Oure soverane lord and estaittis of this present parliament, considdering that Johnne Stewart, sone lauchfull to umquhile Frances, sumtyme earle Bothuell, wes lauchfullie prowydit to the benefice of the pryourie of Coldinghame, spiritualitie and temporalitie thairoff, and that his majestie and estaittis foirsaidis in this present parliament hes alreddie restoired the said Johnne Stewart aganis quhatsumevir lawes, actis of parliament, statutes and constitutiounes quhatsumevir made anent the disshabilitatioun of the bairnes and posteritie of umquhile Frances, sumtyme erle Bothuell in sa far as the same may be extendit to the said Johnne Stewart and the aires lauchfullie gottin or to be gottin of his bodie, and in sa far as thairby the said Johnne Stewart wes in anywayes maid unhable to bruke, use and posses the said benefice of the pryourie of Coldinghame or ony uther benefices, landis, roumes, possessiounes, dignities or honoures; lyikas the said Johnne Stewart, be his lettres of procuratorie and dimissione seillit and subscrivit with his hand, and be his procuratouris speciallie constitute for that effect, is to mak lauchfull resignatioune and dimissioun in the handis of oure said soverane lord of the said benefice of the foirsaid pryourie of Coldinghame, with the monasterie and abbaye place of Coldinghame, closter, houssis, biggingis, yairdis, orcheartis, close and haill boundis, commodities and easmentis within the precinct of the same and all thair pertinentis, with the haill landis, baronies, milnes, woddis, fischeingis, kirkis, teyndis, castellis, toures, fortalices, tenementis, annuelrentis, croftis and aikeris pertening to the said pryourie of Coldinghame, alsueill temporalitie as spiritualitie of the same, quhairevir the samene ly within this realme, to the effect that his majestie may dissolve, extinguische and suppres the said pryourie, name and memorie thairoff, and of new erect the samene in ane temporall lordschip and dispone the same heretablie to the said Jhonne Stewart, his aires and assigneyis in dew and competent forme as effeiris, as the said procuratorie and instrument of dimissioun mair fullie proportis. and that the said seasing salbe sufficient for all and sindrie the foirsaidis landis, baronies, milnes, multouris, woddis, fischeingis, tenementis, annuelrentis, croftis, aikeris, castellis, toures, fortalices, maner places, housis, biggingis, tennentis, tenandries, service of frie tennentis, kirkis, teyndis and utheris generalie and particularlie abovementionat, without any uther particular seasing to be takin at ony uther place or pairt thairoff, nochtwithstanding that thai ly not contigue togidder, to be haldin of oure said soverane lord and his majesties successouris in frie blensche ferme, fee and heretage for evir; and als payand to the present ministeris serveing the cure at the said kirkis and thair successoures the yeirlie stependis efter rehersit, ilk ane of thame for thair awin pairtes as is efter dewydit at the termes off payment useit and wont, viz: to the minister serveing the cure at the said kirk of Coldinghame, thrie chalderis victuell, halff beir, halff aitmeill, besyid and attour the viccarage of the said kirk; And becaus the said kirk of Stitchell is unite to the kirk of Home, quhilk is ane kirk of Kelso, and the said kirk of Fischewick is unite to the kirk of Hutoun, quhilk is ane kirk of the provestrie of Dunglas, thairfore his majestie and estaittis foirsaidis decernis and declaires that the said Johnne Stewart and his foirsaidis salbe onlie haldin to pay to the saidis ministeris serving the cure at the saidis kirkes the proportionall pairtes of the saidis ministeris stependis efter following, to wit: to the minister serveing the cure at the said kirk of Stitchell and kirk of Home unite thairto, tuentie tua bollis victuell, halff beir, halff mukkit land aittis, and fiftie four pundis money as his proportionall pairt of the soume of ane hundereth merkis money of augmentatioune augmentit for the saidis unite kirkis of Home and Stitchell be the lordis commissioneris of his majesties last parliament, besyid and attour the viccarages, manses and gleibis of the saidis kirkis; and to the minister serveing the cure at the saidis unitit kirkis of Fischeweik and Huttoun, the soume of thrie hundereth merkis money as the proportionall pairt off that yeirlie stepend of sex hundereth merkis money prowydit to the minister serveing the cure at the said unitit kirkes of Fischeweik and Huttoun; and als furnesand the elementis of breid and wyne yeirlie to the celebratioun of the holie communione at the kirkes abovewrittin sua oft as said sall requyre, and relevand the saidis ministeris of all taxatiounes and impositiones quhatsumevir that may be imposit upoun the saidis teindis, fructis and rentis of the saidis kirkes or for repairing of the same in tyme cuming. And ordanis ane infeftment to be past and exped heirupoun to the said Johnne Stewart and his foirsaidis in dew and competent forme as efferis, but prejudice to the Bischope of Dumblane as deane of the chapell royall off his richt to anye dewtie addettit to the chepell royall out of the landis off Coldinghame. And Jhonne Belchis, for the lairdis of Aytoun and Blacader, protestit that the foirsaid act suld not be prejudiciall to thair rightis of anye teyndis or landis pertening to Coldinghame; and the said Johnne Stewart, being present with Maister Lues Stewart, his procuratour, protestit in the contrair.
