The quhilk day Maister Thomas Hammyltoun of Drumcarne, advocat to oure soverane lord, producit in presens of the kingis majestie and haill estatis of parliament, lyk as he did diverse [tymes] of befor, ane summondis of treassoun rasit and persewit be oure said soverane lord and his hienes advocat and justice aganis Williame Ruthven, brother and apperant air to umquhile Johne, erle of Gowrie and Maister Alexander Ruthven, his brother, and his tutouris and curatouris, gif he any hes, and all utheris haveand or pretendand to have interes in the mater of treassoun underwrittin, to have ansuerit to the pointis of the said summondis and to the crymes of treassoun and lesemajestie contenit thairintill; and siclyk the said advocat producit in presens of the kingis majestie and estaitis summondis rasit be thame aganis Alexander and Harie Ruthvenis, sonnes to umquhile Alexander Ruthven of Freland, Patrick Eviot, brother to Colene Eviott of Balhoussie, and Hew Moncreif, brother to Williame Moncreif of that Ilk, to have lykewayes ansuerit to the pointis of ane uther summondis of treassone anent the interprysing of the slauchter of oure soverane lord at Perth upoun the fyft day of August list bipast; the quhilkis tua summondis, ressones and causes thairin contenit, being first red in presens of the kingis majestie and in presens of the lordis of articles, they fand baith the samyn summondis relevant; and thaireftir this instant day, baith the saidis sumondis of treassoun being red in presens of the kingis majestie and haill estaittis and the said Williame Ruthven, his tutouris and curatouris and all utheris haveand or pretendand to have enteres, the saidis Alexander and Harie Ruthvenis, Patrick Eviott and Hew Moncreif being thryse callit at the tolbuth window and nane of thame comperand, the saidis haill estaittis fand baith the saidis summondis, ressones and causes thairin contenit relevant and thairfoir they admittit the samyn to the said advocattis probatioun.

And immediatlie thaireftir the said Maister Thomas Hammyltoun of Drumcarne, advocat to oure soverane, for preving of the pointis of baith the saidis summondis of treassoun, producit the lettre of horning dewlie execute and indorsat aganis the saidis Alexander and Harie Ruthvenis, Hew Moncreif and Patrik Eviott, and that they were denuncit rebellis and put to the horne for the crymes of treassoun thairin contenit, and repetit the haill depositionis of the witnesses examinat befoir the lordis of articlis and the depositionis of umquhile Maister Thomas Cranstoun and George Craigingelt, and thair executioun to the death for the foirsaid cryme of treassoune; and last, the said advocat repetit the nochtorietie of the dead of the said treassoun, togidder with the haill circumstances of the said mater, and renuncit forder probatioun for proving of the pointtis of baith the saidis summondis of treassoun and desyrit the said proces to be advysit; and thairupoun the said advocat askit instrumentis.

The quhilk day the said Maister Thomas Hammyltoun of Drumcarne, advocat to oure soverane lord, eftir that he had repetit and producit all his probationis to the saidis haill estaitis quhilkis he wald use for preving of the pointis of the saidis summondis of treassoun rasit and persewit at the instance of oure said soverane lord and his hienes justice aganis the said Williame Ruthven, brother and apperant air to the said umquhile Johne, erle of Gowrie and Alexander Ruthven, his brother, his tutouris and curatouris and all utheris haveand or pretendand to have interes in the mater of treassoun underwrittin, quhairby they wer summond to have comperit befoir oure said soverane lord and his estaitis of parliament at ane certane day bigane, with continewatioun of dayes, to have ansuerit to the pointis and crymes of treassoun and lesemajestie contenit in the said summondis; off the quhilk summondis the tennour followes:

And thaireftir the haill wryttis and probationes being red, sene and considerit be the haill estaittis of parliament in presens of the kingis majestie, and they thairwith being ryplie advysit, the saidis lordis and estatis of parliament findis, decernis and declaris that the saidis Alexander and Harie Ruthvenis, Hew Moncreif and Patrik Eviott, and ilkane of thame, committit and did oppin and manefast treassoun aganis oure said soverane lord in all pointis, articlis and maner contenit in the said summondis; and thairfoir it wes gevin for dome be the mouth of David Lyndesay, dempster of parliament, in maner and forme as followis: This court of parliament schawis for law that the saidis Alexander Ruthven, Harie Ruthven, his brother, sonnes lauchfull to umquhile Alexander Ruthven of Freland, Hew Moncreif, brother to Williame Moncreif of that Ilk, and Patrik Eviott, brother to ColeneEviott of Balhoussie, committit the crymes of treassoun and lesemajestie aganis oure soverane lord and his authoritie royall in maner at lenth contenit in the said summondis; and thairfoir decernis and declaris thair persones to underly the panis of treassoun and lesemajestie and last punischement prescryvit be the lawis of this realme and all thair gudis moveabill and immoveabill, alsweill heretages as offices, benefices and utheris quhatsumevir pertening to thame, or quhilkis micht onywayes belang or appertene to thame, to be confiscat to his majestie and to remane with his hienes in propeirtie for evir and thair posteritie to be now and in all tyme cummyng uncapabill and unhabill to bruik and posses within this realme ony honouris, digniteis, offices, benefices, successiones or utheris gudis or geir, moveabill or immoveabill.
