Act in favouris of the towne of Perth for bigging of thair brig

Oure soverane lord, estaittis and haill bodie of this present parliament, understanding and being informit that the provest, bailleis, counsaill and communitie of the burgh of Perth have sa far procedit in the bigging of thair brig of Tay as they have begun at the ground and raisit the haill pillaris thairof abone the watter, thairfoir his majestie and estaittis foirsaidis and upoun the respect and regaird they have to the forthering of sa gude and necessar a work, tending sa great to the weill of the lieges, policie and decoratioun of the countrey, have ratefeit, apprevit and confermit and, be the tennoure of this present act, ratefeis, appreves and confermis the gift, donatioun and dispositioun gevin and grantit be oure said soverane lord, with advyse and consent of his trustie and weilbelovit counsaillouris, Schir James Hay of Kingask, knycht, his hienes comptroller, under the privie seall of the kingdome of Scotland, to the provest, bailleis, counsaill and communitie of the said burgh of Perth yearlie and ilk year for the haill space of sevin yearis nixt following thair entrie of all and haill ane yearlie dewtie and sowme of fyve thowsand merkis money of North Britane, to be payit yeirlie during the space of sevin yeiris betuix the first day of November the yeir of God jM vjC and ten yeiris, and the first day of November jM vjC and ellevin yeiris, and sua furth yeirlie in tyme cumming during the said space of sevin yearis, to the saidis provest, bailleis, counsaill and communitie of the burgh foirsaid and thair deputis, to the reparatioun of the burgh foirsaid furth of his hienes propirtie quhatsumevir and furth of the best and reddiest of his majesteis customes and impostis within the kingdome of Scotland, beginnand the first yearis payment of the same yeirlie duetie and sowme of fyve thowsand merkis betuix the first day of November jM vjC and ten and the first day of November jM vjC and ellevin yeiris, as the said gift and dispositioun grantit thairupoun of the dait the secund day of Maii last bipast mair fullelie proportis, in all and sindrie pointis, heidis, articlis and circumstances thairof. And his majestie and estaittis foirsaidis willis, decernis and declaris that this present approbatioun and ratificatioun is and sall be of als great availl, force, strenth and effect as gif the foirsaid gift and dispositioun wer heirin word be word at lenth insert and ingrossed heirintill, wheir anent his majestie and estaittis foirsaidis hes dispensit and dispensis be thir presentis; and ordinis his hienes comptroller to visite the brig yearlie and that the work go forward with all possibill tymes, and that everie year at the leist they imploy the said sowme of fyve thowsand merkis whilk they sall ressave frome the comptroller upoun the bigging of the said brig. And incais the work be compleit in fewer yearis nor in the said space of sevin yearis to cum (within the quhilk space the said comptroller is ordanit be thair said gift to pay the said sowme of fyve thowsand merkis yearlie for the said space of sevin yearis to the said burgh of Perth), notwithstanding of the compleiting thairof in fewer yearis, the samin sall be na cause to the comptroller present and to cum of retentioun of ony pairt of the fyve thowsand merkis yearlie eftir the compleiting of the said brig, bot that the comptroller present and to cum sall pay the foirsaid sowme of fyve thowsand merkis yeirlie and ilk yeir, seing it is understand to the estaittis that the burgh of Perth is impignorat in great sowmes of money for bigging of thair brig alreadie and that the foirsaid haill sowme will not compleit the work of the said brig.
