Act in favoures of Schir Richert Cokburne, lord previe seill

Oure soverane lord and estaittis of parliament ratiefies and apprevis the chartour and infeftment grantit be his majestie, with avise of his hienes collectour generall and thesaurer of new augmentatiounes for the tyme, to his majesties trustie and weilbelovit counsellour Schir Richert Cokburne of Clerkingtoun, knicht, keiper of his hienes previe seale, and his airis maill specifit thairin, of all and haill the landis off Clerkingtoun, with the maner places, housis, biggingis, yairdis, orcheartis, coirnemilnes and walk milnes thairoff and all thair pertinentis lyand within the parochin and constabularie of Hadingtoune and schirefdome of Edinburgh, to be haldin off his majestie and his successouris in frie blenche for payment of ane pennie upoun the ground of the saidis landis at the feist of Witsonday yeirlie in name of blenche ferme, gif the samene beis askit allanerlie, nochtwithstanding that the saidis landis wer haldin in fewferme of before, daittit at Roystoun, the nyntene day off Januare, the yeir of God jM vjC and ten yeiris, with the precept and instrument of seasing following thairupoune, togidder with the act of his majesties parliament haldin at Edinburgh, the tuentie third day of October, the yeir of God jM vjC and tuelff yeiris, quhairby his hienes and estaittis ratifiet and approvit the said chartour and infeftment, precept and instrument of seasing following thairupoun, and decernit the said act to be ane sufficient dissolutione for securitie to the said Schir Richert and his foirsaidis of the landis and utheris abovewrittin, to be haldin blensche of his majestie in all tyme cuming in all and sindrie heiddis, articles, clauses and circumstances thairoff; and willis and declairis that this present generall ratificatioune is and salbe als sufficient as giff the saidis chartour, infeftment, precept and instrument of seasing and act wer at lenth worde be worde insert heirintill. And farder, oure said soverane lord and estaittis foisaidis, for the causes specifit in the said act, hes off new dissolvit and, be thir presentis, dissolvis the saidis landis off Clerkingtoune, with the maner places, housis, biggingis, yairdis, orcheartis, cornemilnes and walkmylnes thairoff and all thair partinentis, and als hes dissolvit and, be thir presentis, dissolvis the landis of Spittelrig with the pertinentis fra his majesties croune and fra all actis of annexatioun quhairby the samen ar and have bene annexit to his majesties croun at ony tyme heirtofoir; and specialie fra the act of parliament maid in the moneth of September, the yeir of God jM vC thriescore ellevin yeiris, anent the landis, roumes or possessiounes haldin of freiris or nunnes and fra the generall annexatioun of kirklandis maid in the monethe of Julii, the yeir of God jM vC fourscore sevin yeiris, to the effect the samene may be disponit be his majestie to the said Schir Richerd, his aires maill and assignais, to be haldin of his hienes and his successoures in frie blensche for payment of ane pennye upoun the ground of the saidis landis at the feist off Witsonday yeirlie in name of blensche ferme, gif the samen beis askit allanerlie, nochtwithstanding that the samene landis wer haldin in fewferme of before; and ordanis chartouris and infeftmentis to be past heirupoune to the said Schir Richard and his foirsaidis in sick dew and competent forme as effeiris.

Ratificatione to Schir Robert Melvill of his infeftment off Lethame and Monymaill etc.

Oure soverane lord and estaittis of this present parliament, haveing sene and considderit the infeftment maid and gevin be his majestie under his hienes gryit seale off the date the fourtene day off August, the yeir of God jM vjC and threttene yeiris to his hienes trustie and familiare counsellour Schir Robert Melvill of Brunteland, knight, and Dame Jeane Hammiltoune, ladye Ross, his spous, and thair aires mentionat thairin off the toun and landis of Lethame and mylne off Monymaill, with the propertie, superioritie and few fermes off the said toun, landis and mylne, with thair pertinentis, lyand within the schirefdome of Fyiff, and of the landis of Monkismyre, and als of the landis and mure callit Edinismure, with thair pertinentis, and lyikwayes of the maner place of Monymaill, housis, biggingis, yairdis and grenes of the same; as als of the teindschevis and utheris teyndis, fruittis and rentis of the kirk and parochin of Monymaill, personage and viccarage thairoff, and erecting and uneitting all and sindrie the foirsaidis landis, teyndis and utheris above expressit in ane frie temporall baronye callit the baronie of Monymaill; and being ryiplie advysit thairwith, his majestie and estaittis foirsaidis hes ratiefiet and approvin and, be the tennour heiroff, ratiefies and approvis the foirsaid infeftment, dispositioun and erectioun thairin contenit in the haill heiddis, articles, clauses, conditiounes and circumstances quhatsumevir specifit and mentionat in the same and haill contentis thairoff; and decernis and ordanis the generalitie heiroff to be als guid, valide, effectuall and sufficient in the selff as gif the said infeftment wer at lenthe worde be worde insert heirin, dispensand thairanent be thir presentis; and decernis, declairis and ordanis the said Schir Robert and his said spous and thair aires to have full rycht to the saidis landis and baronie, milnes, maner places, orcheartis, yairdis, mures, teyndis and utheris, thair priviledges and pertinentis, to be bruikit and josit be thame efter the forme and tennour of the said infeftment in all poyntis.

Ratificatioun to Schir George Haye off his infeftment of Kinfawnis

Oure soverane lord and estaittis of this present parliament ratifies and approvis the infeftment made and grantit be his majestie under his hienes gryit seale to his majesties trustie and weilbelovit counsellour Schir George Haye off Kinfawnes, knight, clerk of his hienes register and rollis and ane of his hienes secreit counsell, his airis and assigneyis quhatsumevir heretablie off all and haill the landis and baronie of Kinfawnes, comprehending the landis and utheris eftermentionat, viz: all and haill the landis and lordschip of Kinfawnes and Pitsindie, with the mansioun, maner place, housis, biggingis, yairdis and orcheartis thairoff; Over Kinfawnes and remanent pendicles of the samene; the landis of Guktoun, Tillehow, Ribnow, Haggishall, Murehall, Windie Edge, Over Manis of Pitsindie, Kingiswallis, Pyperis Aiker, with the mylne, mylnelandis, multouris and sequellis thairoff, with all and sindrie thair pairtis, pendicles, cottages, annexis, connexis, dependences and pertinentis of the samene quhatsumevir, with the fischeingis in the water of Taye, tennentis, tenandries and service of frie tennentis and all thair partinentis quhatsumevir lyand within the schirefdome of Pearthe as for the principall; and siclyik all and haill the landis of Carretstoun callit Furdetoun, with the toure, fortalice, maner place, yairdis, orcheartis and all thair pertinentis; the landis of Nethir Carretstoun, with the corne and walk milnes of the samen and thair pertinentis; the landis of Litill Watterstoun, Braklaw and Bollehillok, with tennentis, tenandries, service of frie tennentis, annexis, connexis, pairtis, pendicles and pertinentis of the samene lyand within the schirefdome of Forfare; and that in speciall clause of warrandice and securitie off all and haill the foirsaidis landis and lordschip of Kinfawnes and Pitsindie, with the mansione, maner place, housis, biggingis, yairdis and orcheardis thairoff; Over Kinfawnes and remanent pendicles of the samene; the foirsaidis landis of Guktoun, Tilliehow, Ribnow, Haggishall, Murehall, Windie Edge, Over Manis of Pitsindie, Kingiswallis, Pyperisaiker, with the milne, milnelandis, multouris and sequellis thairoff, with all and sindrie thair pairtis, pendicles, cottages, annexis, connexis, dependences and partinentis of the samene quhatsumevir, with the fischeingis in the said water of Tay, tennentis, tenandries and service of frie tennentis and all thair pertinentis quhatsumevir lyand as said is; and siclyik in speciall clause of warrandice and securitie off all and haill the landis of Craigtoun, with the brewhous, brewlandis and fischeingis of the samene callit Pilgartheuch, Cambuspule and Cruke, with all uther fischeingis in the said water of Taye betuix the wode dyike of Kynnoule and limittes or bounder of the landis of Lytlesegedene in all pairtis within the foirsaidis landis of Craigtoune, with all thair partinentis lyand in the lordchip of Scone and within the said schirrefdome of Pearthe; and siclyik all and haill the heretable office of keiping of the said water of Taye on baithe the syiddes of the water thairoff within the haill boundes of the samene, beginnand at that pairt thairoff callit Drumlaw Sandis to the heid of the said water, with all feyis, casualities, priviledgis and dewties pertening and belanging thairto speciallie mentionat in the said infeftment, all unite, create and incorporat in ane haill and frie baronye callit the baronie of Kinfawnes, to be haldin of his majestie and his successouris in frie heretage and frie barony for evir for payment of the yeirlie dewtie thairin specifit, off the date at Halierudhous, the tuentie day of Julii, the yeir of God jM vjC and tuentie yeiris, with the precept and instrument of seasing following thairupoune, in all and sindrie pointis, articles and clauses thairincontenit efter the formes and tennouris thairoff. Lyik as his majestie and estaittis foirsaidis decernes and declairis that this present ratieficatione and confirmatioun of the said infeftment, with the precept and instrument of seasing following thairupoune, salbe als valide, effectuall and sufficient in all respectis as gif the samene infeftment, precept and instrument of seasing following thairupone wer at lenthe insert in this present act of parliament.

Oure soverane lord and estaittis of this present parliament, respecting and considering the gude, trew and thankfull service done to his majestie be his trustie and weilbelovit counsellour Schir Andro Hammiltoun of Reidhous, knycht, ane of the senatoures of the colledge of justice, in the publict effairis in this realme in tyme bygane, and his majestie and estaittis foirsaidis willing to encourage him and to gif him occasioun to continew in the lyik thankfull service in tyme cuming, thairfore his majestie hes ratiefiet, approvin and confermit and, be the tennour of this present act, with avise and consent of his estaittis and haill bodie of this present parliament, ratiefies, approvis and perpetuallie confermes the chartour and infeftment maid and grantit be his majestie, with avise and consent of his majesties principall thesaurer and comptroller, thesaurer and comptroller depute and of the remanent lordis commissioneris within the said kingdome, under his majesties gryit seale thairoff, of the date at Newmercate in England, the tuentie day off Februar, the yeir of God jM vjC nyntene yeiris, to the said Schir Andro Hammiltoun, his aires maill and assignais quhatsumevir heretablie, off all and haill the landis of Eister Spittell, alias Eister Reidspittell, with the maner place thairoff callit Reidhous, houssis, biggingis, yairdis, orcheartis, toftis, croftis, medowes, outseittis, pairtis, pendicles and pertinentis thairoff quhatsumevir; all and haill that housband land of the landis of Ballincreif callit Wester Bissetleyis; all and haill the halff of the manis of Ballincreiff sumtyme pertening to Johnne Borthuik, portionar off Ballincreif, with the cornemilne biggit be umquhile Frances Borthuik, father to the said Johnne Borthuik, upoun the foirsaid halff of the manis of Ballincreiff, with the multouris and sequellis of the said mylne, with the mansioun, yeardis, doucattis and medowes of the samene, halfis landis and maynes lyand within the lordschip of Ballincreif, constabularie of Hadingtoun and schirefdome of Edinburgh; and als of all and haill the heretable office off bailyerie of all and sindrie the landis, milne and utheris abovewrittin, with the haill liberties, priviledges, casualities and commodities pertening to the said office sua far as concernis the landis, milne and utheris abovespecifit allanerlie, conteaning ane new gift and dispositioune of the foirnamit landis, milneand utheris abovementionat and heretable office of bailyerie thairoff foirsaid, erecting, creating, uniting and incorporating the samene in ane haill and free barronye to the said Schir Andro, his aires maill and assignais, callit the baronie off Reidspittell, with the precept of seasing under the testimonye of the greit seale and instrument of seasing gevin conforme to the said chartour, and als the lettres of procutorie of resignatioun made and grantit be Robert Trottar, prebender of the prebendarie of Reidspittell, foundit within the colledge kirk of Dunglas, with avise and consent of the provest and remanent prebendaris of the said colledge kirk, and siclyik with speciall avyse and consent of James, earle of Home, lord Dunglas, undouttit patrone of the samene colledge kirk, provestrie and prebendaris thairoff, and of Dame Marie, countes of Home, his mother and tutrix testamentar for hir entres, off all and sindrie the landis of Reidspittell, als Wester Reidspittell, with the maner place, housis, biggingis, yairdis, orcheartis, doucattis, milne, multeris, milnelandis, medowes, pairtis, pendicles and all thair pertinentis, and off all and haill the landis of Coittis, with pairtis, pendicles, annexis, connexis, and all thair pertinentis, quhilkis landis and fewferme dewties thairof wer of before proper pairtis and partinentis of the patrimonie of the said prebendarie of Reidspittell in the handis of the lordis of secreit counsell within the kingdome off Scotland, his majesties commissionaris haveing power and commissioun of his hienes to ressave all resignatiounes in his majesties name, togidder with all rycht, tytill, entres and clame of rycht quhatsumevir quhilkis the saidis prebendar and provest or patrone of the colledge kirk of foirsaid, or any of thame, thair aires or successouris, had, hes or any wayes may have clame or pretend in and to the landis and utheris abovewrittin, propertie or superioritie of the samen or onye pairt thairoff, or to the maillis, fermes, gressumes, rentis, proffittes and dewties of the samene in speciall favouris of the said Schir Andro Hammiltoune of Reidhous, knight, his aires maill and assignais. Lyik as his majestie, considdering the great chargis and expenses debursit be the saidis provest, bailyeis, counsell and communitie off the said burgh of Edinburgh in erectioun of ane hospitall upoun intertenement of thair ministerie and colledge foirsaid, gave, grantit and disponit to the saidis provest, bailyeis, counsell and communitie of the said burgh of Edinburgh and thair successouris all and haill the provestrie of the Trinitie Colledge, landis, housis, rentis, kirkis, teyndis, utheris fructis, rentis and emolimentis thairto annexit, mair at lenth contentit in the said chartour under his hienes gryit seale off the date the tuentie sext day of Maii 1587 yeiris. Lyik as his majestie, efter his perfyit age of tuentie ane yeiris compleit, be his lettres patentis under his gryit seale, ratiefiet, apprevit and confermit the foirdaidis chartouris off the contentis, daittis respective foirsaid, as at mair lenth is contenit in the chartour of confirmatioun off the samene under his hienes gryit seall off the date the 29 of Julii 1587. Lyik as his majestie, be his new chartour under his hienes gryit seale, off new gave, grantit and disponit to the saidis provest, bailyeis, counsell and communitie off the said burghe of Edinburgh and thair successouris, for intertenement of the said colledge, ministrie and hospitall, all and haill the foirsaid provestrie of the Trinitie Colledge, with utheris certane benefices, kirklandis, teyndis, annuelrentis, tenementis and utheris mair at lenth sett doun in the said chartour and infeftment to be haldin in maner thairin conteaned, quhilk is of the date at Bearvoir Castell, the sevint day off August 1612. Lyik as his majestie, considdering that sindrie and dyerse godlie and wieldisposed persounes hes doted and mortiefied dyerse and sindrie gryit soumes of money to the use of the said colledge and for sutentatioun of professouris of humanitie, theologie and certane bursaris within the same, and his majestie, out off his gratious lufe, affectioun and royall care quhilk he beiris to the grouthe and incres of leirning within this realme, and speciallie within the said burgh of Edinburgh, being his majesties principall toun and burgh within this his kingdome, being maist willing that the formar giftis and particularis grantit thairto be confermit and all farder immunities grantit thairto in als ample forme as any uthair colledge hes or bruikes within this realme, thairfore his majestie, with advyse of the estaittis of the present parliament, ratifies and approvis the foursaidis infeftmentis grantit be his majestie under his hienes gryit seale, togidder with the erectioune of the said gryit ludgeing, manse and hous of the Kirk of Field in ane colledge for professioun of thelolgie, philosophie and humanitie, togidder with the foirsaids mortificatiounes maid be his majestie ather to the use of the colledge or to the use of the ministrie and hospitall of the said burgh, in all and sindrie poyntis, passis, heiddis, articles, conditiounes, pruivledgis, immunities, liberties and utheris circumstances quhatsumevir thairin contenit, efter the forme and tennour thairoff. Lyik as his majestie and estaittis foirsaidis statutes and ordanis that this present ratificatioun is and salbe als valide, effectuall and sufficient in all respectis as giff the forsaidis infeftmentis of the dates respective abovewrittin wer at lenthe and worde be worde ingrossit in this present act. And siclyik his majestie and estaittis foirsaidis willes, grantis, statutes and ordanis that the foirsaidis chartouris and this present ratificatioun of the samene ar and salbe guide, valide, lauchfull and effectuall rightis and securities to the saidis provest, bailyeis, counsell and communitie of the said burgh of Edinburgh and thair successouris for bruiking and joising of the landis, benefices, teindis and for erectioun of the said colledge and all uther priviledgis, liberties and commodities contenit in the saidis chartouris in all tyme cuming efter the forme and tennour thairoff; ordaning the clerk of register and his deputtis to extend ane act off parliament heirupoun and to insert and ingrose thairintill the chartouris abovespecifit in mair ample forme. Lyik as his majestie, off his princelie and royall favour and for gude service done to him be the saidis provest, bailyeis, counsell and communitie of the said burgh of Edinburgh, and for thair further encouragement on repairing and reedifeing off the said colledge and placeing thairin sufficient professoures for teiching of all liberall sciences, ordaning the said colledge in all tyme to cum to be callit King James Colledge, and als with advyse of the saidis estaittis, hes of new agane gevin, grantit and disponit to thame and thair successouris in favoures of the said burgh off Edingurgh, patrones of the said colledge and off the said colledge and of the rectouris, regentis, bursaris and studentis within the samene, all liberties, fredomes, immunities and priviledgis appertening to ane free colledge, and that in als ample forme and lairge maner as any colldge hes or bruikis within this his majesties realme; and, gif neid beis, ordanis ane new chartour to be exped under his hienes gryit seall for erecting of the said colledge with all liberties, priviledgis and immunities quhilk anye colledge within this realme bruikis, joises or to the samene is knawin to appertene. And for thair farder securitie, his majestie and estaittis hes dissolvit and dissolvis the foirsaids haill giftis and utheris particularlie abovespecifit fra his majesties croun and fra all actis of parliament maid thairanent in sa far as the samene or any pairt thairoff is or may appeir to have bene annexit thairto in tyme bigane to the effect particularlie abovespecifit, and annullis all and quhatsumevir actis and statutes quhilk may be prejudiciall or dirogatorie to the premisse, and, giff neid beis, ordanis new giftis to be exped thairupoun.

Oure soverane lord and estaittis of parliament, considdering that thair is sum pairtis off the burgh of Edinburgh within the poirtes of the samene quhairoff the inhabitantis and induellaris have in tyme bygane bene repute and haldin parochoneris off the paroches of Sanctcuthbertis Churche and Halierudhous, albeit they duelt within the poirtes and jurisdictioun of the said burgh of Edinburgh, and that be the samene divisoun of the inhabitantis of the said burghe frome the ordinarie paroche churches thairoff thair hes occasioun bene gevin in tyme bygane to many insolencies, the inhabitantis of these pairtis thairoff whiche wer of before of the paroche of Sanctcuthbert and Halierudhous not yeilding thair dew obedience to the ordinarie pastoures of the said burgh, bot resorting in tyme of divyne service and at all uther occasiounes to thair saidis severall paroches outwith the jurisdictioun and poirtes of the said burgh, quhilk hes bred gryit disturbance to the policie and discipline of the churche establischit thair and quhairby thair ensewis also hevie domage and hurt to the burgh off Edinburgh, being the cheiff burgh off the kingdome. For remeid heiroff, oure said soverane lord, with advyse and consent off the estaittis of this present parliament, statutes and ordanis that the inhabitantis within the poirtis off the said burgh of Edinburgh sall in all tyme cuming be subject under the governament of the pastures and sessiounes of the churches of the same burgh and astrictit to the discipline thairoff as ordinarie parochoneris of the samene, and thairfore oure said soverane lord and estaittis off parliament hes dismemberit and disjoyned these pairtis of the foirsaid burgh lyand within the poirtis thairoff and quhilkis wer off before of the saidis parochis off Sanct Cuthbertis churches and Halierudhous fra the samen kirkis and parochines off Sanct Cuthbert and Halierudhous, and unitis, annexis and incorporattis the samene to the paroche kirkis of the foirsaid burgh of Edinburgh, to remayne thairwith as ane pairt of the parochines thairoff. And ordanis and appoyntis the inhabitantis of these pairtis off the said burgh now unite thairto to resorte and repair to the paroche kirkis of Edinburgh to be servit thairat proportionallie as they dwell and ly maist ewest and convenient to the saidis kirkis quhairunto they ar now incorporat as thair awin paroche kirkes; and findes, decernis and declairis that the saidis inhabitantis of these pairtes of the said burghe off Edinburghe, now unite to the parochines thairoff, salbe subject to the ordinarie pastures and discipline of the saidis paroche kirkes off the samene burgh as the rest of the inhabitantis of the samen in all tymes heirefter.
