2Oure soverane lord, understanding that umquhile Euphame MacKalyeane, dochter and air to umquhile Maistir Thomas MacCalyeane of Cliftounhall, wes laitlie for certane crymes of witchcraft and tressone alleagit committit be hir convict and foirfaltit in ane justice court haldin at Edinburgh, in the moneth of [...], the yeir of God jM vC fourscoir ellevin yeiris; nochtwithstanding quhairof, his majestie tuichit in honour and conscience and now being of mynd that the said foirfaltour and convictioun sold onnawyis hurt or prejuge hir posteritie, to witt, Martha, Elizabeth and Ewphame MacCalyeanis, hir dochteris and apperand aris, in thair wardlie honour, name, fame, estimatioun and richt of successioun to quhatsumever landis, heretages, annuelrentis, takis, steddingis, rowmes and possessionis quhairto thai, or ather of theme, may succeid, or hes succedit as dochteris and aris to thair saidis mother, or to umquhill Maistir Thomas MacCalyeane, thair guidschir, or ather of thame, bot that thai and thair aris may bruik, joyis and posses thair saidis landis and heretages, and succeid thairin to thair saidis umquhile mother and guideschir and utheris thair predicessouris as gif the said umquhile Euphame haid deceissit naturallie, and that the said pretendit foirfaltour haid nevir intervenit; thairfoir, his majestie, with advise of the estaitis and haill bodie of this present parliament, hes restorit and rehabilitat and presentlie restoris and rehabilitattis the saidis Martha, Elizabeth and Ewphame MacCalyeanis, dochteris and aris foirsaidis, aganis the said pretendit convictioun and foirfaltour with all penalties and sequellis depending thairupoun, and to thair wardlie honour, name, fame, and richt of successioun foirsaid as gif sic fairfaltour haid nevir intervenit. Lyk as his majestie and estaitis foirsaidis decernis and ordanis that the samyne foirfaltour, with the pretendit proces quhairupoun the samyn procedit, sall nevir be usit in jugement nor outwith jugement, and reducis, retreittis, casis and annullis all and quhatsumevir deducit thairanent, decernis and declaris the samyn to have bene fra the beginning, baith presentlie and in all tyme cuming, null and of nane availl, force nor effect, with all that hes followit, or may follow thairupoun, and for his hienes and his successouris, renuncis and dischargis all actioun, persute or instance that may be competent be vertew of the said sentence and dome of foirfaltour; and lykwayes, reducis, retreittis etc. all giftis and dispositionis, infeftmentis, charteris, preceptis, instrumentis of seasing, presentationis and utheris grantit to quhatsumevir his hienes leigis of ony pairt or portioun of the said umquhile Euphamis landis or heretage to burgh or land, falling or depending upoun the said pretendit foirfaltour, or to the richt of quhatsumevir reversionis, takis, steddingis, rowmes or possessionis pertening to the said umquhile Euphame; and willis and declaris that it salbe lauchfull to the saidis Martha, Elizabeth and Ewfame Makcalyeanis, barnis, dochteris and aris foirsaidis, to enter thairto frelie, but obstacle or impediment, be brevis of his hienes chappell or utherwayis as accordis of law. And finallie his hienes, with advise foirsaid, ordanis the memorie of the said pretendit foirfaltour to be damnit and put in oblivioun for evir, provyding alwayes that Patrik MacCalyeane, spous to the said umquhile Euphame, be satisfiit be the saidis dochteris and apperand aris of the said umquhile Euphame off the sowme of fyve thowsand merkis payit and deliverit be the said Patrik to our said soverane lord and his hienes donatour for the gift of foirfaltour of the said umquhile Euphame. And for the said Patrik his better securitie, oure said soverane lord and estaitis foirsaidis decernis and ordanis the saidis dochteris and apperand airis foirsaidis to content, pay and thankfullie deliver to the said Patrik, thair father, the said sowme of fyve thowsand merkis, payit and deliverit be him in maner foirsaid, sua that the said sowme be tane upoun the said umquhile Euphammis heretaige be the saidis dochteris and apperand airis, with consent of the said Patrik; exceptand and reservand the landis of Cliftounhall, with the mylne, myllandis, housis, biggingis and pertinentis thairof, to Schir James Sandelandis of Slamanno, knicht, his aris and assignais provydit thairto be his majestie, as fallin in his hienes handes be ressone of escheat throw the said proces and dome of foirfaltour led aganis the said umquhile Euphame MacCalyeane, to stand in the samyn strenth, force and effect as gif this restitutioun haid nevir bene grantit, sua that the said Schir James, his aris and assignais, may bruik the saidis landis of Cliftonhall, mylne, myllandis and pertinentis thairof be vertew of his infeftment grantit unto him of the samyn upoun the foirfaltrie of the said umquhile Euphame in all tyme cuming; and als reservand to the said Schir James and his foirsaidis all actioun, entres and clame quhilk the said umquhile Euphame haid aganis Maistir Henrie MacCalyeane and all uthris quhatsumevir, for redemptioun of the saidis landis of Cliftonhall, mylne, myllandis and pertinentis thairof, and all uther actioun quhilk wes competent in hir persoun aganis the said Maistir Henrie for the saidis landis and proffittis thairof, baith bygane and to cum, ony uther maner of way, to be persewit, callit and obtenit be the said Schir James and his foirsaidis, siclyk and in the same maner as the said umquhill Ewfame micht have done in hir lyftyme befoir the said foirfaltor; and siclyk exceptand and reservand the servitude, altius edes non tollendi prospectui et luminibus non officiendi, constitute and imposit upoun ane tenement of land now pertening to Maistir Johnne Nicolsoun, advocat, lyand within the burgh of Edinburgh upoun the north syd of the Kingis Streit thairof, maid and grantit be quhatsumevir heretouris and proprietaris thairof to the said umquhile Maistir Thomas MacCalyeane, father to the said umquhile Euphame, or to quhatsumevir uther his predicessouris heretouris of the tenement or tenementis of land within the said burgh, liand upoun the north syd of the Kingis Streit thairof, and contigue adjacent to the said Maistir Johne Nicolsonis landis upoun the eist syd thairof, and all uther servitude quhatsumever quhilk the said umquhile Maistir Thomas, Euphame, his dochter, and quhatsumevir uther thair predicessouris heretouris of the said land, micht or may in onywayis acclame to be imput and constitut upoun the said Maistir Johnne, his hous, tenement of land, yard thairof and pertinetis be vertew of ony contract, band or obligatioun or be quhatsumevir uther maner of way. Quhilk constitutioun, band or obligatioun, or quhatsumevir uther richt of servitude imposite upoun the foirsaid tenement and utheris foirsaidis, oure said soverane lord and estaitis abonewrittin casis, annullis and dischargis simpliciter, and decernis the same to be of nane availl, force nor effect in all tyme cuming, sua that the said Maistir Johnne, his aris and successouris salhave edes liberas ab omni servitute that may be acclamit thairof in one maner of way be the said Patrik and his saidis tua youngest dochteris, and be the said Martha and Maistir David Ogilbie, hir spous, in ony tyme heireftir, to the quhilkis exceptionis and reservationis particularlie foirsaidis maid, alsweill in favouris of the said Schir James Sandelandis as of the said Maistir Johnne Nicolsoun, the said Patrik MacCalyeane, spous to the said umquhile Euphame, for him self and as father and lauchtfull administratour to the saidis Elizabeth and Ewphame MacCalyeanis, his tua youngest dochteris, as alsua the saidis Maistir David Ogilbie for him selff and in name and behalf of Martha MacCalyeane, his spous, consentit and aggreit.
