Ratificatioun in favoures of the Lord Lowdoun of his infeftment of Kyillismure etc.

Oure soverane lord and estaittis of this present parliament ratiefies, approvis and perpetuallie confermes the act of dissolutioune maid in his hienes parliament haldin at the burgh off Peirth, the nynt day of Julii, j^M vj^C and sex yeiris, dissolvand all and haill the landis, lordschip and baronies of Kyillismure and Barmure, with castellis, toures, fortalices, maner places, housis, biggingis, yairdis, orcheartis, milnes, woddis, fischeingis, annexis, connexis, dependences, pairtis, pendicles, tennentis, tenandries, service of frie tennentis thairoff and all thair pertinentis lyand within the bailyerie of Kylestewart and schirefdome of Air fra the act of annexatioun maid at Edinburgh, the tuentie nynt day off Julii, the yeir of God j^M v^C fourscore sevin yeiris, anent the annexatione of the temporalitie of all benefices within this realme to the patrimonie of his hienes croun; and als dissolvand the paroche kirk of Machlene, personage and viccarage thairoff, lyand as said is, with the haill teindis, fruittis, rentis, proventis and emolumentis pertening thairto fra the abbacie or monasterie of Melros to the effect mentionat in the said act of parliament, togidder with the chartour past under his hienes gryit seall maid and grantit be his majestie, with advyse and consent of umquhile Maister Johnne Prestoun off Penniecuke, collectour generall and thesaurer of his hienes new augmentatiounes for the tyme, to his hienes right traist cousing Hew, lord of Lowdoun and his aires maill thairin specifit, off all and haill the saidis landis, lordschip and baronies of Kyillismure and Barrowmure, with castellis, toures, fortalices, maner places, housis, biggingis, yairdis, orcheartes, milnes, woddis, fischeingis, annexis, connexis, dependences, pairtis, pendicles, tennentis, tenandries, service of frie tennentis thairoff and all thair pertinentis lyand as said is, with all and sindrie teindschevis, utheris teyndis, alsueill personage as viccarage, fruittis, rentis, emolimentis and dewties quhatsumevir of the said paroche kirk of Machlene lyand as said is, contening also ane erectioune of the toun of Machlene in ane frie burgh of baronie, with the precept and instrument of sesing following upoun the said chartour, quhilk chartour is daittit at Grenewitche, the last day of Junii, the yeir of God j^M vj^C and aucht yeiris, in all and sindrie heiddis, articles, clauses, conditiounes and circumstances quhatsumevir thairin contenit efter the formes and tenouris thairoff, with the haill liberties and priviledgis thairin conteanit; and declairis this present ratificatioun to be als valide, effectuall and sufficient in all respectis as gif the saidis actis of parliament, chartour, precept and instrument of seasing following thairupoun wer at lenth insert in this present act, dispensand with the not inserting thairoff heirin be thir presentis for evir. And lyikwayis findes, decernis and declaris that the foirsaidis landis, lordschip and baronies of Kyillismure and Barrow Mure, with castellis, toures, fortalices, maner places, housis, biggingis, yairdis, orcheartis, mylnes, woddes, fischeingis, annexis, connexis, dependences, pairtis, pendicles, tennentis, tenandries, service of frie tennentis thairoff and all thair partinentis lyand as said is, with the said paroche kirk of Machlene, personage and viccarage thairoff, and haill fructis, rentis, praventis, emolimentis and dewties quhatsumevir pertening thairto, as lauchfullie dissolvit fra the said act of annexatioun and abbacie of Melros be vertew of the said act off dissolutioun made in the foirsaid parliament haldin at Pearthe, the said nynt day off [...], the yeir off God j^M vj^C and sex yeiris; and that oure said soverane lord, with advyse and consent foirsaid, hes lauchfullie gevin, grantit and disponit to the said Hew, lord of Lowdoun and his foirsaidis all and haill the saidis landis, lordschip and baronies of Kyillismure and Barmure, with the castellis, toures, fortalices, maner places, housis, biggingis, yairdis, orcheartis, milnes, woddis, fischeingis, annexis, connexis, dependences, pairtis, pendicles, tennentis, tenandries, service of frie tennentis thairoff and all thair pertinentis lyand as said is, with the foirsaid paroche kirk of Machline, personage and viccarage thairoff, with the haill fructis, rentis, proventis, emolimentis and dewties quhatsumevir pertening thairto in maner exprest in the foirsaid chartour; and that the act of dissolutioun (gif anye be maid in this present parliament or that salhappin to be maid in onye parliament heirefter) to and in favoures of Thomas, erle of Melros, lord Bynning etc., or of quhatsumevir persoun or persounes, dissolvand the lordschip off Melros with all utheris lordschipis, baronies and kirkis of auld pertening to the said abbacy and monasterie of Melros fra the said act of annexatioun and fra the said abbacie and monasterie of Melros, nor the infeftmentis alreddie maid, nor to be maid to the said Thomas, erle of Melros, nor quhatsumevir uther persoun or persounes thairupone, is not nor sall nawayes be hurtefull nor prejudiciall to the said Hew, lord of Lowdoun, his aires, successoures nor assignais, nor to thair rightis and heretabill infeftmentis maid and grantit to thame be oure said soverane lord in maner before rehersit off the saidis landis, lordschip and baronies of Kyillismure and Barmure, paroche kirk of Machlene, personage and viccarage thairoff, nor to na pairt of the samene; and that the saidis actis of dissolutioun maid or to be maid of the remanent landis, lordschip and utheris foirsaidis quhilkis pertenit of auld to the said abbacie and monasterie of Melros in favoures of the said Thomas, erle of Melros, or of quhatsumevir uther persoun or persounes, is not nor sall nawayes be hurtfull nor prejudiciall to the rightis and securities maid in favoures of the said Hew, lord of Lowdoun and his foirsaidis off the saidis landis, lordschip and baronyes of Kyillismure and Barrowmure, paroche kirk of Machlene, personage and viccarage thairof, nor na pairt of the samene.
