Anno gracie millesimo trecentesimo septuagesimo primo et regni Regis Roberti secundi anno secundo, ac mensis Marcii die secundo, cum continuatione dierum subsequentium, in pleno parlamento ipsius regis tento apud Sconam fuit statutum et ordinatum de consensu et assensu trium communitatum per presidentes sive per personas electas ad determinationem negotiorum in parlamento eodem quod, cum plura homicidia perpetrata fuissent ante tempus parlamenti predicti, quoque justicia quo ad huiusmodi homicidia per regni consuetudines de ipsis homicidis tam cito fieri non potuit sicut expediret pro utilitate communi, rex ex nunc habebit potest[atem] et debet facere per ministros suos et alios quos ad hoc deputare volverit capi et carceri mancipari homicidam et incontinenti cognosci facere per assisam si homicidium fuit perpetratum ex certo et deliberato proposito vel per forthouchfelony sive murthir vel ex calore iracundie videlicet chaudemellee. Et si compertum fuerit per assisam ipsum homicidium perpetratum fuisse per forthouchfelony vel per murthir incontinenti facienda est justicia; si vero per chaudemellee fuerit perpetratum homicida habebit dilationes et defensiones legitimas et debitas per leges regni et consuetudines hactenus approbatas. Et hec omnia locum habent et habebunt ubi homicidium est notarium et de homicida notorie potest constare. Et in casu quo committens homicidium per forthouchfelony vel per murthir non poterit apprehendi sed est forte fugitarus fiat publica proclamatio per vicecomitem apud capitale manerium regis quod talis homicida se exhibeat et presentet coram vicecomite aut alio ad hoc deputato per regem infra quadraginta dies a tempore homicidii perpetrati ad faciendum cognosci per assisam an homicidium fuit perpetratum per murthir vel per forthouchfelony, alioquin extunc perpetuo sit bannitus et exul et ipsius bona confiscata in usus regis vel baronis. Cui bona talia tanquam escaeta debentur et terre si quas habuerit pro tempore vite sue sint confiscate et applicate in usus regis vel baronis cui per leges regni hactenus approbatas debentur. Et premissa omnia fiant per ministros regalitatum et baroniam sicut per ministros regis quando et quotiens homicidium infra regalitatem vel baroniam perpetrari contigerit alioquin per ministros regis in eorum defectu.

Item statutum fuit quod omnes homicide qui fuerint prosecuti et calumpniati de commisso homicidio per chaudemellee ex parte australi aque de Forth' non sint audiendi ultra septimum diem litis incepte, nec ex parte boreali aque eiusdem ultra quarto diem litis mote proponendo exceptiones dilatorias vel frivolas sed statim ipsis exceptionibus dilatoriis et frivolis omissis procedendum est in lite. Et ordinatum fuit et statutum quod ad futura solummodo se extendant premissa statuta et non ad preterita nec ad pendentia sed quod in ipsis preteritis et pendentibus locum habent leges et consuetudines hactenus approbate.

Item statutum fuit de illis qui homicidia commiserint ante tempus huius parlamenti sive statuti quod, si infra quadraginta dies a tempore proclamationis ipsius statuti se exhybuerint et presentaverint, juri communi tractandi sunt et erunt secundum antiquas leges regni hactenus approbatas. Si vero se exhibere vel presentare nolverint aut forte communi juri stare recusaverint extunc incident in pena supradicti statuti et per confiscationem rerum et terrarum puniendi sunt ut supra.

Item quociens homicida assumpserit immunitatem ecclesie monendus est et requirendus ut supra ut exeat et se exhibeat juri ad cognoscendum per assisam si per murthir sive per forthouchfelony fuit homicidium perpetratum. Si vero sic requisitus et monitus se exhibere vel presentare noluerit, tanquam de murthir et forthouchfelony convictus baniendus est et exulandus extunc perpetuo, servata sibi immunitate ecclesie quam assumpsit. Si vero se exhibuerit et presentaverit communi juri et justicie et compertum fuerit per assisam quod per chaudemelle fuit homicidium perpetratum, restituendus est immunitati ecclesie sicut prius et de hoc habebit vicecomitem ipsum assecurare antequam de immunitate exierit quam assumpsit.

Item si aliquis fuerit de receptatione homicide irretitus ministri regis habebunt de hoc ab ipso veritatem inquirere et si fateatur receptationem homicide cavebit et securitatem inveniet sufficientem quod non erit homicide amplius receptator, et quod suam diligenciam et posse ponet diligenter pro homicida arrestando, si potest, et quod requisitus laborabit per se vel per alium cum ministris regis vel baronis pro ipso arrestando. Si vero negaverit se esse receptatorem homicide nichilominus requisitus per ministros regis vel baronis apponet diligenciam pro posse ut supra. Si vero vehemens suspicio ultra hoc habeatur de aliquo, debet per ministros regis vel baronis arrestari et liberari sub securis plegiis, vel si hereditatem notabilem habeat ad proprium plegium de comparendo et stando juri communi ubi, quando et coram quo de hoc citius cognosci poterit et melius per partes ipsius arrestati in curia videlicet baronis, vicecomitis, justiciarii aut in parlamento regis.

Et ad premissa omnia observanda omnes regni barones prestiterunt magnum juramentum corporaliter, de consuetudine regni in arduis prestari consuetum coram rege in parlamento predicto.
