for evir; payand thairfore yeirlie the said Johnne Stewart, his aires and assignais foirsaidis to oure said soverane lord and his majesties successouris the soume of tua hundereth merkis guid and usuall money of this realme of Scotland at the feist of Witsonday in name of blensche ferme, gif the same be askit allanerlie; and als payand to the present ministeris serveing the cure at the said kirkis and thair successoures the yeirlie stependis efter rehersit, ilk ane of thame for thair awin pairtes as is efter dewydit at the termes off payment useit and wont, viz: to the minister serveing the cure at the said kirk of Coldinghame, thrie chalderis victuell, halff beir, halff aitmeill, besyid and attour the viccarage of the said kirk; to the minister serveing the cure at the said kirk of Aytoun and kirk of Lambertoun unite and annexit thairto, four chalderis victuell, halff beir, halff mukit land aittis, with the haill viccarages, manse and gleibis of the saidis kirkes; to the minister serveing the cure at the said kirk of Swyntoun, four chalderis victuell, halff beir, half mukkit land aittis, with the haill viccarage, manse and gleib of the said kirk; to the minister serveing the cure at the said kirk of Edreme, four chalderis victuell, halff bair, halff mukkit land aittis, with the haill viccarages of the said kirk; to the ministeris serveing the cure at the said kirk of Ednem yeirlie the soume of fyve hundereth merkis, with the haill viccarage of the said kirk, with sick uther augmentationes and dewties as ar alreddye or sall heirefter be appoyntit be the commissionaris and utheris haveand power of his majestie and estaittis of parliament to that effect. And becaus the said kirk of Stitchell is unite to the kirk of Home, quhilk is ane kirk of Kelso, and the said kirk of Fischewick is unite to the kirk of Hutoun, quhilk is ane kirk of the provestrie of Dunglas, thairfore his majestie and estaittis foirsaidis decernis and declaires that the said Johnne Stewart and his foirsaidis salbe onlie haldin to pay to the saidis ministeris serving the cure at the saidis kirkes the proportionall pairtes of the saidis ministeris stependis efter following, to wit: to the minister serveing the cure at the said kirk of Stitchell and kirk of Home unite thairto, tuentie tua bollis victuell, halff beir, halff mukkit land aittis, and fiftie four pundis money as his proportionall pairt of the soume of ane hundereth merkis money of augmentatioune augmentit for the saidis unite kirkis of Home and Stitchell be the lordis commissioneris of his majesties last parliament, besyid and attour the viccarages, manses and gleibis of the saidis kirkis; and to the minister serveing the cure at the saidis unitit kirkis of Fischeweik and Huttoun, the soume of thrie hundereth merkis money as the proportionall pairt off that yeirlie stepend of sex hundereth merkis money prowydit to the minister serveing the cure at the said unitit kirkes of Fischeweik and Huttoun; and als furnesand the elementis of breid and wyne yeirlie to the celebratioun of the holie communione at the kirkes abovewrittin sua oft as said sall requyre, and relevand the saidis ministeris of all taxatiounes and impositiones quhatsumevir that may be imposit upoun the saidis teindis, fructis and rentis of the saidis kirkes or for repairing of the same in tyme cuming. And ordanis ane infeftment to be past and exped heirupoun to the said Johnne Stewart and his foirsaidis in dew and competent forme as efferis, but prejudice to the Bischope of Dumblane as deane of the chapell royall off his richt to anye dewtie addettit to the chepell royall out of the landis off Coldinghame. And Jhonne Belchis, for the lairdis of Aytoun and Blacader, protestit that the foirsaid act suld not be prejudiciall to thair rightis of anye teyndis or landis pertening to Coldinghame; and the said Johnne Stewart, being present with Maister Lues Stewart, his procuratour, protestit in the contrair. And siclyik Schir George Home, the laird off Wodderburne and the laird of Rentoun gave in thair protestatiounes in wreit, quahiroff the tennoures followes:
