Act in favour of Sir John Scott of Scotstarvit

Our sovereign lord and estates of this present parliament ratify and approve and, for his majesty and his successors, perpetually confirm the charter and infeftment made and granted by his majesty under his highness's great seal to his majesty's beloved Sir John Scott of Scotstarvit, knight, director of his highness's chancellery, his male heirs and assignees whatsoever heritably of all and whole the lands and barony of Scotstarvit, comprehending the lands and others after-specified, namely: all and whole the lands and barony of Tarvit, with the tower, fortalice, manor place, houses, buildings, yards, orchards, rabbit-warren, dovecot, mill thereof, mill lands and multures of the same, annexes, connexes, outsets, parts, pendicles and pertinents of the same whatsoever lying within the parish of Ceres and sheriffdom of Fife; and also of all and whole the lands and barony of Caiplie, comprehending the lands and others after-mentioned, namely: all and whole the lands of Caiplie Overton, alias called Third Part, with the pendicle thereof called Stavert; the lands of Netherton of Caiplie, with the mill lands, multures and sequels thereof, together with the fishings pertaining to the said lands and with tower, fortalice, manor place, houses, buildings, yards, orchards, dovecot, annexes, connexes, parts, pendicles and all their pertinents lying within the barony of Tarvit by annexation and sheriffdom of Fife aforesaid; and likewise all and whole the lands of Easter Pitcorthie, with houses, buildings, yards, orchards, annexes, connexes, parts, pendicles and pertinents thereof whatsoever lying within the parish of Kilrenny and sheriffdom of Fife aforesaid, with full right, liberty and privilege of commonty and common pasturage and casting, extracting and conveying of fuel, fail and divot in and upon the muirs, commonly called the King's Muir and Crail Muir, within the whole bounds, meiths and marches thereof, according to the said Sir John, his predecessors and authors, their possession of the same; and also all and sundry the teind sheaves and vicarage teinds of the said lands of Over Caiplie, alias Third Part of the aforesaid town and lands of Nether Caiplie, with the mill thereof and mill lands of the same; and of the aforesaid town and lands of Easter Pitcorthie, with the cottages, parts, pendicles and all their pertinents included therewith pertaining to the said Sir John heritably, all united, annexed, created and incorporated in a whole and free barony called and to be called the barony of Scotstarvit, containing therein a new gift, with an union thereof, in a whole and free barony called the barony of Scotstarvit as said is, to be held of our said sovereign lord and his successors in fee and heritage for ever, likewise at more length is contained in the said charter and infeftment of the date at Edinburgh, 11 February 1619, together with the precept of sasine made according to the said charter and instrument of sasine following thereupon, of whatsoever date or dates, tenor and contents the same be, in all and sundry points, passages, heads, articles, clauses, circumstances, provisions and conditions whatsoever therein contained, with all that has followed or may follow thereupon; willing and granting and, for his majesty and his successors, with advice and consent of the whole estates of this present parliament, decreeing and ordaining this present general ratification to be as good, valid, effectual and sufficient to the said Sir John Scott and his foresaids for possessing and enjoying of the lands, barony, teinds and others with the pertinents thereof above-mentioned as their heritage at their pleasure in all time coming, in the same way as if the aforesaid charter and infeftment, precept and instrument of sasine following thereupon were at length and word by word engrossed herein; concerning which his majesty, with advice and consent aforesaid, has dispensed and, by this act, for his highness and his successors, dispenses for ever, saving and reserving always to his majesty and his successors the feu blench and other duties of the lands, barony, teinds and others above-specified with the pertinents thereof above-written due and customary to his highness and his predecessors before this present ratification. Moreover, our said sovereign lord and estates aforesaid, understanding that the late King James V of worthy memory, his majesty's grandfather, gave and granted special licence, faculty and freedom to the late Alexander Inglis of Inglistarvit, heritable proprietor of the lands and barony above-expressed, with the pertinents for the time, to close up, remove and destroy that part of his highness's high street and common gate passing between his place and his barns, barn yards and stables of Inglistarvit, now called Scotstarvit, on the west side of the place thereof, and to make the said high passage and common gate as large and wide as it was of before and as commodious upon the east side of the said place of Inglistarvit, now called Scotstarvit, and to hold the same as large in all time coming to be used by his majesty and his highness's lieges resorting thereto as his highness's common gate was and is at the west end of the said place, and willed and granted that he should not be accused nor incur any harm or danger in his person, lands, goods or gear through this in any time thereafter, notwithstanding of whatsoever acts of parliament, laws, statutes or constitutions of this realm made or to be made in the contrary, as the said licence of the date subscribed by his majesty's own hand and given under his highness's signet at St Andrews, 2 June and of his majesty's reign the 29th year, at more length bears. Which licence, our said sovereign lord and estates aforesaid ratify and approve in all points according to the tenor thereof, and of new again his majesty, with advice and consent aforesaid, by this act, gives and grants full licence, free faculty and liberty to the said Sir John Scott and his foresaids to remove, divert and destroy that part of the aforesaid high street and common way which lies from the ferry side to the burgh of Cupar on the west side of the said Sir John's place of Scotstarvit, at what time he or they best please, providing always that he and they make as large, ample and commodious a highway and common street upon the east side of the said place of Scotstarvit for serving of his majesty's lieges as the aforesaid common high passage and gate is at the west end of the said place, and wills and grants and, for his majesty and his successors, with advice and consent aforesaid, declares that the said Sir John nor his foresaids shall not be accused nor incur any harm, damage or danger in his person, lands, goods or gear through this by any manner of way in time coming, notwithstanding whatsoever acts of parliament, laws, statutes or constitutions of this realm made or to be made in the contrary; concerning which, and regarding all pains therein contained, our said sovereign lord, with advice and consent aforesaid, has dispensed and, by this act, for his highness and his successors, dispenses for ever. Discharging likewise by this act the lords of his highness's privy council and session, justices, sheriffs and all other officers and ministers of the laws within this his majesty's kingdom, and all and sundry their deputes and substitutes present and to come, of all calling, accusing, summoning, arresting and pursuing of the said Sir John Scott or his foresaids, their tenants and servants thereof by any manner of way in time coming, and of their offices in that part for ever, and that the said confirmation and licence stand as said is.
