Act in favoures of the Lord Kilmaweris anent the kirk of Dreghorne

Oure soverane lord and estaittis of parliament ratiefies and approvis the chartour and infeftment made and grantit be his majestie to his² hienes traist cousing Williame, lord Kilmaweris, his aires maill and assignais quhatsumevir heretablie off all and haill the landis of Duntryne, with the pertinentis lyand within the baronie of Kilmarnok and schirefdome of Dunbartene, upoun his awin resignatione, and of the advocatioun, donatione and right of patronage of the kirk of Dreghorne, personage and viccarage thairoff, manse, gleib, housis, biggingis, teindis, fructis, rentis and emolimentis quhatsumevir belanging thairto, as becuming in his majesties handis and at his hienes dispositioun ather be dimissioun maid thairof in his hienes handis be Johnne, archebischope of Sanctandros, commendater of the abbacie of Kilwynning, with consent of the convent thairoff, or be quhatsumevir uther dimissioun maid in his majesties handis of the said kirk of before, or be vertew of quhatsumevir dissolutioun made of the said abbacie of Kilwynning, kirkis, teindis, fructis, rentis, emolimetis, proffittes and dewties of the samene at ony tyme bigane, or be vertew of quhatsumevir uther rycht or title quhairby the said kirk, personage and viccarage thairoff, advocatioun, donatioun and right of patronage, manse, gleib, housis, biggingis, teindis, fructis, rentis and emolimentis of the samene or anye pairt thairoff hade vaikit, fallit and pertenit or micht vaik, fall and pertene to his majestie in maner specifit in the said chartour and infeftment, as the samen of the date at Edinburgh, the tent day off Maii, the yeir of God j^M vj^C and tuentie yeiris in the selff at mair lenth proportis; togidder with the uther chartour and infeftment made and grantit be his majestie under his hienes greit seale of the date at Quhyithall, the tuentie sext day of Apryill, the yeir of God j^M vj^C tuentie and ane yeiris, ratiefeand and apprevand the said former chartour and infeftment and of new disponand the saidis landis, advocatioun, donatioun and right of patronage of the said kirk of Dreghorne, als weill personage as viccarage thairoff, manse, glebe, housis, biggingis, teindis, fructis, rentis and emolimentis pertening and belanging thairto to the said Williame, lord Kilmaweris, his aires and assignais foirsaidis, with all rycht quhilk his majestie culd pretend to the samene advocatioun, donatioun and right of patronage ather as being ane pairt of the said abbacie of Kilwynning and dissolvit thairfra, or as being ane severall and distinct personage and viccarage and off auld at his majesties presentatioun, or be quhatsumevir uther maner off way the samene pertenit, pertenis or might pertene to his majestie be the lawes and pratik of this realme, with the precept and instrument of seasing following thairupoun, in all and sindrie heiddis, articles, clauses and circumstances of the saidis chartouris, preceptis and instrumentis of seasing. And his majestie and estaittis foirsaidis willes and declaris that this present generall ratieficatioun is and salbe als sufficient to the said Williame, lord Kilmaweris and his foirsaidis for bruiking and joising of the foirsaid advocation, donatioun and right of patronage of the said kirk of Dreghorne, personage and viccarage thairoff, as giff the samen infeftmentis, preceptis and instrumentis of seasing wer at lenth worde be worde insert heirintill; quhairanent his majestie and estaittis foir saidis hes dispensit and, be thir presentis, dispensses for now and evir. And farder, oure said soverane lord and estatttis of parliament hes dissolvit, dismemberit and seperatit and, be thir presentis, dissolvis, dismemberis and seperatis the said kirk of Dreghorne, advocatioun, donatioun and rycht of patronage of the samen, manse, gleib, housis, biggingis, teindis, fructis, rentis and emolimentis quhatsumevir belanging thairto, togidder with the said viccarage of Dreghorne in sa far as the samen is or may be estemit to have bene ane pairt of the said abbacie of Kilwynning at ony tyme bigane, fra the samene abbacie of Kilwynning and benefice thairoff in all tyme cuming, to the effect that his majestie may dispone the advocatione, donatione and right of patronage off the samene kirk, personage and viccarage thairoff, manse, gleib, housis, biggingis, teindis, fructis, rentis and emolimentis quhatsumevir belanging thairto to the said Williame, lord Kilmaweris, his aires maill and assignais quhatsumevir, to be haldin of his majestie and his successoures in frie blenche for payment of ane Scottis pennye yeirlie³at the feast of Witsonday, gif the samen beis askit allanerly in all tyme cuming; and als willis, grantis, decernis and ordanis that the right of patronage off the said kirk of Dreghorne, personage and viccarage thairoff, in sa far as the samene, or ather of thame, wer severall and distinct benefices of before at his majesties presentatioun salbe at the presentatioun of the said Williame, lord Kilmaweris and his foirsaidis in all tyme cuming, and that nochtwithstanding quhatsumevir actis of parliament maid of before requyring the consent off the titularis, fra the quhilk his majestie and estaittis foirsaidis exceptis the saidis infeftmentis maid and to be made to the said William, lord Kilmaweris and his foirsaidis of the said advocatione, donatioun and right of patronage of the said kirk of Dreghorne, personage and viccarage thairoff, for evir; and ordanis ane new chartour and infeftment gif neid beis to be made and past to the said Williame, lord Kilmaweris and his foirsaidis thairupoune in sick dew forme as effeiris, and that for the lang, gude, trew and thankfull service made and done to his majestie and his maist noble progenitouris be the said Williame, lord Kilmaweris and his predicessouris heirtofore; and it is declairit that this present ratificatioune salbe nawayis prejudiciall to the Earle of Eglintounes right quhilk he now hes to the kirk of Dreghorne, nor sall nevir be opposit or used to mak the Lord Kilmaweris former right stronger nor it wes of before, to the Erle of Eglintounes prejudice of his richtis quhilkis he now hes, and ordanis the Lord Kilmaweris to consent to the abovewrittin declaratioun personalie before the extracting of this act and the samen declaratioun and consent to be insert in the extract of this act be the clerk of register; conforme to the quhilk ordinance the said Lord Kilmaweris hes consentit be his subscriptioun.
