Procedure: royal declaration; protest

The which day the king's majesty, in presence of his estates of parliament, declared that, so far as he remembers, he never gave, granted nor subscribed any remission to whatsoever person that was at the slaughter of the late Hugh [Montgomery], earl of Eglinton, except only to David Cunningham of Robertland. Upon the which declaration, Robert [Seton], lord Seton and Robert [Sempill], lord Sempill took instruments and immediately thereafter James [Cunningham], earl of Glencairn protested that the king's majesty's declaration above-written should not prejudice any of the said earl's friends who have already got remission for the said slaughter, but that they may be heard to defend themselves by law upon the remissions obtained by them for the said slaughter, or whensoever they should be summoned to underlie the law for that, notwithstanding the foresaid declaration.
