Our sovereign lord, considering the spirituality of the ministry of Failford to be altogether dilapidated and put away by the ministers and titulars of the same for the time, and that by the act of annexation of the temporality of benefices to the crown made in his highness's parliament held in the month of July 1587, the temporality of the ministry of Failford is annexed to his majesty's crown, so that for the present there remains nothing to be possessed and enjoyed by the present minister and his successors for their maintenance. And his majesty, remembering that by the late provision and gift of the said benefice of the ministry of Failford granted in favour of Master Walter Whitford, present minister of Failford, his majesty has already made assignation to the said minister in his cause during all the days of his lifetime of the whole mails, ferms, feu ferms, kanes, customs, casualties, profits and duties of the whole temporality of the said benefice; and his majesty, being now graciously pleased that the same remain also with his successors who shall be lawfully provided hereafter to the said benefice and to this effect to restore the said minister of Failford and his successors to all and sundry lands, superiorities, mills, woods, fishings, patronages and others pertaining to them before the said act of annexation, therefore his majesty, with express advice and consent of the estates of this present parliament, not only ratifies and approves the gift and provision granted by his majesty under the great seal of the date at Windsor, 30 August 1619, to the Master Walter of the said benefice of the ministry of Failford, with the said assignation made to him of the whole mails, ferms, kanes, customs, casualties, profits and duties of the temporality of the said benefice, but also has dissolved and, by the tenor hereof, dissolves from the crown and patrimony thereof all and sundry towers, fortalices, lands, mills, woods, fishings, annualrents, tenements, patronages and others whatsoever pertaining of old to the benefice of the said ministry of Failford and formerly annexed to his majesty's crown as said is, and unites and annexes the same of new again to the said ministry of Failford in the same manner as they were before the said annexation of the same to his majesty's crown, to the effect that the same with the mails, ferms, feu ferms, kanes, customs, superiorities, casualties, profits and duties thereof whatsoever may be enjoyed and peaceably possessed by the said Master Walter Whitford, present minister of Failford, and after his decease by his successor ministers of Failford without prejudice always of the feus and other rights lawfully made of whatsoever tenements, annualrents, mills, woods, fishings pertaining thereto to the parties having right to the same. And to the effect that all such persons who before the act of annexation were tenants and vassals to the said ministers of Failford may be in certainty and know to whom they should be entered and received in the lands and others held by them of the said ministers of Failford, therefore it is statute and ordained by our sovereign lord and estates that when such occasion shall offer of receiving of vassals or changing of tenants who come in the vassals' place, either by alienation of the vassals or comprising from them or by any other lawful manner, the said minister of Failford and his successors shall be held and astricted to do the same and to enter all such persons, they doing their duty to the superior at their entry as appertains.
