[1592/4/104]*[print] [email] [cite] [preceding] [following]
†Our sovereign lord, now after his perfect age of 25 years complete, with advice of his estates in parliament, ratifies and approves the donations and mortifications made by [Mary], his highness's late dearest mother, in her perfect age and by his highness's self at diverse times, of the lands, benefices and rents endowed for sustentation of the ministry within the burgh of Edinburgh, and for maintaining of the hospitals thereof, and specially of all annuals, lands and tenements lying within the freedom of the said burgh, founded to whatsoever benefice, and of all lands and annuals lying outwith the liberty of the said burgh annexed to any benefice, prebendary or religious place situated within the freedom of the said burgh. And our said sovereign lord, for his pitiful zeal which he has to the sustentation of the hospitals and ministry within the said burgh, with advice of his said estates of parliament, now after his perfect age of 25 years complete, has of new annexed to the community of the said burgh and their successors, in favour of their ministry and hospital, all and whole the said lands, tenements, annualrents, profits and emoluments foresaid, feu ferms, mails and duties thereof; and substitutes them in the full right of all lands, annualrents and emoluments situated within the freedom of the said burgh, which pertained of before to whatsoever bishop, abbot, prior or whatsoever ecclesiastical person within this realm; and ordains a new infeftment to be completed thereupon for their security if it be thought expedient. And for the said godly effect, his highness dissolves the general annexation in that part in so far as the same may appear to be extended to any of the premises, or to the annexation made of before in favour of the said college and hospital of the kirk of Dunbar[ney], whereof the kirk of Potie and Moncreiffe are pendicles, lying within the sheriffdom of Perth, the parsonage of Currie, and the one half of the vicarage thereof pertaining to the archdean of Lothian, the lands, annualrents, houses, yards and buildings of the Trinity College, situated within the said burgh of Edinburgh, as well pertaining to the provost as to the prebendaries thereof and common lands and annualrents of the same; which annexation his highness, with advice of his said estates in parliament, ratifies and approves. As also his majesty, with advice of his said estates, of new annexes the other half of the vicarage of Currie, to the which no person is provided, and the whole vicarage of the said kirk of Dunbarney which also falls vacant by deprivation of [...], last possessor of the same, to remain with the provost, bailies, council and community of the said burgh and their successors in time coming for sustentation of their said ministry and hospital. And our said sovereign lord and estates foresaid decree and declare that none of these particulars written before, conveyed of before and newly annexed for sustentation of the said ministry and hospital, were, are, or shall be ever comprehended in the general annexation of the ecclesiastical lands and rents to the crown, but were, are and shall be excepted therefrom. Likewise his majesty and estates foresaid of new except the same, not only from the said annexation, but from all his highness's revocations made in time past or made in this present parliament; and declare also that the said provost, bailies, council and community and their successors in all time coming, have and shall have such full right of property and superiority of the foresaid lands, annualrents and revenues, tenants and tenancies, and service of free tenants thereof, as had the bishops, abbots, priors, friars, monks, nuns, chaplains and prebendaries to whom the said lands and annualrents pertained of before, notwithstanding any act or constitution preceding the date hereof.
