Act in favour of James and John Menzies
2Concerning the supplication presented and given in to our sovereign lord and lords of articles by James Menzies of Ford and John Menzies, his son, making mention that where they are denounced our sovereign lord's rebels and put to his highness's horn at the instance of some persons who, upon pretence thereof, intend to seclude them from all compearance in judgement in pursuit and defence of diverse actions presently depending before the lords of session and other judges, which are of great weight and consequence to the recovery of the which actions, relief of the said horning and satisfaction of their creditors, seeing it is necessary that they be heard in judgement by themselves and their procurators; and therefore desiring our said sovereign lord, with advice of his said estates, to dispense with all and whatsoever hornings or other acts of parliament made in the contrary led against the said James and John Menzies, at the instance of whatsoever person or persons, for any cause or occasion past preceding the date hereof, to the [...] day of [...] coming, to the effect that they, by themselves or their procurators, may pursue and defend in their just actions and thereby recover relief of the said hornings, and in the meantime that they may lawfully resort within the realm in doing of their lawful business, ordaining therefore the lords of council and session to suffer and permit the said persons, by themselves and their procurators, to do and defend in their said actions, notwithstanding of the said hornings or anything therein contained made in the contrary, concerning the which it will pleasure his highness and three estates to dispense, as at more length is contained in the said supplication. Which being heard, seen and considered by his majesty and lords of articles, and they therewith being ripely advised, our said sovereign lord, with advice and consent of the said estates of parliament, dispenses with all and whatsoever hornings or acts of parliament made in the contrary led against the said James and John Menzies, at the instance of whatsoever person or persons, for any cause or occasion past preceding the date hereof, so far and in the same manner as the lords of council and session have dispensed already with the aforesaid hornings; to the effect the said James and John Menzies, by themselves and their procurators, may pursue and defend in their just actions and thereby recover relief of the said hornings, and in the meantime that they may lawfully resort within the realm in doing of their lawful business as amply and freely in all sorts as the said lords of council and session have granted the same to them of before.
