The quhilk day Schir Thomas Hammyltoun of Monkland, knycht, advocat to oure soverane lord, produceit in presens of the saidis haill estaittis of this present parliament ane summondis of treassoun dewlie execute and indorsat, rasit at the instance of oure soverane lord and of his hienes said advocat aganis Thomas Kennedie of Drummurchie, brother germane to umquhile Gilbert Kennedy of Bargany, for rasing of fyre and burning the place of Auchinsoule upoun the auchtene day of Maii jM vjC and thrie yeiris. The quhilk summondis being callit thryse at the bar and the said Thomas Kennedie nawayes comperand; and thaireftir James Borthuik, Rothosay herauld, comperit in presens of the saidis haill estaittis and maid faith that he lauchfullie summonit the said Thomas Kennedie upoun the fyftene day of Februar jM vjC and four yeiris at the peir and schore of Leith befoir Daniell Boyll, messinger, and Patrik Hammyltoun, servitour to the Erle of Cassellis, quha being baith present lykwayes maid faith that they hard and saw the said James Borthuik mak the said executioun at the said schore of Leith and that they wer requirit witnesses thairto. And siclyk the said James Borthuik, Rothosay herauld, maid faith in presens of the saidis estaittis that he lauchfullie summond the said Thomas Kennedie upoun the sewintene day of Februar the yeir of God foirsaid at the marcat croce of Irving, and upoun the auchtene day of the said moneth of Februar the samin yeir of God at the marcat croce of Air and marcat croce of Mayboill; and lykwayes upoun the nyntene day of the said moneth of Februar the yeir of God foirsaid the said James Borthuik maid faith that he lauchfullie summond the said Thomas Kennedie at Johne Wallace house of Ballintra, quhair the said Thomas Kennedie remanit continewalie befoir his depairting furth of Scotland, and that the samin haill executionis wes maid befoir Johne Wod of Wodland and Johne Carnoquhan, his servitour; quhilkis tua witnesses lykwayes comperit in presens of the saidis estaittis and maid faith that they hard and saw the said James Borthuik execute the foirsaid summondis of treassoun aganis the said Thomas Kennedie at the marcat croces of Irving, Air and Mayboill and at the duelling house of Ballintra the dayes respective foirsaidis, and that they wer requirit witnesses be the said James Borthuik thairto. Upoun the productioun of the quhilk summondis of treassoun and verificatioun thairof, the said Schir Thomas Hammyltoun, advocat to his hienes, askit instrumentis.
