Erll of Marris attestatioun

Anent the supplicatioun presentit to the kingis majestie and his estaitis assemblit be Johnne, erll of Mar, lord Erskin, makand mentioun that quhair his hienes hes remanit within this his majesties castell of Striviling almaist continewallie sen his birth, being now enterit in the fourtene yeir of his aige under the nutritoure of the said erllis umquhile fader Johnne, erll of Mar, lord Erskin, sumtyme regent to his hienes, his realme and liegis, Annabill, countes of Mar, his moder, and Alexander Erskin of Gogar, maister of Mar, his uncle, likeas, sen his hienes acceptit the governament of his realme in his awin persoun, for the maist part the said erll hes had the charge of attendence upoun his majestie and keiping of his said castell, quhairin the said erllis guidwill hes bene and is faithfullie to serve his hienes, as God knawis, to his majesties weill and honour and to the contentment of his nobilitie and haill subjectis; bot seing his majestie now cum, at Goddis plesir, to the perfectioun of aige, and that his hienes, with avise of his estaitis, hes fund it expedient and resolvit that his majestie sall hald his parliament at his burgh of Edinburgh and repair thither in propir persoun sa that his continewall residence in this castell, nor na uther place, can be langer nor his hienes self, with his resident counsale for the tyme, sall think meit and convenient for his majestie, maist humilie, thairfoir, requiring his hienes attestatioun, declaratioun and discharge to the effect underwrittin. Quhilk supplicatioun being red, hard and considderit be the kingis hienes and his saidis estaitis presentlie assemblit, and his majestie and they being weill avisit thairwith, eftir mature deliberatioun, oure soverane lord and his saidis estaitis presentlie convenit, all in ane voce, without discrepance or contradictioun, findis, declaris, affermis and testifiis that the said Johnne, erll of Mar, lord Erskin, his said umquhile lord and father, his moder, his uncle, him self and his friendis, servandis and dependaris assisting his said umquhile fader, his eme and him self in performing of the charge of the preservatioun of his hienes persoun and castell of Striviling, into the quhilk his majesties residence hes bene unto his present tyme, hes done his hienes trew, thankfull, worthie and gude service and dewlie accomplishit thair said charges sen the acceptatioun thairof, conforme to the instructionis, actis of secreit counsale and of parliament past thairanent of befoir, allowand and apprevand the same presentlie; and that thai and thair souirties fund be thame for the keiping of the said castell of Striviling, in naim and to the use and behuif of his hienes, and attendence upoun his majesties persoun and preservatioun of the same within his said castell, at the divotioun and directioun of his majestie and his said counsale, be from the day that his hienes depairtis frome this castell toward Edinburgh frelie exonerit, quitclamit and dischairget for thame and thair airis of the bandis, actis and obligationis maid to this effect in tyme bigane be his said umquhile fader, his uncle, himself and thair freindis, and of all actioun, sute or clame that may be intentit aganis him or thame for ressaving, accepting and using of the said charge be command of his hienes, the quene, his dearest moder, or ony his majesties regentis in tyme bigane, sa that heireftir the said erll sall not be further obleist in keiping of the said castell of Striviling bot as the utheris capitanis and keiparis of his hienes castellis and houses havand the custody thairof in heretage or takis or during his majesteis will, and that in signne and taiken of his majesties favoure and in part of recompance of that faithfull gudwill and trew service that his foirbearis and him self hes maid unto his majestie and his progenitouris in tyme bigane as he intendis, Godwilling, to continew alwyise in the like fidelitie and trew service to his majestie in tyme cuming. And ordanis this his present attestatioun, declaratioun and discharge to be ratifiit and approvit in his hienes nixt parliament.
