†Our sovereign lord and estates of this present parliament, having consideration of the daily, true and thankful service done to his highness by his right trusty cousin and councillor Alexander, lord of Spynie, and for the other causes contained in the gift of pension mentioned below, now read, seen and considered by his majesty and estates above-rehearsed, they have ratified and approved and, by the tenor hereof, ratify, approve and confirm a letter of pension given and granted by his majesty, with advice and consent of his officers of state therein nominated, under his highness's privy seal, to the said Alexander, lord Spynie, his heirs and assignees, of a yearly pension of £148 14s 6d and third part penny money, two chalders, 12 bolls, three firlots, two pecks of barley, and 8 chalders, 8 bolls, two pecks and two part pecks of meal, to be yearly lifted out of the readiest and best payment of the surplus of the third of the priory of Whithorn unassigned, where they shall please choose, for the space of nineteen years next after the date of the said letter of pension, and further, yearly thereafter, until the said Alexander, lord Spynie or his foresaids be completely paid of the sum of 3,000 merks money therein mentioned, as the same letter of gift made thereupon containing sundry other heads and privileges of the date at Edinburgh, 12 September 1588, at more length purports; together with the decreets, letters and all others following and that shall follow thereupon in all points, heads and articles of the same after the tenor thereof. And our sovereign lord, with the estates of parliament above-rehearsed, find, decree and declare that the foresaid gift of pension was, is and shall be good and sufficient right and title to the said Alexander, lord Spynie, his heirs and assignees whatsoever, to possess, enjoy, intromit with and take up, use and convey at their pleasure, the foresaid whole victual and silver therein contained during the space above-written as freely in all respects as our said sovereign lord and his collectors general might have done or may do themselves, if the said letter of gift had never been made nor granted, and that notwithstanding whatsoever acts of parliament or other acts, statutes, ordinances, constitutions and decisions of council, session and of exchequer, or any thereof made or to be made in the contrary, and namely notwithstanding of the act and ordinance made by our sovereign lord, with advice of the lords of his highness's secret council, session and exchequer, in the month of February 1587 [1588], regarding the thirds of benefices therein mentioned; and also notwithstanding of whatsoever decreets, sentences and interlocutors given and pronounced in prejudice of the said letter of pension or any part thereof; and also notwithstanding of whatsoever revocations special or general made or to be made by our sovereign lord, which might or may be interpreted in the contrary, likewise his majesty and estates foresaid decree and declare that the said letter of pension shall in no way be comprehended under any of the said revocations, but is and shall be excepted, likewise they declare the same, by this ratification, to be expressly excepted out of all the said revocations, acts and ordinances above-mentioned. And for the better security, our sovereign lord, with advice and consent of the forenamed estates of new, by the tenor hereof, gives, grants and conveys to the said Alexander, lord Spynie, his heirs and assignees, all and whole the yearly pension of money and victual above-specified, to be yearly lifted and taken up during the years and space above-written out of the first, readiest and best payment of the surplus of his highness's thirds of the said priory of Whithorn, where they please to choose yearly, resting unassigned to the ministers in their stipends possessed by them of before, discharging therefore, by the tenor of this act, our sovereign lord's collectors general, treasurers of augmentation and their deputes present and to come, and likewise his highness's advocate and all other officers and judges, of all troubling, charging, poinding or pursuing of the said Alexander, lord Spynie, his heirs or assignees, in taking up of the said yearly pension, or yet of whatsoever tenants, parishioners or others due in payment of the foresaid money and victual conveyed and assigned thereof during the years and spaces above-written, and of their offices in that part simply; and ordains letters of horning upon a simple charge of 10 days, poinding and all other execution needful, the one without prejudice of the other, to be directed by the lords of session or exchequer, for causing of the said Alexander, lord Spynie and his foresaids be answered end obeyed of the said yearly pension according to the said gift and this present act in due form as appropriate.
