Forsamekle as the present scairsitie of money can not convenientlie in schort tyme be redressit and all thingis tending to the inbringing of money and to the incres and aboundance thairoff within this kingdome can hardlie be foirsene and ordered without gude and mature advyse and deliberatioun, thairfore oure soverane lord and estaittis of this present parliament hes gevin and grantit full power and commissioun to the persounes following, viz: the Archebischope of Sanctandros, the Archebischope of Glasgow, the Bischope of Brechin, the Bischope of Ross, the Erle of Mortoun, the Erle of Roxburgh, the Lord Elphingstoun and Lord Carnegie, [...] Murray off Balvaird, George Afflect off Balmanno, Maister Jhonne Leslie of Newithoun and Schir Alexander Naper of Laurenstoun, David Aikinheid, provest, and Johnne Byires, dene of gild off Edinburgh, Andro Gray, provest of Pearthe, and Maister Alexander Wodderburne, toune clerk of Dundie, togidder with the four officers off estate following, viz: the lord chancelare, the lord thesaurer, the lord secretare and the lord clerk of register, or onye thrie off everie ane off the foirsaidis rankis of persounes, for trying and cognosceing the maist proffittible and usuall waye for the weill of this kingdoms to inbring money and mak the samene incres and abounde within this cuntrie. With power to thame to convene and meit at sick tymes as they sall think meitest and to call before thame and inquyre of any persoune best skilled in materis of money, alsueill traddismen as cunyearis, and all utheris quha can giff greatest licht and knawledge thairintill, and to do all uther thingis maist expedient for furtherance off that quhilk is committit heirby to thair charge. And quhatsoevir the saidis commissioneris, or thrie of everie ane of the saidis rankis togidder, appoyntis, statutes and ordanis in the premises, oure said soverane lord and estaittis off this present parliament declairis to be of als gryit force, strenthe and effect as gif the samen wer now presentlie concludit, actit and ordanit in this present parliament.

Commissioun anent the taxt roll within the schirefdome off Kincardin

Oure soverane lord and estaittis of parliament, considdering the supplicatioun presentit be Williame, lord Keith, schirreff principall off the schirrefdome of Kincairdin, beiring him to have bene chairgit be the collectouris of sindrie bypast taxatiounes to mak payment for ane fyvetene pund land mair nor the retoures off the haill landis of the said schirefdome of Kincardin will extend to, craveing thairfore that commissioun micht be gevin for setting doun ane trew and perfyit taxt roll of the just extent of all landis lyand within the said schirefdome, conforme quhairunto his majesties taxatiounes may be payit in all tyme heirefter; and, thairfore, oure soverane lord, with consent of the saidis estaittis, hes gevin and grantit and, be the tennour heiroff, gevis and grantis full power and commissioun to David, lord Carnegye, Schir George Hay of Kinfawnes, knycht, clerk of his hienes register, Schir George Erskin of Inverteill, knycht, Maister Johnne Weymes of Craigtoun, Maister Alexander Gibsoun of Durie, all senatoures of the colledge of justice, and to [...] Arbuthnet, younger, of that Ilk, [...] Burnet of Leyis, [...] Douglas of Glenbervie, [...] Ramsaye of Balmane, or ony four of thame conjunctlie (tua of the saidis senatoures off the college of justice being alwayes tua of the said number), to convene togidder in ane court, quhilk the saidis lordis does by these presentis ordane to be haldin within the tolbuyth of Edinburgh upoun the first Tuysday of December nixtocum, and thair to call before thame the haill heritouris off landis lyand within the said schirefdome, tak inspectioun of thair auld retoures and infeftmentis and confer the samen with the auld taxt rollis off the said schirefdome, and to use sick uther meanis for making ane trew and perfyite stent off all landis lyand within the said schirefdome as to thame sall seime maist expedient, to the effect that the schirreffis of the said schirefdome of Kincairdin be not at any tyme heirefter chairgit be the collectoures of the taxationes or thair deputtis for payment making of ane grychter or less proportioune off stent nor the retoures of the haill barounes and friehalderis off the said schirefdome, being joynit togidder, will amount unto. For the better effectuating quhairoff, the saidis lordis ordanis lettres to be direct to messingeris off armes, schirrefis in that pairt, chargeing thame to pas to the mercate croce of Stanehayve (being the heid burgh of the said schirefdome of Kincairdin) and thair be oppin proclamatioune in his hienes name and authoritie mak publicatioun heiroff that nane pretend ignorance of the samene; and thairwithall to warne all and sindrie erlis, lordis, friehalderis, heretouris and fewaris of land lyand within the said schirefdome, quhais names salbe gevin in roll subscryvit be ony tua of the saidis commissioneris personallie, or at thair duelling places, to compeir before the saidis commissioneris in the said burgh off Edinburgh the said first Tuyisday of December, with continewatioune of dayes, bringand with thame and exhibitand before the saidis commissioneris all and sindrie thair saidis auld retoures and infeftmentis of thair saidis landis within the said schirefdome, to be sene and considderit be the saidis commissioneris to the effect foirsaid. With certificatioun to sick as compeiris not befoir the saidis commissioneris at the said day and place and produce not thair auld retoures and infeftmentis upoun thair aithe solemlie gevin that thai had na uther bot sick as they sall produce at the said day, that the rollis to be made and sett down be the saidis commissioneris salbe acceptit and allowit of as just and perfyit taxit rollis of the samene schirrefdome and be decernit to be registrat in his majesties register and nevir to be impugnit nor querrellit heirefter, bot the samene to stand in full force and affect, nochtwithstanding of ony infeftment or retour to be producit in anye judgement or court quhatsumevir for preving of ony of the landis within the saidis rollis sua to be sett down be the saidis commissioneris to be retourit at any lawer raite nor they ar extentit to or to ly within anye uther jurisdictiounes nor they ar designed to ly be the saidis taxit rollis to be sett down be the saidis commissioneris in maner abovespecifiet. And in the meane tyme, the saidis lordis findis and declairis the granting off this present comissione salbe no lett nor impediment to the collectoure off the taxatiounes or his deputtis to charge and compell the said schirreff of the said schirefdome of Kincairdin, present and to cum, to mak payment of the taxatioun of the landis lyand within the said schirrefdome of Kincairdine according as they have bene in use and custome of payment off the samene before the granting of this present commissioune unto the tyme the said commissioune tak full effect, conforme to the tennour thairoff abovespecifit.

Oure soverane lord and estaittis off parliament, considdering the evident appeirance of harme to the haill liegis of this realme gif coale, quhilk is our best fewall, inlaik or be utterlie exhaustit within this kingdome, and speciallie besyid the coistsyid quhair the samene may be easiest transportit; and being willing to tak sum goode solide ordour for preventing the said danger, quhilk can not be convenientlie done without sum tryell and cognitioun be first made and takin thairanent, have thairfore gevin and grantit and, be the tennour heiroff, gevis and grantis full power and commissioun to the persounes following: [...], James, archebischope of Glasgow, Adame, bischope of Dumblane, Jhonne, erle of Wigtoun, David, lord Carnegie, Schir Johnne Skrimgeour of Dudope, knycht, Alexander Lauder off Haltoun, Mungo McCall and Schir George Bruce off Carnok, knight, to sicht, view, try and considder the present estate off all and everie coilheuche lyand within tua myillis to the water of Forthe and coist syid thairoff on baithe the syiddis of the samene, gif the samene coilheuchis be coistlie and dificill to wine and in danger of drowning, gif they be not spedielie wroght and the work manteaned by forrayne sale, or gif the samene may be easelie wrocht with ressonable chairgis and have a competent sale in the cuntrie aboute and towardis Leithe and all the coistsyid about, quhairby it may be the more perfyitlie knawin gif the restraynt of exporting of coale be necessar or nocht. And ordanis the saidis commissioneris to meit in the toun of Edinburgh upoun the first Tuyisday of Apryill, and thair sett down and appoynte thair tymes of visitatioun and all uther thingis requisit and expedient for furtherance of that quhilk is heirby committit to thair charge. And as they try and find the estate of the saidis heuches and quhat is maist necessar to be done thairanent, ordanis thame to reporte thair proceiding in wreat in presens of the lordis of counsell upoun the first counsell day in the monethe of Junii thairefter, to the effect the samene may be recordit in the buikis of counsell and at the first occasioun of ane uther parliament be offerrit to the consideratiounes of the estaittis, that thai may tak sick ordour thairanent as the mater it selff salbe found to requyre.

Commissioun for modiefeing blenche dewties and ministeris stependis in erected prelacies

Oure soverane lord and estaittis of parliament, considdering that thair is sindrie benefices pertening of auld to abbotis, pryoures and nunnes dissolvit and erectit to sindrie persounes in this present parliament be his majestie, with advyse of the saidis estaittis, in lordschippis and baronies; and als that the patronages off the kirkis pertening to the saidis abbacies, pryouries and nunries ar gevin and annexit to the samene lordschippis and baronies to the foirsaidis persounes; as alsua that thair ar dyverse utheris patronages of benefices gevin and disponit be his majestie, with advyse foirsaid, in this present parliament, to sindrie particular persounes; and oure said soverane lord and estaitis foirsaidis, being maist willing that thair be ane yeirlie dewtie contenit in everie ane of the saidis erectiounes quhilk salbe payit yeirlie to his hienes and his successouris, and also being willing that the ministeris serveing or that heirefter sall serve at the kirkis of everie personage or vicarage quhairoff the patronages ar now disponit in this present parliament to quhatsumevir persoun, ather in thair erectiounes or utherwayes, be prowydit of sufficient stependis, and that the haill kirkes be plantit with sufficient ministeris to serve the cure at ilk kirk, sua money of thame as ar yit unplantit, thairfore, and that the premisse may be performit, oure said soverane lord and estaittis foirsaidis hes gevin and grantit and, be this present act, gevis and grantis full power and commissioune to Alexander, erle of Dumfermeling, chancelare of this realme, Johnne, erle of Marr, gryit thesaurer off this realme, George, erle of Wintoun, Robert, earle of Lowithiane, Thomas, erle of Melros, Jhonne, vicount Lauderdaill, David, lord Carnegie, Schir George Hay of Kinfawnes, knycht, clerk of register, and Schir Williame Oliphant of Newithoun, knycht, advocat to oure soverane lord, or ony fyve of thame, to modifie, decerne and declare the yeirlie dewtie to be contenit in everie ane of the foirsaidis erectiounes to be payit yeirlie to oure said soverane lord and to his majesties successoures, and the samene dewtie to be insert be the clerk of register and his deputtis in everie act of erectione grantit in this present parliament. And the saidis estaittis declaires that the yeirlie dewties to be modiefiet, decernit and declairit be the saidis persounes in maner foirsaid be vertew of this present commissioun salbe als valide, effectuall and sufficient in the selff as gif the samene yeirlie dewties hade bene modifiet, decernit and declairit be the saidis haill estaittis and had bene presentlie insert and conteanit in evrie ane of thir erectiounes. And siclyik, oure said soverane lord and estaittis foirsaidis hes gevin and grantit, lyikas by the tennour of this present act gevis and grantis full power and commissioun to Johnne, archebishope of Sanctandros, James, archebischope of Glasgow, Patrik, bischope of Aberdene, Adame, bischope of Dumblane, Andro, bischope of Gallowaye, Johnne, bischope of Cathnes, the saidis Alexander, erle of Dumfermeling, chancelare, Johnne, erle of Marr, thesaurer, Robert, erle of Louthiane, Robert, erle of Roxburgh, Johnne, vicount Lauderdaill, and David, lord Carnegie, or ony thrie of the saidis bischopes and any thrie of the saidis erles and lordis, to modifie, decerne and declare to everie minister serveing or that heirefter sall serve at everie kirk the cure thair yeirlie stependis in all tyme cuming, by thair manse and gleib off all thair kirkes quhairoff the patronages ar disponit be oure said soverane lord in this present parliament in the erectiounes of temporall lordschippes and baronies or utherwayes quhatsumevir, to the effect that the haill kirkis, baith alreddy plantit or as yit unplantit, may be prowydit to sufficient stependis in all tyme cuming; and that everie kirk may be prowydit of ane minister to serve the cure at ilk kirk, and that thai have sufficient and competent stependis, at the leist fyve hundereth merkis money of this realme or fyve chalderis victuell prowydit to everie ane of thame to serve the cure in all tyme cuming as said is; prowyding nevirtheles that gif the present standing stependis at ony of the saidis kirkis be above fyve hundereth merkis or fyve chalderis victuell, that the samene stependis sall nawayes be diminischit, bot to stand in the same estate as they ar presentlie. And it is heirby declarit that it salbe lesum to ony persone or persones of thair awin gudwill and plesour to augment and increase the stependis now to be modifiet be vertew of this present commissioune. And oure said soverane lord and estaittis foirsaidis dischargis the clerk of register and his deputtis of all buiking and extracting of anye actis of the saidis erectiounes or ony uther act of this present parliament quhairin the patronages of the benefices ar disponit; and als dischargis the keiparis off the registeris and seallis to expeid ony of thir saidis infeftmentis unto the tyme that oure said soverane lordis yeirlie dewtie and the ministeris sufficient and competent stependis be first modiefiet, decernit and declarit be the persounes foirsaidis conforme to the tennour of this present act of commissioun in all poyntes.
