Judicial proceeding: summons of treason

The which day Master David MacGill of Cranstoun-Riddel, advocate to our sovereign lord, produced a summons of treason duly executed and endorsed against George [Gordon], earl of Huntly, Sir Patrick Gordon of Auchindoun, knight, Thomas Gordon of Cluny and William Gordon of Gight and certain their accomplices for the crime of treason committed at Donibristle, as the summons depending thereupon at length bears; upon the production whereof, the said advocate asked instruments. And likewise produced William Porteous, messenger, executor of the first execution executed upon 3 April 1593 at the market cross of Edinburgh, and made faith that his execution was true, as the same bears; and John Purdie and Daniel Graham, present, made faith that they were required witnesses to the said execution, and that they heard and saw him execute the same. And also produced Daniel Graham, messenger, executor of the second and third executions executed upon 9 April last at the market cross of Aberdeen, and Normond Leslie's dwelling house there, and executor of the fourth execution upon 11 April 1593 at the said person's dwelling houses, and executor of the fifth execution upon 12 April 1593 at the market cross of Banff, and executor of the sixth execution executed upon 12 April the year foresaid at certain their dwelling places, and executor of the seventh execution executed upon 13 April 1593 at the market crosses of Elgin, Forres and Inverness, and executor of the eighth execution executed upon 15 April 1593 at certain of their dwelling houses, and executor of the penultimate and last executions executed upon 18 and 19 April the year foresaid at certain of their dwelling houses; and the said Daniel Graham made faith that he executed the said summons of treason upon the foresaid whole persons in manner contained in his said executions; and Donald Neill and Alexander Rhind, being both present, made faith that they were required witnesses by the said Daniel Graham to his said executions and that they heard and saw the said Daniel execute the same as they bear. Upon the verification of the which summons, and that the said officers and their witnesses compeared in presence of the said lords commissioners of parliament and verified their own executions that the same were truly executed as the same bears, the said Master David MacGill and Master John Skene [of Curriehill], his highness's advocates, asked instruments. The lords commissioners of parliament continues the foresaid summons in the same form, force and effect until 10 July next to come.
