Ratification to Sir George Hay of his infeftment of the lands of Kincaple
Our sovereign lord and estates of this present parliament presently convened, having seen and considered the infeftment and charter made and granted by the reverend father in God, George [Gledstanes], archbishop of St Andrews, with consent of the chapter of the cathedral kirk thereof, of the date the [...] day of [...] 1612, ratifying and approving the charter of feu ferm made and given by the late Patrick [Adamson], archbishop of St Andrews, to the late George Haliburton of Pittarchy and Margaret Dumbreck, his spouse, their heirs and assignees mentioned therein, of all and whole a twenty fourth part of the towns and lands of Kincaple occupied for the time by John Mitchell, and of a sixteenth part of the said towns and lands on the west side of the same occupied by David Forrester, and of another sixteenth part of the said town and lands occupied by Thomas Vennesone, with their pertinents, lying within the regality of St Andrews and sheriffdom of Fife; and likewise ratifying the charter made and given by the said late Patrick, archbishop of St Andrews, to the said late George Haliburton, his heirs, assignees and successors, of all and sundry the feu ferms of a sixteenth part of the said town and lands of Kincaple occupied by Patrick Kinninmonth of Callinsche, and of a third part and ninth part of the said town and lands occupied by Patrick Duddingston, and of a twenty fourth part of the said town and lands occupied by Andrew Month, and of another twenty fourth part of the said town and lands occupied by David Forrester, and of another twenty fourth part of the said town and lands occupied by Andrew Brown, and of another twenty fourth part of the said town and lands occupied by [...] and their tenants, together with a precept of clare constat made and given by the said George, archbishop of St Andrews to James Haliburton of Essie, as son and heir to the said late George Haliburton, of all and sundry the said feu ferms of the foresaid particular parts and portions of the said town and lands of Kincaple, and a charter made and given by the said James Haliburton of Essie to Sir George Hay of Nether Liff, knight, his male heirs and assignees, of all and whole the said twenty fourth part of the said town and lands of Kincaple occupied for the time by the said John Mitchell, and of the said sixteenth part of the said town and lands occupied by the said David Forrester, and of the said other sixteenth part of the said town and lands occupied by the said Thomas Vennesone, and another charter made and given by the said James Haliburton of Essie to the said Sir George Hay, his male heirs and assignees, of all and sundry the said feu ferms of the said other particular parts and portions of the said town and lands above-expressed, with their pertinents; and likewise containing a new infeftment and gift of novodamus made and granted by the said George, archbishop of St Andrews, with consent foresaid, to the said Sir George Hay, his heirs and assignees mentioned therein, of all and sundry the foresaid twenty fourth part of the said town and lands of Kincaple occupied for the time by the said John Mitchell, and of the said sixteenth part of the said town and lands occupied by the said David Forrester, and of the said other sixteenth part of the said town and lands occupied by the said Thomas Vennesone, and also of all and sundry the said feu ferms of the said other particular parts and portions of the said town and lands above-expressed, with their pertinents; and being ripely advised therewith, his majesty and estates foresaid have ratified and approved and, by the tenor hereof, ratify and approve the foresaid charter and infeftment in the whole heads, articles, clauses, circumstances and conditions contained therein and whole contents thereof, decreeing and ordaining the said Sir George Hay, his heirs and assignees to have the undoubted right to the foresaid lands, and of the feu ferms and duties contained in the foresaid infeftments and charters respectively perpetually in all time coming to be possessed, enjoyed, intromitted with, taken up, used and conveyed by them after the form and tenor of the foresaid charter and infeftment in all points.
