Ratification to the burgh of Aberdeen

Our sovereign lord and estates of this present parliament ratify, approve and for his highness and his successors perpetually confirm the erection of the burgh of Aberdeen in a free burgh, with all infeftments, privileges, rights and titles made and granted by his highness and his predecessors to them of before, and decree and declare the same to stand in the full strength, force and effect in time to come.

Ratification of the burgh in barony of Turriff

Our sovereign lord and estates of this present parliament ratify, approve and for his highness and his successors perpetually confirm the charter and infeftment granted by the late James IV of good memory, under his highness's great seal, regarding the erection and creation of the town and lands of Turriff, with the pertinents, lying within the sheriffdom of Aberdeen in a free burgh of barony, with all privileges, liberties and immunities of free burgesses, free crafts, free fairs, weekly market, buying and selling within the same mentioned in the said charter, together with all and sundry points, articles and clauses specified in the said charter, as the same of the date 10 March the year of God 1591 [1592] bears; saving always to our sovereign lord and his successors service of burgh of barony due and customary to his highness and his predecessors of before this present confirmation only. In addition, our said sovereign lord and estates foresaid, by the tenor hereof, will and grant and for his highness and his successors decree and ordain that this present confirmation is now and shall be in all times coming of as great force, strength and effect as if the forenamed charter and infeftment were word by word engrossed in this present act; regarding which and all defaults and defections which may follow thereupon our sovereign lord for his highness and his foresaids dispenses for ever, [and ordains an act to be made hereupon in the appropriate form].

Ratification of the king's majesty's acquittances to the burgh of Dundee

Our sovereign lord, in presence of the estates of this present parliament, ratifies, approves and for his highness and his successors perpetually confirms the acquittance and discharge granted by his highness, with advice of the lords of secret council and of his highness's comptroller, to the provost, bailies, council and community of the burgh of Dundee and their successors of the sum of £20,000 as that part of his highness's tocher which were deposited and put in their hands by the said comptroller in his majesty's name, and of the whole arrears of the yearly profit of the said sum of all years and terms preceding the date hereof; granting therewith likewise the contract and appointment made permanent between the said comptroller in his highness's name on the one part, and certain commissioners of the burghs of this realm on the other part, of the date the [...] day of July 1590, to be fulfilled and kept in all points according to the tenor thereof by the said provost, bailies, council and community of the said burgh for their parts, as the same acquittance and discharge of the date 16 May last at more length purports; together with all and sundry points, articles, circumstances and conditions mentioned therein, willing, granting and declaring that this present ratification shall be as valid and effectual as if the forenamed acquittance and discharge were word by word engrossed in this present act; regarding which, and all defaults and defects that may follow thereupon, his majesty and estates foresaid by this charter dispenses for ever.

Ratification to [Ludovic Stewart], duke of Lennox

Forasmuch as our sovereign lord has given and granted to his highness's dearest cousin Ludovic, duke of Lennox, earl of Darnley, lord Tarbolton, Methven and d'Aubigny etc. during all the days of his lifetime all and whole the temporality of the priory of Pluscarden, extending yearly to the sum of 700 merks money, as in the gift of pension granted to him thereupon under the privy seal upon 8 November 1592 at more length is contained; and his majesty willing that the said gift may be sure to the said Ludovic, duke of Lennox for possessing and enjoying of the same and sum of money above-specified during the time therein contained, therefore our said sovereign lord and estates of this present parliament ratify, approve and confirm for his highness and his successors the said letter of gift and pension of all and whole the temporality of Pluscarden, extending yearly to the said sum of 700 merks, in all heads, points, articles, clauses and conditions specified therein with all that has followed thereupon; and will that this present ratification and confirmation is and shall be as valid, effectual and sufficient to the said Ludovic, duke of Lennox as if the said letter of pension and gift were expressly inserted herein, notwithstanding the act of annexation made in the parliament held at Edinburgh on 29 July 1587, to the which this present ratification shall make express derogation so far as may be extended to the said temporality of Pluscarden.

Ratification to [John Erskine], earl of Mar

Our sovereign lord and the estates of this present parliament ratify and approve the gift of the office of the keeping of the castle of Edinburgh granted by his majesty to his right trusty cousin and councillor John, earl of Mar, lord Erskine and Alloway etc., with the assignation of the money and victual assigned therein for keeping of the said castle etc., in all and sundry points, heads, clauses and conditions therein contained after the form and tenor thereof, to the effect the said assignation of the victual and money above-specified contained in the said gift appointed for sustentation of the said castle and keeping thereof may be the more effectual. Our said sovereign lord and estates revoke, rescind, make void and annul all and whatsoever pensions, gifts, assignations or any other dispositions whatsoever made by his highness to the hurt and prejudice of the said assignation contained in the said gift and which may impede and stay the peaceable possession, uplifting and intromitting with the said victual and money therein contained in any way, decreeing and declaring the same pensions, gifts, assignations and dispositions to be null and of no value in all time coming.

Ratification to David Seaton of Parbroath, comptroller

Our sovereign lord, the estates and whole body of this present parliament ratify and approve and for them and their successors perpetually confirms the infeftment, namely: charter, new gift and disposition therein contained, precept of sasine, with the instrument of sasine following thereupon, made and granted by our said sovereign lord in the year of God 1592 after his grace's perfect age, general and special revocations to his well-beloved and familiar councillor David Seaton of Parbroath, his highness's comptroller, and to the male heirs lawfully procreated or to be procreated of his body, which failing, to his nearest and lawful male heirs whatsoever bearing the arms and surname of Seaton, of all and whole the lands and barony of Parbroath, annexes and connexes thereof, whole lands, mills, towers, fortalices, manor places and others whatsoever at more length specified and contained in the same infeftment, in all points, heads, articles, clauses, conditions, provisions, circumstances, privileges and liberties whatsoever therein mentioned; and wills and declares that this general ratification and approbation of the forenamed infeftment, namely: charter, precept and instrument of sasine following thereupon is and shall be in all times coming of as great force, strength and effect to the said David Seaton of Parbroath and his male heirs above-written as if the foresaid whole infeftment, namely: charter, precept and instrument of sasine had been at length word by word engrossed and inserted herein.

Ratification to [Alexander Hay of Easter Kennet], clerk register, and Master John Hay, his son

Our sovereign lord and estates of this present parliament ratify, approve and for his highness and his successors perpetually confirm the charters and infeftments after-specified made, given and granted by his highness or by the other persons underwritten, either to his well-beloved clerk and councillor, Alexander Hay of Easter Kennet, clerk register, or to Master John Hay, his eldest son, one of the clerks of council, and to the persons therein and after mentioned of the lands, annualrents, teind sheaves and others respectively underwritten therein specified, namely: one of the said charters made and granted by his highness to the said Master John Hay, his male heirs and assignees whatsoever heritably of all and whole the place and ground whereupon the chapel of the preceptory of St Anthony stood and was built, with the kirkyard, mansions, houses, buildings, chambers, yards and orchards of the same and whole pertinents thereof; as also of all and sundry the lands, tenements, annualrents, teind sheaves and other teinds, fruits, [...] particularly therein and under specified, ferms, tenants, tenancy and service of free tenants thereof, with the whole pertinents of the same, and all other commodities which justly pertains to the said preceptory and patrimony thereof, or which the preceptors of the same in any time bygone held or possessed, as the said charter of the date at Dalkeith 28 March 1591 at more length bears. Another charter of feu ferm made, given and granted by Francis [Hay], sometime [earl of Erroll] in parliament, with consent of diverse persons therein specified at whose instance he was interdicted, to the said Alexander Hay of Easter Kennet and Marion Farquhar, his spouse, the longest liver of the two, for all the days of their lifetimes, and to the said Master John and his male heirs whatsoever, of all and whole the lands of Tillymaud and Bullers of Buchan, with the craigs and fishings of the same and whole pertinents thereof, lying in the lordship of Slains and sheriffdom of Aberdeen, of the date at Stirling, 4 November the year of God 1585, with the charter of confirmation thereof of the date at Edinburgh, 27 August the year of God 1592; together with another charter made by his highness, with advice of his majesty's treasurer and comptroller, to the said Master John Hay and Marion Drummond, his spouse, and longest liver of the two, in conjunct fee and their male heirs and of tailzie therein specified, of all and whole the lands of Easter Kennet, with tenants, tenancy, service of free tenants, with the whole pertinents thereof lying adjacent together within the sheriffdom of Clackmannan; as also of all and sundry the acres, crofts, lands, annualrents and superiorities respectively underwritten, with the pertinents and others therein specified, as the same of the date at Holyroodhouse, 27 December 1593 bears, notwithstanding whatsoever our said sovereign lord's revocation, act or constitution made heretofore or in this present parliament under which the said charters and infeftments shall never be comprehended, but the same to be good, valid and sufficient to the said Master John and others therein mentioned for possessing of the lands and others therein contained. Likewise his highness renounces all action and instance competent to his majesty for impugning and quarrelling of the same or any of them, with an agreement not to petition, and with supplement of all faults, as well as not named as named, which his highness and estates foresaid will have as for expressed in the said act and to be as sufficient as the same were inserted and incorporated in this present act.

Our sovereign lord and estates of parliament, acknowledging and remembering the earnest favour, goodwill and affection ever borne to his highness's service by his trusty councillor Master Peter Young of Seaton, his highness's master almoner, one of the lords of his highness's privy council, who not only at his highness's desire took several journeys from this realm as his highness's ambassador to the realm of Denmark, especially in the month of July the year of God 1586 and in the month of May the year of God 1587, in treating and concluding upon the heads of his majesty's most honourable marriage with his highness's dearest and well-beloved spouse, Anne, now queen of Scots, but also with little warning, at his highness's request, took voyage and accompanied his majesty to the realm of Norway to the solemnisation of the said marriage in the month of October the year of God 1589, and remaining with his highness until the month of December the year of God foresaid that he was directed with his majesty to return within this realm for his majesty's special affairs within the same. Likewise the said Master Peter in the month of April last is directed by his majesty with his highness's special commission as his highness's ambassador to his highness's dearest brother the king of Denmark and sundry princes of Germany for treating and concluding of sundry his highness's affairs, where the said Master Peter is presently to his great charges and expenses. And our sovereign lord, not willing that the said Master Peter shall be in any way hurt by any deed to be done in his highness's present parliament, but rather to make his spouse and bairns sure of all rights and title of whatsoever lands or pensions acquired by him of before, therefore our said sovereign lord, with advice of the said estates, has allowed and by this charter allows all things done by the said Master Peter as ambassador for his highness in his said journeys, his departure, attending and accompanying of his majesty and returning in manner foresaid as most acceptable, good and thankful service done to his majesty for the benefit of his whole realm; and likewise our said sovereign lord, with advice foresaid, in part of recompense of his said service and expenses made in the said voyages, of his certain knowledge, has ratified and approved and by this charter ratifies and approves and for his highness and his successors perpetually confirms the act made in his highness's parliament on 29 July the year of God 1587 ratifying and approving certain gifts of pensions, offices and fees therein mentioned granted to the said Master Peter Young, his spouse and bairns and assignees respectively therein contained, together with the infeftments, charters, precepts and instruments of sasine granted to the said Master Peter, his spouse and their heirs therein contained of the lands of Easter Seaton and shadow half of Dykmontlaw, with the parts, pendicles and pertinents thereof lying within the sheriffdom of Forfar and of all that has followed or may follow thereupon, together also with the gift of pension granted by his highness to the said Master Peter of the mails, ferms, profits and duties of the lands of Wester Seaton occupied by William Auchterlony and sunny half of Dykmontlaw occupied by Andrew Annan, all lying within the lordship of Arbroath and sheriffdom foresaid, together with his highness's promise made to the said Mr Peter for warrandice of the said gifts, infeftments and others foresaid and with all decreets given according thereto; which infeftments, act of parliament, gifts of pension, offices, promises, decreets and others foresaid and all that has followed thereupon in all heads, clauses and circumstances of the same, our said sovereign lord and his estates foresaid, of certain knowledge, ratifies, approves and confirms for his highness and his successors in time coming, and finds and declares that all and sundry the said infeftments, gifts of pension, offices and fees contained therein, act of parliament ratifying the same and others respectively foresaid made and given in manner foresaid are made for just and reasonable causes tending to the benefit of our sovereign lord, his realm and lieges, and therefore decrees and ordains the same to stand in full force, strength and effect in all times coming, and declares that the same, nor none of them, falls nor shall fall under whatsoever his highness's revocations made in this present parliament or at any time preceding the date hereof. And also our said sovereign lord and his estates foresaid decree, statute and ordain that the act made in favour of the ministry of 14 February the year of God 1587 [1588] shall in no way touch nor be hurtful to the said Master Peter nor his foresaids nor be prejudicial to their rights and titles of their pensions above-specified and duties therein contained, but the same to stand in the own strength, force and effect as largely as if the said rights had been made and granted by our sovereign lord after his perfect age of 25 years complete; and declare the same in no way to come under the said act, and ordain the said Master Peter and his foresaids to be answered and obeyed thereof according to their said gifts, notwithstanding the said act. And for his highness's said councillors, their better security of [the] premises, our said sovereign lord, with advice foresaid, has of new granted and conveyed to his said councillors the foresaid whole rights respectively above-mentioned and ordains the same to be renewed in the most ample form. And further declares, statutes and ordains that no act nor statute made in this present parliament shall hurt or be prejudicial to the said Master Peter, his spouse and bairns in any of their rights foresaid or any other right that they have to any lands, pensions or possessions, but they shall possess the same freely according to their rights notwithstanding any act made heretofore in their prejudice.

Our sovereign lord and three estates of this parliament, understanding that his highness after his perfect age of 25 years complete and last and general revocation in the month of January the year of God 1591 [1592], by his highness's charter under the great seal, has given, granted and conveyed to Sir James Douglas of Drumlanrig, knight, and his male heirs whatsoever bearing the surname of Douglas and arms of the house of Drumlanrig, all and sundry the lands, baronies and others underwritten, with castles, towers, fortalices, manor places, woods, mills, multures, fishings, tenants, tenancies and service of free tenants, advocation, donation and right of patronages of kirks and chaplainries, outsets, parts, pendicles, annexes, connexes, dependancies and pertinents thereof and others after-specified, namely: all and whole the lands and barony of Drumlanrig, with castles, towers, fortalices, manor places, corn mills and waulk mills and sucken of the same, woods, parks, fishings on the water of Nith and their pertinents, lying within the sheriffdom of Dumfries; all and whole the lands and barony of Tibbers, with the castle and castle moat thereof, with the corn mills and waulk mills of the same, tenants, tenancies and service of free tenants of the same and all their pertinents; all and whole the ten pound land of old extent of Almerness, with the manor place, houses, buildings, fishings, fish enclosures and pertinents; all and whole the five merk land of old extent of Craigmuie, with manor place, houses, buildings, parts, pendicles and pertinents lying within the stewartry of Kirkcudbright, together with the advocation, donation of the parish kirks and parishes of Kirkbride and Durisdeer, all united, annexed, created and incorporated of before in a whole and free barony of Drumlanrig; and also all and whole the five merk land of Airds, with the pertinents, lying within the barony of Crossmichael and stewartry of Kirkcudbright, together with the advocation and donation of the parish kirk and parish of Glencairn, both parsonage and vicarage, lying within the said sheriffdom of Dumfries; and has united the said five merk land of Airds with the advocation and donation of the said parish kirk of Glencairn in and to the said barony of Drumlanrig; and also has conveyed to the said Sir James and his male heirs foresaid the advocation and donation of the parish kirks of Penpont, Morton and Dalgarnock lying within the said sheriffdom of Dumfries, and has united the same with the said barony of Drumlanrig, to remain with the said Sir James and his heirs foresaid; and has erected the said whole lands and baronies and others respectively foresaid in a free regality with free chapel and chancellery within the bounds thereof, with all privileges, liberties and jurisdictions of the said regality likewise and as freely in all respects as any regality has within this realm, as the said charter of union and erection of the date foresaid at more length purports; therefore our said sovereign lord, with advice of the said estates of parliament, has ratified, approved and confirmed and by the tenor hereof, for his highness and his successors, ratifies, approves and perpetually confirms the said charter, donation, union and erection therein contained with all and sundry points, passages, clauses, articles and conditions specified therein, and with all other infeftments, rights and titles whatsoever made and granted to the said Sir James and his foresaids of the forenamed baronies and others before rehearsed; and decrees and declares the same to be a perpetual right to the said Sir James and his male heirs foresaid of the whole lands, baronies and others particularly above contained, and to be as sufficient as if the said charter were at length inserted herein. Providing always that the said Sir James shall resign and renounce the advocation and donation of the said parish kirk of Dalgarnock to Thomas Kirkpatrick of Closeburn, his heirs and assignees, otherwise this present ratification and the said charter shall not be extended to the said advocation and donation of the said kirk but the same shall be null in that point only.

Ratification to [Sir James Scrimgeour of Dudhope], constable of Dundee

Our sovereign lord and estates of this present parliament, for the good, true and thankful service done to his highness at diverse times of before by his highness's well-beloved Sir James Scrimgeour of Dudhope, knight, have ratified, approved and confirmed and by the tenor of this present act ratify, approve and confirm the infeftment, donation and disposition therein contained made and granted by our said sovereign lord after his highness's perfect age of 21 years complete and revocation general to the said Sir James Scrimgeour and to his male heirs lawfully procreated or to be procreated of his body, which failing, to James Scrimgeour, lawful son to Robert Scrimgeour, who was uncle of the said Sir James, and the male heirs to be lawfully procreated of his body, which also failing, to certain other persons and their male heirs and of tailzie nominated in the said infeftment, of all and sundry lands, baronies, mills, multures and others therein contained, united and annexed by virtue of the said infeftment in a whole and free barony to be called in all times coming the barony of Dundee, and granting the tower and fortalice of Dudhope to be the principal messuage of the said barony, and that the sasine taken by the said Sir James and to be taken by his heirs in time coming shall be sufficient at the said messuage of Dudhope, notwithstanding that the said lands, baronies and others therein contained lies not adjacent and together but in diverse places and sheriffdoms, which infeftment contains also a new disposition granted by his highness to the said Sir James and his male heirs and of tailzie foresaid of all and sundry the lands, baronies, mills, multures, woods, fishings and others particularly therein expressed, with advocation, donation and right of patronage of the parsonage of the kirk and parish of Dundee, with all right and title, interest, action and claim of right, both petitor and possessor, that his highness, his predecessors and successors had, has or may pretend thereto by whatsoever manner of way and with supplement of all default etc., as the said infeftment of the date at Holyroodhouse, 15 November the year of God 1580, passed under his highness's great seal, at more length purports. And further his highness and estates will, grant, statute and ordain that this present confirmation shall be as good, valid and effectual to the said Sir James, his male heirs and assignees as if his said infeftment were at length inserted in this present act and registered in the books of parliament; and also statute and ordain that the said infeftment and this present act shall be good, valid and sufficient rights to the said Sir James and his foresaids for holding and enjoying heritably in time coming as well as of all and sundry the lands, baronies, mills, multures, woods, fishings and others expressed and contained in the said infeftment as of all and sundry bonds, fees, customs, assizes, rents, profits, privileges, immunities and duties whatsoever granted by his highness or any of his most noble progenitors to the said Sir James or any of his predecessors, either as constable of Dundee for using of the office thereof, or for the bearing of his highness's banner in time of war, or for whatsoever other cause or occasion bypast to be intromitted with, uplifted, received and conveyed by him and his foresaids in time coming likewise and as freely in all respects as he or any of his predecessors did of before.

Ratification to David Scrimgeour of Fordie

Our sovereign lord, with advice and consent of the estates of this present parliament, has ratified, approved and confirmed and by the tenor hereof ratifies, approves and confirms the infeftment of feu ferm, location and disposition therein contained, made and granted by his highness after his perfect age of 25 years complete and revocation general, with advice and consent of his highness's ordinary officers of state, to his highness's beloved David Scrimgeour of Fordie and to his male heirs bearing the surname and arms of Scrimgeour and assignees whatsoever heritably of all and whole the town and lands of Fordie, with mill, multures, parts and pendicles thereof and all their pertinents lying within the parish of Caputh, lordship of Dunkeld and sheriffdom of Perth, together with the advocation, donation and gift of patronage of the chaplainry and alterage of St Roch lying beside the Cowgate port of the burgh of Dundee and sheriffdom of Forfar, with all lands, tenements and annualrents pertaining to the said chaplainry wherever the same lies within this realm, united and annexed in a whole and free tenancy to be called the tenancy of Fordie, and containing a new disposition with supplement of all default to be held of our said sovereign lord and his highness's successors in feu ferm and heritage for payment of certain feu mail specified and contained in his highness's feu charter and infeftment made to the said David and his foresaids thereupon, as the same passed under his highness's great seal of the date at Edinburgh, 15 August the year of God 1592 at more length purports. Which feu charter and infeftment, location and disposition therein contained and sasine following thereupon our said sovereign lord and the estates of parliament ratify, approve and confirm in all the heads, articles and clauses thereof, and consents and declares that this present ratification shall be as good and sufficient to that effect as if the said whole infeftment were at length registered and contained hereto, notwithstanding the non-inserting thereof; concerning which, his highness, for himself and his successors, dispenses in that part by this charter for ever.

Our sovereign lord, with advice and consent of the estates of this present parliament, ratifies, approves and perpetually confirms the infeftment and disposition made by his highness after his majesty's perfect age of 21 years and general revocation made in parliament to John Hay of Lochloy, his male heirs and of tailzie and assignees whatsoever of town and lands of Lochloy, with the mills of the same, of the lands of Perk, with the outsets and pendicles thereof called Knockowdie, Newtoun and Hunterbrig, the lands of Inshoch, with the mansion, tower and fortalice, orchards, yards, houses and buildings, with the outsets and pendicles of the same called the Head Paddock Furd, Milnehill, Mortoun, Kilnhill and Lonehead, the lands of Knoknagilyie, Urchnie and Lurmoir, with the fishings of the said lands of Lochloy and Inshoch, as well as of salmon as of other fish in fresh waters and salt, with the forest of Lochloy, together with all other woods, parks, parts and pendicles, of all and sundry the foresaid lands and pertinents of the same customary; all and sundry the town and lands of Kinnudie, with the croft of the same called the Ailhouse croft, with the parts and pendicles lying within the sheriffdom of Nairn; and also all and whole the lands of Grony and Fingask, with the crofts of the same and parts and pendicles thereof lying in the barony of Aird, lordship of Lovat and sheriffdom of Inverness conveyed in warrandice of the said lands of Kinnudie and Ailhouse croft, with the parts and pendicles, as in the said infeftment under his highness's great seal of the date 20 February 1588 [1589] at more length is contained; and decrees and declares the same infeftment, precept and instrument of sasine following thereupon to have full effect and strength in all time coming, and the same to be a perpetual right to the said John and his heirs foresaid to possess the said lands according to the tenor thereof.

Ratification to John Arnott

Our sovereign lord, having consideration of the good, true and thankful service done to his majesty by John Arnott, burgess of Edinburgh, has, with advice of the estates of this present parliament, decreed, declared and ordained that the said John and his heirs shall peaceably possess and enjoy the town and lands of Wester Crichton, the lands of Thornydykes and Nether Hailes, with the whole lands and lordship of Colbrandspath, with annexes, connexes, parts, pendicles and pertinents thereof, and all other lands whatsoever, as well as kirklands as others lying within the town and Mains of Colbrandspath, according to the said John's rights and titles made to him of the same, whereof he has now presently the possession, likewise he has had these diverse years bygone by collection of the mails and duties thereof; and this notwithstanding of the restitution of any persons heretofore forfeited or yet by the forfeiture led or to be led and prosecuted presently or at any time hereafter against any of the superiors of the said lands, or by any other laws, constitutions, revocations, dissolutions or acts of parliament whatsoever whereby the said John or his ancestors' rights may be quarrelled or called in question, which our sovereign lord, with advice of his said three estates, holds here as expressed, and that this generality thereof shall be as sufficient as if every act, constitution, dissolution, forfeiture, restitution or revocation were herein expressed, and a special reservation and exception of the said John's right of the lands above-specified reserved and excepted thereto, discharging his majesty's treasurer, comptroller and advocate or any other having power or right of his majesty to quarrel, trouble or molest the said John or his heirs in the peaceable possessing and enjoying of the lands above-written and every part thereof for any cause bygone, whereof his highness, with advice foresaid, has declared and declares this present act to be a supplement of all faults as well as if provisions and remedies necessary were specially mentioned and expressed herein.

Our sovereign lord, having consideration of the good, true and thankful service done to his highness by his highness's servant Captain Patrick Cranston, with advice and consent of the estates of this present parliament, ratifies and approves his highness's gifts and dispositions given and granted to the said Captain Patrick of these monks' portions out of the abbacy of Scone, which pertained of before to the late dean Robert Carver, dean John Blaw, dean John Purdaly and dean William Donaldson, and likewise their portions out of the abbacy of Crossraguel which sometime were held and possessed by the late dean John Muir, elder, and dean Michael Dewar, together with all privileges contained in the same; and wills that his said highness's gifts stand in full force and effect to the said Captain Patrick during all the days of his lifetime.

Ratification to Master Henry Keir [of Greenland]

Our sovereign lord, having consideration of the faithful service done by Master Henry Keir of Greenland, his domestic servant, not only to himself but also to the queen, his majesty's late dearest mother, having continued long in her service as one of her secretaries with small commodity, as yet, albeit he had his majesty's promise of recompense, and specially when the said Master Henry at his majesty's desire renounced and gave over the lands of Helderhaill, being 10 or 12 chalders of victual by year in heritage upon assured promise of a just recompense; for acknowledging of a part thereof, his majesty, with advice of the estates of this parliament, has ratified, approved and confirmed a yearly pension of 2 chalders of victual, half malt and half meal, conveyed to the said Master Henry and to George Keir, younger, his son, during their lifetimes by Master William Erskine, now archbishop of Glasgow, with consent of his majesty, and of his trusty cousin Ludovic [Stewart], duke of Lennox, to be uplifted out of the readiest of the fruits, profits and emoluments of the said bishopric, as at more length is contained in the said gift, in all points, articles and clauses of the same; and wills and declares that the said gift and disposition shall stand for a perpetual security to the said Master Henry and his son during their lifetime and the longest liver of the two, and that without any impediment of any taxation, composition or contributions to be paid by them for the same, or yet subject to any reduction in case the pensions of the said archbishopric be in any way quarrelled for dilapidation of the fruits of the same or disposition of more than the third thereof in pension; and notwithstanding of the act of annexation, ordaining no part of the temporal lands to be conveyed except in augmentation of the rental, and of all other acts of annexation and ratification made or to be made contrary thereto, with the which whole his majesty dispenses relating thereto; and declares that the said gift and pension shall be in no way subject thereto no more than that the said gift of pension had been specially contained and reserved therein, renouncing all action and instance that his majesty has or may have for questioning and quarrelling of any part of the said pension or validity thereof; and discharges his majesty's treasurer, collector, comptroller and advocate of all pursuing, molesting or troubling of the said Master Henry and his son in the peaceable possession of the same pension during their lifetimes.

Our sovereign lord, estates and whole body of this present parliament ratify and approve and for them and their successors perpetually confirm all charters, locations and dispositions therein contained made and granted by the late Patrick [Adamson], archbishop of St Andrews to George Haliburton of Ballridie, Margaret Drumbreck, his spouse, the longest liver of the two in conjunct fee, their heirs, assignees and successors whatsoever of whatsoever parts or portions of the town and lands of Kincaple, feu ferms thereof or of any part of the same town and lands, superiority, office of bailiary and jurisdiction of the said lands lying within the regality of St Andrews and sheriffdom of Fife, with the precepts and instruments of sasine following thereupon, together with the charter of confirmation containing therein a new gift of the forenamed lands, feu ferms and others before-specified made, given and granted by our said sovereign lord to the said George Haliburton, Margaret Drumbreck, his spouse, and their foresaids in the year of God 1593, passed under his highness's great seal, ratifying and confirming the foresaid charters granted by the said late Patrick, archbishop of St Andrews with the precept and instrument of sasine following thereupon in the whole points, heads, articles, clauses, conditions and provisions, circumstances, liberties and privileges whatsoever mentioned in the forenamed charters, precepts, instruments of sasine, charter of confirmation above-written or any one of them; and wills and declares that this general ratification and approbation thereof is and shall be in all times coming of as great force, strength and effect to the said George, Margaret, his spouse, and their foresaids as if the forenamed whole infeftments, charters, precepts, instruments of sasine, confirmation before rehearsed, precept and instrument of sasine following thereupon had been at length word by word engrossed and inserted herein.

Our sovereign lord and estates of this present parliament ratify and approve and for his majesty and his successors perpetually confirm the gift and disposition made by his highness to Alexander Hay, then director of the chancellery and now clerk register, of the annualrents, ferms, feu duties and others which sometime pertained in common to the chaplains and vicars of the cathedral kirk of Aberdeen, to be collected out of certain lands, buildings, waters and possessions within and about the burgh of Aberdeen, as in the said charter containing the whole annualrents, sums and duties in particular of the date 10 February 1574 [1575] at more length is contained; and decree and declare the same heritable gift and disposition of the same annualrents to be a perpetual right to the said Alexander, his heirs and assignees for possession of the same, and ordain the said gift and disposition to stand in the own full strength, force and effect in all time coming.

Ratification to [William Stewart], commendator of Pittenweem

Our sovereign lord and estates of this present parliament, remembering the good, true and thankful service done to his highness by William, commendator of Pittenweem, as well as within the realm as in diverse other nations without the same, not only tending to his majesty's own particular but also to the public estate and welfare of the realm, wherein the said commendator has sustained great charges and expenses; in recompense of a part whereof, our said sovereign lord, with advice of the lords of his highness's secret council, and also with consent of Sir Thomas Lyon of Auldbar, knight, his majesty's treasurer, Sir Robert Melville of Murdocairnie, knight, treasurer depute, and Master Robert Douglas, provost of Lincluden, collector general and treasurer of the new augmentations, for their interest, made and constituted the said commendator, his deputes and substitutes his highness's lawful undoubted and irrevocable actors, chamberlains and bailies of the whole temporal lands, lordships, baronies and others whatsoever which pertained to the archbishopric of St Andrews, wherever the same lie within this realm, giving and granting to him and his foresaids full power to ask, crave, uplift and receive all and sundry mails, ferms, teinds, fruits, rents, annualrents, kanes, customs, accidents and casualties whatsoever pertaining to the same of all years and terms resting unpaid the time of the granting of the said letter of chamberlainry, which was upon 1 May the year of God 1589, and likewise yearly and termly thereafter during the space of 15 years, as the said letter of gift granted to the said commendator under the privy seal of the date foresaid in itself at more length purports. And to the effect that the said letter and gift may be more valid and effectual to the said commendator and his foresaids, therefore, and for diverse other good causes and considerations, our said sovereign lord, with advice of his said estates, by the tenor hereof, ratifies, approves and confirms the said letter and gift in all and sundry heads, points, articles, clauses and conditions contained therein, declaring the said gift and all other letters of factory and acts of secret council and rights granted to the said commendator thereupon to have been and to be sufficient and undoubted right and title to the said commendator and his foresaids for possessing and enjoying of all and whole the mails, ferms, duties, kanes, customs, casualties and others partly above-specified belonging to the said archbishopric, and for using the whole liberties, privileges and commodities mentioned in the foresaid gift during the space and years above-written therein contained, notwithstanding of the act of annexation of the temporality of all benefices within this realm to the crown, made in the parliament held at Edinburgh, 29 July the year of God 1587, or whatsoever others acts, laws or constitutions made in the contrary hereof.

Act regarding the bridge of Dalkeith

Our sovereign lord and estates in parliament, for beating, upholding and mending of the two bridges of Dalkeith, the one built upon South Esk on the south side of the said town, and the other built on North Esk upon the north side of the said town, which bridges are now almost decayed, statute and ordain that all carriages and burdens of mill-stones, wine, timber and other equipment passing from end to end of the said two bridges with carts shall pay to the bailies and council of the said town of Dalkeith, or their collector to be appointed by them, for repairing, mending and upholding of their said bridges the tax and impost following, that is to say: of each mill-stone passing from end to end on any one of the said two bridges, 40d, and for each cartful laden with wine, timber or other gear, 8d money of this realm. And this act to take beginning from 20 June 1594, and to last and continue for the space of three years next and immediately following the said 20 June.

Provision in favour of burghs erected since the act of annexation

Our sovereign lord and estates of this present parliament find and declare that albeit all erections made or erected since the act of annexation (except so many as are specially excepted in the said act) are decreed and declared in this present parliament to be null and of no value, yet the same shall be in no way prejudicial or hurtful to such burghs as are erected by his highness in free burghs since the said act and have been in use to pay custom to his highness and in making of their accounts in exchequer, but they shall stand erected with all privileges, immunities and liberties granted by his highness to them, providing always that their erections prejudice not any particular parties' rights regarding the right or superiority of their feu lands held by them of before of the kirk, and especially Alexander Gaw in Maw and such others as may be interested by the erection of the burgh of Culross in a free burgh, whose rights our sovereign lord and estates foresaid declare to stand in their full authority notwithstanding the said erections, until the same be discussed by the judge ordinary according to the law.

Regarding hospitals and schools

Forasmuch as such corruption and manifold disorders are entered in colleges, schools, hospitals and maison dieus, their buildings ruined and rents and revenues are most altogether dilapidated, to the great decay of learning and harm of the poor, the reformation and oversight whereof and order taking therewith properly appertains to the chancellor of the realm, it is therefore statute and ordained by the king's majesty and estates of this parliament that John [Maitland], lord Thirlestane, chancellor of this realm, take order with all convenient speed with all the said colleges, universities, schools, hospitals and maison dieus, that the building thereof may be repaired, the rents and revenues recovered and appropriated to the right use according to their several foundations and they and every one of them reduced to some better perfection and, if it be possible, to their former state and integrity.
