†Our sovereign lord, now after his perfect age of 25 years complete and general and last revocation, made with advice and consent of the estates of this present parliament, having by [John Maitland, lord Thirlestane], his majesty's chancellor, treasurer,† [David Seaton of Parbroath], comptroller, [Master Robert Douglas, provost of Lincluden], collector general, and others of his highness's trusty and well-beloved councillors, perused and considered the charter, infeftment and confirmation under his highness's great seal of the date at Edinburgh, 29 July 1587, made, given and granted by his majesty, with advice of his chancellor, treasurer, comptroller and collector general, to the poor members of Jesus Christ then and in all times thereafter coming, dwelling and resident within the burgh of Perth, of all and sundry lands, tenements, houses, buildings, kirks, kirkyards, chapels, colleges, yards, orchards, crofts, annualrents, feu mails, feu ferms, pensions, mills, mill lands and their sequels, fishings, fruits, rents, duties, profits, revenue, emoluments, ferms, kanes, services, alms, dail silver, obits and anniversaries and others whatsoever which in any way pertained, or are known to pertain, or might or may pertain to whatsoever chaplainries, altarages, vicarages, prebendaries and benefices founded in whatsoever kirk, chapel, college or place within the freedom, territory, suburbs or parish of the said burgh of Perth, by whatsoever patron or patrons, or which in any way pertained, or are known to pertain, or might or may pertain to whatsoever hospitals, maison dieus, alms houses, lepers or poor within the said burgh of Perth, freedom, territory, suburbs or parish thereof, in possession whereof the chaplains, prebendaries, vicars and other beneficed persons of the same or the said hospitals, maison dieus, alms houses, leper folk or poor respectively were or might have been of before, wherever the said lands, tenements, houses, buildings, kirks, kirkyards, chapels, colleges, yards, orchards, crofts, annualrents, feu mails, feu ferms, pensions, mills, mill lands and their sequels, duties, profits, revenue, emoluments, ferms, kanes, services, alms, dail silver, obits, anniversaries and others whatsoever lie or were lifted of before respectively, with places, manor places, mansions, kirks, kirkyards, yards, orchards, lands, acres, crofts, annualrents, pensions, fishings, mills, mill lands and their sequels, duties, profits, revenue, emoluments and others whatsoever which pertained of before, or might or may pertain to the black friars or predictors, or to the friars minor or Franciscan, or to the white friars of the said burgh of Perth, together with the yards, monastery or place of the charterhouse situated beside the same burgh, and with all and sundry other lands, houses, tenements, annualrents, pensions, fruits, rents and duties lying or uplifted within the said burgh of Perth, freedom, territory, suburbs or parish of the same, given, endowed, funded or used to be paid to whatsoever chaplainries, altars, altarages, monasteries, places, colleges, kirks, benefices, mortuaries or anniversaries wherever they are or lie within this realm; and also all and sundry annualrents, pensions and other duties used to be paid by the provost, bailies or inhabitants of the said burgh of Perth, or within the freedom, suburbs, territory or parish thereof, to whatsoever kirk, chapel, college, altar, monastery, prebendary, place or benefice without the said burgh, for whatsoever cause or occasion, and specially for celebration of prayers; and likewise well and ripely perused and considered the act of parliament held at Edinburgh, the said 29 July 1587, wherein the said charter, infeftment and confirmation are inserted, and whereby the same are duly ratified, approved and confirmed and decreed and ordained to have the strength of an act of parliament in time coming; and letters and executorials to pass thereupon after the form specified therein as the said charter, infeftment, confirmation and act of parliament in themselves respectively more fully purport; therefore our said sovereign lord and estates foresaid, yet as of before, have ratified and approved and, by the tenor thereof for his highness and his successors, ratify, approve and perpetually confirm the charter, infeftment and confirmation, donation, disposition, powers, privileges, reductions, declarations and all other things therein contained, with the sasine following thereupon, and the said act of parliament in all and sundry points, passages, articles, clauses and conditions, immunities, privileges, liberties and circumstances whatsoever therein contained, and wills, declares and ordains the same to be extended to and with the clauses of tenants, tenancies and service of free tenants, in the same way as if the same clauses were specially inserted therein, notwithstanding that the same clauses, by the negligence of writers, be omitted; and decree and declare for his majesty and his highness's successors that the same charter, infeftment and confirmation, donation, disposition, powers, privileges, reductions, declarators and all other things therein contained, with tenants, tenancies, service of free tenants and the said special clauses thereof to be inserted, reputed and esteemed to be inserted therein, is and shall be in all time coming, effectual, valid, good and sufficient to the said poor members of Jesus Christ present and to come within the said burgh of Perth for the peaceable possessing and enjoying of all things mentioned in the same charter, infeftment and confirmation, with tenants, tenancies and services of free tenants, perpetually and in all time coming, according to the tenor, substance and meaning thereof in all points; and for non-entries, receiving and admitting of tenants, notwithstanding his majesty's revocation made in this present parliament, or any other revocation made of before or to be made in any time hereafter, or any other of his highness's acts, laws, statutes and constitutions general or special made or to be made to the prejudice or derogation thereof, or of anything expressed in the same, under the which the said charter, infeftment nor confirmation, nor no part thereof, shall never be comprehended by no manner of way; and will, decree and ordain the said charter, infeftment and confirmation with the addition of the said clauses (of tenants, tenancies and service of free tenants) to have the strength of an act of parliament; and letters and executorials to pass thereupon in form specified therein.
