Oure soverane lord and estaittis of this present parliament, considering the gude, trew and thankfull services done heirtofoir be his hienes richt trustie and weilbelovit cousing and counsaillour Johne, erle of Mar, lord Erskyne, Alloway and Gareoch, and his predecessouris, in thair great cair, vigilance and faithfulnes in all thingis that micht tend to the advancement of his majesteis honorable affairis, quhairof he and his umquhile father gaif evident and manifest pruif and experience in thair worthie, memorable and acceptable panis and travellis tane be them in the educatioun of his majesties maist royall persone fra his birth to his perfyte age, and in the lyk nochtable service done be the said erle himself in the educatioun of his majesteis darrest sone, the prince; and also his majestie, remembering the happie and prosperous jornayis and expeditiounes quhilkis the said erle hes tane in ambassages frome his hienes, quhilkis he has dischargeit na less dewtifullie nor he hes accomplisheit spedelie, to his hienes great contentment; and his hienes, being nawayes of mynd to forget the saidis great services nor leave the samin unrewardit, and finding na mene better to reward the same in sum pairt than be the dispositioun of sic rentis, proventis, proffeittis and emolumentis of the landis, kirkis and utheris particularlie underwrittin as did pertene of befoir to the monastereis of Inchmahomo, Cambuskynneth and Dryburgh, the samyn monastereis and superstitiounis thairof being now abolishit, and the kirklandis of the samin now annexit to his hienes crowne; and thairwith considering that the saidis monastereis have bene in all tyme heirtofoir commounlie disponit be his majesteis predecessouris to sum that wer cum of the House of Erskeyne; and that inrespect thairof his majestie, be his hienes chartour and infeftment under his hienes great seall, have grantit and disponit to his said richt traist cousing and counsaillour Johne, erle of Mar, his airis maill and assignayis heretablie, all and sindrie the landis, baroneis, castellis, touris, fortalices, maner places, mylnis, multuris, salmond fischeingis and utheris fischeingis, woddis, parkis, medowes, forrestis, teyndis, teyndscheves, annualrentis, fewfermes, maillis, dewteis, casualiteis, tennentis, tenandreis, service of frie tennentis and utheris quhatsumevir at lenth specefeit and contenit in the said chartour, quhilkis pertenit of auld to the said priourie of Inchmahomo and abbaceis of Dryburgh and Cambuskynneth, and quhairof the priouris and abbottis of the samin hes bene in possessioun as pairtis of the rentis and patrimonie thairof in ony tyme bigane, togidder with the advocatioun, donatioun and richt of patronage of all and sindrie the parochkirkis, baith personages and vicarages, of the saidis monastereis with all thair pertinentis, all unitit, annexit and incorporatit in ane frie lordschip and baronie callit, and to be callit in all tyme cumming, the lordschip and barony of Cardroise, as in the said chartour contening sindrie utheris commoditeis, privilegis, articlis and clauses of the date the [...] day of [...], the yeir of God jM vjC and four yeiris mair fullelie is contenit; thairfoir, and for the uther gude causes underwrittin, oure said soverane lord and estaittis of this present parliament ratefeis, apprevis and confermis the foirnameit chartour, with the precept and instrument of seasing following thairupoun, grantit to his said richt trest cousing and counsaillour Johne, erle of Mar, his airis maill and assignayis foirsaidis heretablie, off all and sindrie the foirnameit landis, baroneis, castellis, touris, fortalices, maner places, mylnis, multuris, salmond fischingis and utheris fischeingis, woddis, parkis, medowes, forrestis, teyndis, teyndscheves, annualrentis, fewfermis, maillis, dueteis, casualiteis, tennentis, tennandreis, service of frie tennentis, advocatioun, donatioun and richt of patronage of all and sindrie the kirkis, baith personages and vicarages, and utheris alsweill generall and speciall mentionat in the said chartour, quhilkis pertenit of befoir to the saidis priourie and abbaceis of Dryburgh, Cambuskynneth and Inchmahomo, in all and sindrie heidis, articlis, clauses, circumstances and conditiounes specefeit and contenit in the said chartour with the precept and instrument following thairupoun. Attoure, oure said soverane lord and estaittis foirsaidis, weyand and considering with them selffis the great and wechtie causes abonewrittin (quhilkis oure said soverane lord and estaittis foirsaidis) moweit his majestie to the granting of the said infeftment fra the beginning, quhilkis, being nochtour and manifest in them selffis, ar maist cleirlie verefeit and provin to his majestie and estaittis foirsaidis in plane parliament, ar now fundin, decernit and declarit to be greate, sene and ressonable causes tending to the advancement of his hienes honour and to the proffeitt of the commoun weill of this realme of Scotland; thairfoir and for the said Johne, erle of Mar and his foirsaidis better and perpetuall securitie of the landis, baroneis and utheris particularlie underwrittin, quhilkis of befoir wer annexit to his hienes crowne, oure said soverane lord and estaittis of this present parliament, be the tennour heirof, expreslie dissolvis fra the act of annexatioun of all the kirklandis within this realme to his hienes crowne and fra the patrimonie of the said crowne, all and sindrie the landis, baroneis, castellis, touris, fortalices, manerplaces, mylnis, multuris, salmond fischeingis, utheris fischingis, woddis, parkis, medowes, forrestis, teyndis, teyndscheves, annualrentis, fewfermis, maillis, dueteis, casualiteis, tennentis, tennandreis, service of frie tennentis of the foirnameit priourie of Inchmahomo and abbaceis of Dryburgh and Cambutkynneth, with all thair pertinentis, allsweill under as abone expressit, sua far as micht have fallin, or may fall, under the said act of annexatioun, to remane separat and dissolvit thairfra in all tyme cumming to the effect the samin may be of new gevin, grantit and disponit to the said noble erle and his foirsaidis in maner eftir following. Attoure oure said soverane lord and estaittis foirsaidis, for the cause abonewrittin, hes unite, annexit and incorporat and, be the tennour heirof, unitis, annexis and incorporattis all and sindrie the foirsaidis landis, baroneis, woddis, mylnis, fischeingis, annualrentis and utheris particularlie and generalie abonementionat, with castellis, touris, fortalices, maner places, woddis, forestis, mylnis, fischeingis, pairtis, pendiclis, annexis, connexis, tennentis, tenandreis, fewfermes and dueteis of all and sindrie the foirnameit landis and baroneis, woddis and fischeingis, quhilkis pertenit of befoir to the said priourie of Inchmahomo and abbaceis of Cambuskynneth and Dryburgh, with advocatioun, donatioun and richt of patronage of all and sindrie the foirsaidis kirkis, personages and viccarages as said is in ane haill and frie lordschip and baronie, to be callit in all tyme cumming the lordschip and baronie of Cardroise; and ordinis the maner place of Cardroise to be the principall messuage thairof, and ane seasing to be tane thairat to stand and be sufficient seasing for the saidis haill landis and utheris abonewrittin, and gevis to the said noble lord, his airis and successouris that salhappin to be provydit be him to the said lordschip and baronie of Cairdroise, the honour, estait, dignitie and preheminence of ane frie lord of parliament, to be callit Lord of Cardroise in all tyme cumming, with all honouris and privileges belanging thairto, and that the said lordschip and baronie sall nawayes be accomptit amongis the ecclesiasticall landis of this realme, bot sall be taxt with the temporall landis thairof, and sall be estimat, judgeit and retourit in all brevis, services and retouris in tyme cumming to ane hundreth pundland of auld extent; and siclyk decernis and declaris that the said lordschip and baronie of Cairdroise sall be frie fra all payment of ony thriddis, first fruittis, fyft penny and monkis portiounes quhilkis may be askit and acclamit be quhatsumevir lawes, actis and constitutiounes furth of the saidis abbaceis and prioureis respective foirsaidis, and decernis the auld assumptioun or quhatsumevir new assumptioun thairof to be alluterlie extinguischit and extinct, for evir to be haldin all and sindrie the foirsaidis landis, lordschip and baronie of Cardroise, comprehending as is abonespecefeit, in frie heretage, frie lordschip and frie baronie for evir, be all richtis, merches etc., payand thairfoir yeirlie the said noble erle and his foirsaidis to oure said soverane lord and his successouris the sowme of fyve hundreth merkis usuale money of Scotland in name of blencheferme alanerlie, reserveand alwayes to the saidis David, commendatar of the abbaceis of Dryburgh, Inchmahomo, and Adam, commendatar of Cambuskynneth, the rentis, proventis and emolumentis quhatsumevir of the saidis landis, baroneis and utheris particularlie abonewrittin siclyk and als frelie as they possessit and bruikit the samin befoir the making of thir presentis. And inrespect of the said reservatioun, his hienes exoneris the said erle and his foirsaidis of all payment of the said blencheferme duetie during all the dayes of thair lyfetymes, and heirupoun his majestie and estaittis foirsaidis ordanis ane chartour to be maid, grantit and exped to the said noble lord Johne, erle of Mar, his airis maill and assignayis foirsaidis, or to ony utheris quhome he sall nominat and think expedient, to be extendit in dew and ample forme, with all clauses necessar, contening sic utheris privileges and liberteis thairintill as it sall pleis his majestie to grant thairwith to them; quhilk new infeftment sua to be past his majestie and estaittis foirsaidis decernis and declaris to be sufficient, valiable and effectuall in all tyme cumming for bruiking, joising and possessing of all and sindrie the foirnameit landis, lordschippis, baroneis and utheris, baith generall and speciall, particularlie befoir expremit, with all thair pertinentis, as thair heretage at thair plesure; declairing be thir presentis that the foirsaid infeftment to be past as said is sall be ane sufficient richt to the said noble lord and his foirsaidis for bruiking and joising of all and sindrie the foirnameit landis, baroneis, tenementis and utheris generalie and specialie befoir expremit, quhairof the saidis commendataris and priouris be them selffis, thair tennentis and utheris in thair names, hes bene in possessioun be the space of fourtie yeiris bigane preceiding the date of thir presentis. Reserveand and exceptand alwayes furth of this present act and erectioun foirsaid all regaliteis and privileges thairof (gif ony be) possessit be the abbottis and titularis of the saidis abbaceis and priourie of Dryburgh, Cambuskynneth and Inchmahomo of befoir to remane with oure soverane lord and his hienes successouris and thair crowne inseparablie in all tyme heireftir.
