In the running parliament held at Edinburgh on 18 November 1583 by the lords commissioner underwritten, namely, Andrew [Home], commendator of Jedburgh, Mr John Lindsay, parson of Menmuir, Mr John Maitland of Thirlestane and Mr Thomas Bannatyne of Newtyle, and Mr David MacGill of Nisbet [and Cranstoun-Riddel], king's advocate.

The which day Mr David MacGill [of Nisbet and Cranstoun-Riddel], advocate to our sovereign lord, produced a summons of treason duly executed and endorsed, pursued at the instance of our sovereign lord and his highness's justice against Alexander Jardine of Applegarth, James and John Jardine, his brother, William Bell, Ninian Jardine, William Taillifer, his servants, William Jardine, alias Red Will, Thomas Jardine of Birnock, Thomas Jardine, his son, David Johnston of Millbank, David Moffat in Sibbiebelside and Matthew Moffat in Woodend, called Dameshaw, for certain crimes of treason and lese-majesty committed and done by them, and every one of them, whereby they were summoned to have compeared before our said sovereign lord, his highness's justice, 25 October 1583, in the hour of cause, with continuation of days, to have answered to the said summons of treason duly executed and endorsed against them, as at more length is contained in the said summons; and after that all the aforesaid persons, defenders above-written, were diverse and sundry times called at the tolbooth window and none of them compearing, the said advocate immediately thereafter produced Richard Binning, messenger, Nicol Newhall and Ninian Swan, messengers, for probation and verification of the execution of the said summons, who, compearing personally, made faith that they and every one of them made the executions and endorsements as the said summons and endorsements thereof purport and bear; and likewise compeared personally Master James Fiddes, writer, John Davidson, messenger, Alan Dennis, Adam Rae, Matthew Rae, Peter Galbraith, tailor, and John Laing, tailor, witnesses contained in the said endorsements respectively, and made faith that they were present, heard and saw the executions and endorsements above-written in manner and form as the same bears; and thereafter the said whole persons being of new called at the said tolbooth window and none of them compearing, the said advocate protested that he may be heard to use further probation against the said persons at such times and place as pleases the king's grace, his estates and commissioners of parliament, in order to proceed and do justice in this present current parliament, and thereupon asked instruments.

The which day the said lords commissioners of parliament above-written, yet as of before, declare this present parliament to run, with all actions of summons of treason, summons of reduction and other causes whatsoever depending thereupon, with all others concerning the king's majesty's affairs and treatment thereof, concerning the welfare of his highness's realm and lieges, until the same be dissolved specially by his highness's estates of this realm or commissioners aforesaid. Upon the which proceedings the said Master David MacGill [of Nisbet and Cranstoun-Riddel], advocate to his highness, asked instruments.
