Act in favour of [Sir Robert Gordon], laird of Lochinvar
Our sovereign lord and estates of this present parliament ratify and approve the infeftment made and granted by his majesty under his highness's great seal to his majesty's beloved Sir Robert Gordon of Lochinvar, knight, his male heirs and assignees whatsoever heritably of all and whole the barony of Crossmichael, comprehending the lands and right of patronage, teinds and others therein mentioned of the date the [...] day of [...] 16[...], with the precept and instrument of sasine following thereupon, in all and sundry points, heads, articles and clauses therein contained after the forms and tenors thereof, and statute and ordain this present ratification to be as valid, effectual and sufficient in all respects as if the infeftments above-specified, precept and instrument of sasine following thereupon were at length and word by word inserted herein. And further, our said sovereign lord and estates aforesaid, for the good, true and thankful service done to his majesty by the said Sir Robert Gordon of Lochinvar, knight, which service his majesty and estates aforesaid have tried and found to have been very profitable to his majesty and to this realm and lieges thereof and worthy of remuneration, therefore his majesty and estates aforesaid have dissolved and dissolve all and sundry the lands and others underwritten, namely: all and whole the two merk land and a half merk land of Suffock, alias Suffock; the five merk land of Ernambrie; the five merk land of Auchendolly; the five merk land of Largneane; the two merk and a half merk land of Ernfillan; the five merk land of Culgruff; the five merk land of Cradell, alias Crodell; the five merk land of Mollance; the five merk land of Hillowton; the five merk land of Clarebrand; the ten merk land of Crofts; the five merk land of Glengopoke; all and whole the lands and mains of Greenlaw, with the kane peats and bondage works of the whole barony of Crossmichael and due service of the same barony and all their pertinents; all and whole the five merk land of Ernespie; the ten merk land of Chapelerne; the two merk and a half merk land of Clarebrand, with parts, pendicles and pertinents of the same whatsoever; the five merk land of Little Dryburgh; the five merk land of Drumjarg; the five merk land of Ernfillan; the five mark land of Erncraig; the five merk land of Blairinnie; the five merk land of Meikle Dryburgh; the five merk land of Chapmanton; the five merk land of Blackerne; the five merk land of Ernminzie; the five merk land of Culnaightrie; the corn mill of Crossmichael; the five merk land of Garranton; the two merk and a half merk land of Blackpark, with all and sundry their castles, towers, fortalices, manor places, houses, buildings, yards, orchards, mills, woods, fishings, parts, pendicles, annexes, connexes, outsets, tenants, tenancies, service of free tenants, feu ferms, kanes, customs, services, casualties and all other commodities of all and sundry the lands, mill, woods, fishings and others above-rehearsed, all lying within the stewartry of Kirkcudbright, all united, created and incorporated in a whole and free barony called the barony of Crossmichael from his majesty's crown and patrimony thereof, and from all acts of annexation made by his majesty and his predecessors whereby the lands and others aforesaid, or any part thereof, were annexed to his majesty's crown, and except the same lands and others above-rehearsed out of the said acts of annexation. And also have dissolved and disunited and, by this act, dissolve and disunite all and sundry the teind sheaves and other teinds, as well parsonage as vicarage, fruits, rents, emoluments and duties whatsoever of the parish kirk of Kirkmabreck lying within [...] from the abbacy of [...], and from all other abbacies and benefices whereunto the same was annexed or pertained of before, to the effect that his majesty may give, grant and convey to the said Sir Robert Gordon of Lochinvar, knight, his male heirs and assignees aforesaid heritably all and sundry the lands, kirks, teinds and others particularly and generally above-specified, together with all right, title, interest and claim of right which his majesty, his highness's predecessors or successors had, has or in any way may have or claim thereto, or any part thereof, in time coming; and also to the effect that his majesty may of new unite, create and incorporate all and sundry the lands, kirks, teinds and others particularly and generally above-specified, and all their parts, pendicles and pertinents above-specified in a whole and free temporal barony to be called now and in all time coming the barony of Crossmichael, ordaining the aforesaid manor place of Greenlaw to be the principal messuage of the said barony and that a sasine now to be taken by the said Sir Robert Gordon of Lochinvar, knight, and by his male heirs and assignees aforesaid in all time coming at the said principal messuage shall stand and be sufficient sasine for all and sundry the lands, kirks, teinds and others particularly and generally above-written, with all their parts, pendicles and pertinents above-expressed, without any other special or particular sasine to be taken by him or them at any other part or place thereof, to be held of our said sovereign lord and his successors in free blench, fee heritage and free barony forever, paying yearly the said Sir Robert Gordon and his male heirs and assignees aforesaid to our said sovereign lord and his successors for all and sundry the lands and others above-specified, with all their parts, pendicles and pertinents above-expressed (except the aforesaid teinds, parsonage and vicarage, of the said kirk of Kirkmabreck), the sum of £20 usual money of this realm of Scotland at the feast of Whitsunday [May/June] in name of blench ferm only, and for all and sundry the aforesaid teind sheaves, other teinds, as well parsonage as vicarage, fruits, rents, emoluments and duties of the said parish kirk of Kirkmabreck one penny money aforesaid at the feast of Whitsunday at the said manor place of Crossmichael in name of blench ferm, if it be asked, and likewise paying to the minister present and to come serving the cure at the said kirk of Kirkmabreck their yearly stipends and duties contained in the infeftments granted to John Murray of the said kirk and teinds thereof, and relieving the said John Murray and his foresaids of the same stipends and of the reparation of the said kirk and of all taxations, impositions and other burdens imposed and to be imposed upon the said kirk and teinds thereof, and of the furnishing of the elements of bread and wine to the celebration of the communion within the said kirk in all time coming only, with this declaration: that this present ratification extends not to the kirk of Crossmichael, whereunto the laird of Lochinvar, present, consented. And my lord [Robert Maxwell, earl of] Nithsdale presently protested for Dame Agnes Maxwell, spouse to William Douglas, his sister, that this present act prejudice not her in her right to the mains and house and lands of Greenlaw and pertinents; which protestation the lords admitted.
