†Our soverane lord and estaitis of this present parliament, remembering the guid, trew, faithfull and thankful service done be his maties lovitt† Sir Thomas Kirkpatricke of Closburne, knyght, not onlie in his hienes privat and particular services fra his majesties infancie to his hienes preferment to the kingdomes of Ingland, France and Irland, and continuallie sensyne in attending upone his majesties maist sacred persone at all tymes and occasiones, bot also in the publict effairs of this realme of Scotland concredite to the said Sir Thomas, greytumlie tending to the common weill, peace and tranquillitie of the samen and lieges thairof, the quhilk service is sufficientlie tryit, verefeit and knawn to his matie and haill estaitties of this present parliament to have bene verrie proffitabill to his matie, this realme and liegs thairof, in the quhilk services, as weill privat as publict, the said Sir Thomas has sustenit and debursit large charges and expenses notor to his matie and estaittis foirsaid. In recompense quhairof, our said soverane lord and estaittis of this present parliament ordanes ane act to be maid in due and competent forme dissolveand, lykeas his matie and estaittis forsaidis dissolves, all and sindrie landis, baroneis, castellis, touris, fortalices, maner placis, mylnes, multuris, woddis, fisheings, annualrentis, caynes, customis, casualiteis, emolumentis and dewteis quhatsumever of the temporalitie of the abbacie of Halywode fra the act of annexatione maid in the parliament halden at Edinburgh the xxix day of July the year of God jM vC fourscoir seven yeiris, annexand the temporalitie of all benefices within this realme to the patrimonie of his hienes croun,† togidder with the paroche kirkis of Halywode, Dunscoir, Penpont,† Tynron and Kirkconnell, lyand within the sheriffdome of Dumfrieis, personages and viccarages therof, with all and syndrie teyndis, fruitis, rentis, emolumentis and dewteis perteining and belanging thairto, fra the said abbacie of Holywode and benefice thairof, quhairunto the samen pertene and pertenit of auld as ane pairt of the patrimonie thairof, to the effect that his matie may give, grant and dispone† to the said Sir Thomas Kirkpatrik of Closburne, knyght, in liferent for all the dayes of his lyftyme, and to Alexander Kirkpatrik, his second† laufull sone, and his airs maill laufullie to be gotten of his awin body, quhilkis failzeing to George Kirkpatrik, third laufull sone to the said Sir Thomas, and to the airis maill laufullie to be gotten of his awin body, quhilks also failzeing to the airis maill and assigneyis of the said Sir Thomas quhatsumever bearing the surname and armes of Kirkpatrik in fie heretablie, all and sindrie the particu[lar]† landis, baroneis, castellis, touris, fortalices, maner places, mylnes, multuris, wodis, fisheingis, annualrentis, [cay]nes, customis, casualiteis, emolumentis and dewteis quhatsumever pertening and belanging to [the temporalitie of] the said abbacie of Halywode†; togidder with the advocationis and donationis and [ryght of patronages of the] paroche kirkis respective above specifit, [per]sonages and vicarages th[air]of, and all right, [title, interes and] clame of richt quhilk his majestie, or hienes predessouris, had, hes or onywayes may have or cla[me thairto, or ony pairt] thairof, be ony maner of way in tyme cuming; and also to the effect that the samen be [unitite, erectit, ordan]it, creat and incorporat in ane haill and frie baronie, to be callit now, and in all [tyme cuming], the baronie of Haliwode; and siclyke to the effect that the said abbacie or mon[astrie] of Halywode may be supprest and extingushit perpetualie in all tyme cuming, and that na persone, [nor] persones, be provydeit thairto in na tyme heirefter, renunciand and dischargeand all ryt and tytles quhilk his matie or his successoris had, hes or may have or pretend in and to the thridis of the fruictis of the said abbacie be quhatsumevir rytis, actis of parliament or lawis of this realme; dischargeand his hienes collectoures present and to cum of all uplifting of the saidis thriddis simpliciter and for evir, revoikand, dischargeand and annulland all pensiounes disponit firth of the thriddis of the said abbacye in anye tyme bigane, and decernand the samen to be null in all tyme cuming†; and willing and granting that na monkis portiounes be upliftit furth of the samyne, quhilkis his matie, for his hienes and his sucessoures, renunces and dischairgis simpliciter and for evir; and ordaneing the place of Haliewode within the precint thairof to be the principall messuage of the said baronie for taking of saising thairat in all tyme heirefter, and that the samen saising sall be sufficient for all and sindrie landis, baroneis, mylnes, multuris, woddis, fischeingis, castellis, toures, fortalices, maner placis, annuelrentis and utheris foirsaidis quhilkis pertenit to the temporalitie of the said abbacye of Halywode, togidder with the advocatione, alienatione and ryt of patronage of the paroche kirkis abonewritten, personages and viccarages thairof, and for everie pairt of the samen, without ony uther speciall or particular saising to be takin at onye uther pairt thairoff, notwithstanding that they ly not contigue togidder, to be haldin of our said soverane lord and his successouris in frie blenche, f[r]ie heretage and frie baronie for evir, payand thairfore yearlie the said Sir Thomas Kirkpatrik of Closburne, knyght, during his lyftyme, and efter his aireis, the said Alexander Kirkpatrik, his secund laufull sone, his airis, successors and assigneys foirsaidis, to oure said soverane lord and his successoures the soume of […] money of this realme of Scotland in name of blenche ferme at the feist of Witsonday allanerlie.† With command to the director and clarkis of the chancellary to extend and expeid ane charter upone the signator to be maid heirupone and to the keepar of the gryt seill to append the samen thairto without passing of ony uther register or appending of ony uther seill thairto, quhairanent thir presentis sall be therof sufficient warrand; and als with comand to the clark of register and his deputtis to extend ane act hereupone in mair competent former with all claussis neidfull.
