Act betuix the Erle of Craufurde and the burgh of Dundie

2Anent the supplicatioun presentit to oure soverane lord and lordis of articles be David, erle of Craufurde, makand mentioun that quhair, be ane chartour of alienatioun of fewferme fra Johnne Fergussoun, provinciall of the Gray Freris of Dundie, with the consent of the rest of the freris of the said place, annaliit to his said umquhile fader, David, last erle of Craufurde, all and haill thair yairdis, toftis, croftis and medowis, with thair pertinentis, liand on the north side of the said burgh of Dundie, gevin out to thame of befoir be his predicessouris, upoun the quhilk alienatioun of fewferme his said umquhile fader obtenit confirmatioun, quhilk is reddie to be producit befoir his majestie and lordis; nochttheles as the said erle is informit be ane generall gift gevin to the burgh of Dundie of all the giftis and annuellis etc. pertening to ony freris or alterages within thair said burgh, quhilk thai desir to be confermit be ane generall act in this present parliament, and thairby thai intend to tak fra the said erle his said rycht and title, thairfoir desiring gif the said act be not past bayth thair titillis be sichtit befoir his majestie and lordis that it may be knawin quhilk of thame hes the best rycht for eschewing of langair proces; and incais it be past becaus the said erle knew not of the samin and it is done in his prejudice, he desiris presentlie to be harde in thair presence afoir ony furder voitting in the said mater, as at mair lenth is contenit in the said supplicatioun. Quhilk being hard, sene and considerit be his hienes and estaittis, oure said soverane lord, with advise of his saidis estaittis of parliament, understanding the confirmatioun of the generall gift grantit to the burgh of Dundie of the saidis freir landis and annuellis etc. onnawyse yit to be past nor grantit, ordanis the said David, erle of Craufurde, to be harde upoun the contentis and desir of this present supplicatioun, and the samin to be red how sone or at quhat tyme the toun of Dundie or ony utheris in thair names gevis in or suittis confirmatioun to be grantit to thame of thair said generall gift of the saidis freir landis and annuellis liand within the said burgh appertening to the samin; quhairupoun the said David, erle of Craufurd, askit instrumentis.
