Act in favouris of Jhone Stewart anent his rehabilitatioun

Oure soverane lord and estaittis of this present parliament of the kingdome of Scotland, understanding that albeit Jhonne Stewart, sone lauchfull to umquhile Frances, sumtyme erle Bothuell, wes be the lawes, actis and constitutiounes of this realme dishabilitat and maid unhable to have bruikit and possessit landis, offices and honoures within this kingdome throw or be the occasioun of the foirfaultoures of the said umquhile Frances, his father, quha wes convict and foirfaultit for certane crymes of treasoun and lesemajestie committit be him, nevirtheles it pleasit his majestie of before, out of pitie and commiseratioun had be his majestie to the said Jhonne Stewart as ane persoun altogidder innocent of the saidis crymes, being onlie ane infant the tyme of the committing thairoff, within the age off [...] yeiris, be his majesties lettres of restitutioun and rehabilitatioun under his majesties greit seale, to grant the benefite of restitutioune and rehabilitatione to the said Jhonne Stewart, restoring and rehabilitating him to his gude name and fame and all and sindrie landis, benefices, offices, honoures, dignities and priviledgis quhairofft he wes depryvit and prejudgit be the saidis lawes, actis and constitutiones, as at mair lenth is contenit in the saidis lettres of rehabilitatione and restitutioun, quhilkis ar of the date the [...] day off [...], the yeir of jM vjC and [...] yeiris. And now his majestie, following his naturall clemencie, considdering that the said Jhonne Stewart hes continewallie frome his youthe behaveit him selff as ane trew, luiffing and dewtiefull subject and servand to his majestie, depending altogidder upoun his majesties gracious will and plesour, thairfore oure said soverane lord, with advyse and consent of the haill estaittis and bodie of this present parliament, ratiefies and apprevis the lettres of rehabilitatioun and restitutioun grantit be his majestie under his majesties gryit seale to the said Jhonne Stewart in maner and to the effect aboveswrittin in all and sindrie heiddis, poyntis, clauses and articles thairoff; and decernis and declaires this present ratificatioun to be als valide and sufficent to the said Jhonne Stewart as gif the saidis lettres of rehabilitatioune wer ad longum de verbo in verbum ingrossit and insert heirintill. And farder, oure said soverane lord, withe consent foirsaid, hes retreittit, rescindit, cassit, annullit and, be the tennour heiroff, retreitis, rescindes, casses and annulles now and fra the begynning all and quhatsumevir lawes, actis off parliament, statutes and constitutiounes quhatsumevir made anent the dishabilitatioun off the bairnes and posteritie of the said umquhile Frances, sumtyme erle Bothuell, in sua far as the same may be extendit to the said Johnne Stewart and to the aires lauchfullie gottin or to be gottin of his bodie, and in sua far as thairby the said Johnne Stewart wes in onywayes maid unhable to bruke, use and posses any benefice, landis, roumes, possessiounes, dignities or honoures, togidder with all actis of parliament, decreittis and sentences following upoun the saidis actis off dishabilitatioune for annexing of quhatsumevir landis, baronies or benefices pertening to the said Johnne Stewart, and to the quhilk he wes prowydit to his majesties croun; and speciallie all and quhatsumevir actis of parliament made for annexing of the abbacie of Coldinghame, temporalitie and spiritualitie thairoff, to his majesties croun, maid in the yeir of God jM vC fourescore tuelff yeiris or fourscoir fourtene yeiris, to the quhilk the said Johnne Stewart wes prowydit, declairing the saidis actis and statutes to be and to have bene null and of nane availl fra the begynning, with all rightis, infeftmentis and dispositiounes grantit be his majestie to quhatsumevir persone or persounes following and depending thairupoune in sua far as the same may prejudge the said Johnne Stewart of his right and tytill of the said abbacie and pryourie of Coldinghame, spirtualite and temporalitie thairoff, or of the fruittes, rentis and emolimentis of the same; and that the said nullatie of the saidis actis in generall salbe als sufficient and valide as giff the same actis wer speciallie expressit and insert thairintill, and that the same salbe als weill ressavit be way of exceptioune and reply as be way of actioune. Mairover, oure said soverane lord, with consent of the saidis estaittis, hes ratifiet and approvin and, be the tennour heiroff, ratifes and apprevis all and quhatsumevir giftis and provisiounes grantit be his majestie in favoures of the said Johnne Stewarte of the said priorie of Coldinghame, spiritualitie and temporalitie of the same, in ony tyme bigame be quhatsumevir maner of way, of quhatsumevir date or daitis, tenour or contentis the same be off in all and sindrie heiddis, poyntes, clauses and articles of the same; and decernis and declairis this present ratificatioun to be als valide and sufficient to the said Jhonne Stewart and his foirsaidis as giff the saidis giftis and provisounes wer all at lenth et per expressum de verbo in verbum ingrossit and insert heirintill.
