Anent satisfactioun to the kirk be papistes

Oure soverane lord, with advise of his estaitis in this present parliament, ordanis all presbiteriis within this realme to caus lauchtfullie summond and charge all personis papistes or suspect of papistrie within the boundis of thair presbiteries, personallie or at thair duelling places, to compeir befoir the saidis presbiteries and satisfie the kirk and presbiterie quhair thay remane and makis residence betuix and the first day of August nixtocum. And incace of thair not comperance or compering sall refuis to gif obedience and mak satisfactioun as said is betuix and the said day, his hienes, with avise of his estaites foirsaidis, ordanis significatioun thairof to be maid be the presbiterie to his hienes privie counsell, and upoun the said significatioun, the privie counsell to direct lettres chargeing the saidis personis papistes or suspectit of papistrie to compeir befoir thame and produce sufficient testimoniall of the presbiterie quhair thay remane of thair satisfactioun as said is, under the pane of rebellioun and putting of thame to the horne; and gif thai failyie, to denunce thame thairto; be the quhilk denunceatioun, oure said soverane lord and estaitis foirsaidis declaris that not onlie thair moveable guidis sall fall in escheat and be confiscat to his hienes use, bot the lyverent of quhatsumevir thair landis, rowmes, possessionis and utheris belanging unto thame sall apertene unto his hienes as escheat, to be intromettit with and disponit upoun as he thinkis gods. And inlikemaner declaris that quhatsumevir persoun or personis sall resset, supplie or interteney the saidis papistes efter the intimatioun of thair disobedience and denunceatioun as said is sall incur the same penaltie of tinsell of thair guidis, geir and liferent. And to the effect that the premises may be the better accomplischit, his hienes and estaitis foirsaidis declaris that incace the saidis presbiteries beis fund remise or negligent in citatioun of the saidis personis befoir thame to the effect abonewrittin, the ministeris of the said presbiterie, or ony ane persoun of the ministerie thairof in quhome the fault salbe tryit, sall amit and tyne the ane half of thair benefice or stipend that yeir, and the collectour or his depuittis sall uplift the same to be disponit be advise of the lordis modifearis of the ministeris stipend, to the help, supplie and interteynement of uthair ministeris as yit not provydit to sufficient stipendis.

Forsamekle as thair is dyvers personis denuncit rebellis, quha being suspectit of papistrie of befoir and fearing the sentence of excommunicatioun to have followit aganis tham, hes procurit the giftes of their eschaetis and lyfrentis disponit be oure soverane lord to their barnis or utheris conjunct personis upoun horningis execute aganis thame for civile causes, and nevirtheles hes retenit the possessioun of thair haill guidis, geir, landis, possessionis as gif thai had remanit his hienes faithfull and obedient subjectis, quhilk hes gevin thame occasioun to continew in thair rebellioun, as alsua in thair superstitious opinioun of papistrie and remaning under the said sentence of excomunicatioun in manifest contempt of God, his trew religioun and lawes of this realme. For the repressing of quhilk contempt and remeid thairof, oure said soverane lord, with avise of the estaitis in this present perliament, decernis and declaris all and quhatsumevir giftes of escheate and liferentis grantit to the saidis barnis and conjunct personis of ony of the foirnamit personis, denuncit rebellis and put to the horne for quhatsumever caus, quha being suspectit of papistrie ofbefoir hes sufferit the sentence of excomunicatioun to pas aganis thame, and quhais guidis, geir, landis and possessionis may be verifiet to have remanit in thair awin possessionis as gif thai had remanit faithfull and obedient subjectis, to have bene fra the beginning and to be in all tyme cuming null and of nane availl with all that hes followit or may follow thairupoun, nochtwithstanding quhatsumevir decreittis or declaratouris gevin and past in favouris of the saidis rebellis, thair barnis or conjunct personis; and the richt of the said eschaet guidis, geir and liferentis to have pertenit and to pertene to oure said soverane lord and to be at his gift and dispositioun als frelie as gif the saidis pretendit giftes and dispositionis thairof had nevir bene grant nor disponit to thair saidis barnis and conjunct personis, and as declaratour had nocht past thairupoun.

Item, oure soverane lord and estaitis of this present parliament ratifies and apprevis the actis maid be his hienes ofbefoir anent the dischargeing of halding of mercattis on the Sabboth day with this additioun: that quhasoevir prophanis the Sabboth day be selling or presenting and offering to be sauld upoun the said day ony guidis or geir or quhatsumevir uther merchandise, be thame selffis or ony uther in thair name, and beis thre severall tymes lauchtfullie convict thairof, ather befoir the provest and baillies within burgh quhair the prophanatioun salhappin to be committit, or befoir certane commissionerris and justices in everie presbiterie to be appointit be the kingis majestie, with avise of his privie counsell, thair haill guidis and geir salbe escheatit to his hienes use and thair personis punist at the will of his majestie, with avise of his secreit counsell.

Anent payment of the dewtie of the wynes

It is statute and ordanit be oure soverane lord and estaitis of this present parliament that the dewtie grantit be the estaitis to his majestie upoun the wynes be thankfullie payit to his majesties collectour in all tyme cuming, within the space of ten dayes nixt efter thair arryving within this cuntrie; and to this effect, ordanis the provest and baillies of ilk burgh within quhais boundis and jurisdictioun ony wynes sall arryve in tyme cuming to tak sufficient cautioun and souirtie of the merchandis, marinaris and utheris hamebringaris of the saidis wynes, that thay sall thankfullie pay the said dewtie grantit to oure soverane lord thairof within the space foirsaid to his hienes collectouris appointit for ingaddering thairof, and heirupoun ordanis lettrez to be direct (gif neid beis) baith to charge the saidis provest and ballies to tak the said cautioun; as also ather to charge the cautioun or then the hamebringaris at the plesour of the collectour to mak payment of the said dewtie to his hienes within the said ten dayes nixt efter thair arryving within this realme, under the pane of rebellioun. And gif thay failyie thairin, the saidis ten dayes being bypast, to denunce thame rebellis and put thame to the horne, and that thay be not relaxit thairfra unto the tyme thay pay the double of the said dewtie to the collectour for thair contemptioun.

Item, becaus that the souirties of all officiaris of armes admittit be lyoun king of armes ar fund to him and his clerk, it is thairfoir statute and ordanit that thai be chargit twys in the yeir to produce thair buikis of souirties, to the effect oure soverane lord and his thesaurair be not defraudit of the halff of the penalties for the deprivit officiaris; and this to be usit be the thesaurair in sic sort as the schireff clerkis ar ordanit to produce thair horningis, to the effect that executioun may follow thairupoun and the thesaurair to be chargit with his ressett of the foirsaidis penalties in his comptis. Oure soverane lord and estaitis in this present parliament, in respect of the greit derth and skarsitie off all kynd of flesches, statutis and ordanis that in all tyme cuming the tyme of Lentren salbe certane fra the first day of Merche inclusive to the first day of Maii exclusive, and that na lambis nor young weillis within yeir auldis be slayne or eattin befoir Witsonday yeirlie under the panis following. And als ratifies, apprevis and confirmis the actis of perliament maid ofbefoir aganis the eittaris of flesche in Lentrone or on the Wadnisday, Fryday or Seterday in everie oulk, except the penaltie appointit in the saidis actis aganis the contravenaris thairof, quhilk oure soverane lord and estaitis foirsaidis cassis, annullis and haldis that point of the same as deleit and reservis the said penaltie as followis to the effect the same may be the better execute: That is to say, quhasoevir salbe tryit to have contravenit the same, for the first fault, salbe adjugeit in the sowme of ten pundis money; for the secund falt, in the sowme of tuentie pundis; and for the thrid, in the sowme of fourttie pundis; and sua ordanis the pane to be multipliit according to the contempt and oft contravening of the saidis actis. And that the same may tak the better effect, oure soverane lord and estaitis foirsaidis ordanis that within burrowis, his hienes thesaurair nominat ane sufficient persone, and that everie burgh nominat ane uther quha salhave pouer to try, serch and seik quhatsumevir personis, contravenaris of this present act, and persew thame befoir the justice generall or his depuittis monethlie for the same. And incace of convictioun of ony persone or personis, ordanis the ane half of the penaltie to apertene to oure soverane lord, and the uther half to the burgh quhair the convictioun salhappin to be, to be employit by thame as thai sall think gude. Quhilk act oure said soverane lord and estaitis foirsaidis ordanis to be put to executioun in tyme cuming without exceptioun or pretence of ony former licience grantit befoir the dait heirof, alsweill aganis the eittaris as aganis the fleschouris, cuikis, oistellaris and utheris prepararis thairof, and that na licience be grantit heireftir without ane sufficient testimoniall be schawin to oure soverane lordis thesaurair be ane minister of Goddis word and doctour of medicine, apothecar or chirurgiane of the infirmitie of the persoun that suittis and cravis the same, utherwayes the licience to be null. And incace the persoun, obtenar of the said licience, be challengeit for contravening of this present act, the licience sall not be sufficient to absolve the persoun accusit, except the same, togidder with the foirsaid testimoniall, be likwyis producit and schawin in jugement.

And understanding that this mischeif and schamefull disordour increscis and is nureschit be the oursicht, hounding out, ressett, mentinence and not punischement of the thevis, limmeris and vagabundis pairtlie be the landislordis, maisteris and baillies of the landis and boundis quhair thai dwell and resortis, and pertlie throw the counsellis, directionis, ressett and pertaking of the chiftanis, principallis of the branches, and houshalderis of the saidis surnames and clannis quhilkis beris quarrell and seikis revenge for the leist hurting or slauchter of ony ane of thair unhappie races, although it wer be ordour of justice or in reskew and following of trew mennis geir stollen or reft, sua that the saidis chiftanis, principallis of the branches, and houshaldaris worthelie may be estemit the verie authouris, fosteraris and mantenaris of the wickit deidis of the vagabundis of thair clannis and surnames. For remeid quhairoff, and that thair may be anys a perfite distinctioun be names and surnames betuix thame that ar and desiris to be estemit honest and trew men and thame that ar and escheamis not to be estemit thevis, reifaris, sorneris and ressettaris and sustenaris of thift and thevis in thair wikit and odious crymes and deidis, it is statute and ordanit that thair be ane roll and catologue maid with all possible diligence of all personis of the surnames foirsaidis suspectit of slauchter, thift, reif, ressett of thift or thevis or sorningis within the saidis schirefdomes and stewartries, in quhat townis and parochinis and under quhat landislordis, maisteris or baillies thai dwell, that all landislordis and baillies be chargit to find suirtie to releve the king and wardane in the bordouris and over all quhair to mak thair men, tennentis and servandis answerable to justice, and to redress parties skaithit quhilkis hes not fund the said souertie alreddie, that the haill personis suspectit and dilatit of the saidis crymes salbe gevin in valentynes to thair maisteris, landislordis or baillies to be presentit befoir his hienes justice and his deputtis and utheris commissionerris or assessouris to be appointit at certane dayes and places, that it may be understand quha wilbe obedient and quha inobedient and fugitive, sic houshaldaris of the saidis clannis as comperis to find cautioun for releif of thair landislordis, sic as comperis not to be denuncit rebellis and fugitives. The chiftanis, principall of the branches, and houshalderis to be chargit to enter pleiges for releif also of the landislordis. The pleges to be deliverit in keping to the noble men, baronis and gentilmen that hes ressavit grytest and latest harmes of the saidis thevis and sornaris of clannis and thair assistaris in thair awin houses, or with thair freindis in the cuntrie quhair thai think maist sure. Gif the personis complenit upoun comperis and findis guid souirtie for releif of thair masteris and landislordis, to bruik thair takis and titles. Gif thay compere not, or comperand findis not the said souirtie, to be denuncit rebellis and thair escheatis of takis to be disponit to thair landislordis. For thair better releif, the complener to have actioun, criminall or civile, aganis the landislordis, masteris or baillies or thair souirties for the attemptat to be committit efter the souirtie fund. The availl and quantitie of the guidis stollen or reft or uther skaith done salbe referit to the aith of the complener, the treuth of the fact being provin be tua witneses. Or gif the pairtie complenit on comperis not personally befoir the justice to mak his defence, or excuses him not be the aith of his maister personallie comperand, na landislord to sett his land or to suffer his land to be occupiit and possessit with his consent or resaif males, gressume or dewtie fra the occupear thairof that being of a clan findis not souirtie to releif his landislord betuix and the first day of August nixt, quhilk gif the landislord omit to seik for his releif, he to be answerable to the complener, criminallie or civilie, as gif he had done the deid him selff. Nane of the saidis clannis or uther brokin men, thair wyffis, barnis, heiris, executouris or assignais salhave actioun, criminallie or civilie, aganis quhatsumevir personis for effecting spulyie, slauchter, fire rasing or uther alleagit violent deid committit aganis thame be ony of his hienes leygis, except thai instruct with thair summondis that the persoun alleagit hurt, spulyeit, slayne or ejectit wes the kingis fre leige man the tyme of that deid, and had fund souirtie to be answerable to justice for releif of his landislord. And to redress pertiis skaithit, everie theif and sorner salbe estemit the man and servand of him quhom of he hes land in tilage and pasturage, or quhome the said theif, sorner or reivar accumpanies at conventionis, gatheringis or at ony violent deidis, or on quhais ground the theif or rever is ressett and taries tuell houris togidder with the knawlege of the landislord being of habilitie and power to aprehend him, or quha hes ressavit band of manrent or gevin band of mantinence to the thevis or reivaris or receavis thair cawlpis and hereyeldis, or quha hes had the saidis thevis and revaris under thair assurance or exemptioun. Tua justice courtis to be haldin yeirlie for the ordiner executioun of this present act and statute within everie ane of the saidis schirefdomes and stewartries at leist, at Jedburgh for Roxburgh, Selkirk and Peiplis; at Drumfreis for the schirefdome thairof and stewartries of Kircubreich and Annerdaill; at Striviling for Ergyle, Bute, Dunbartane and Perth, stewartries of Menteith and Stratherne; at Abirdene for the schirefdome thairof and Bamf; at Elgin or Inverness for the schirefdomes of Elgin, Forres, Narne, Invernes and Cromertie. And the expenses of officiaris, clerkis and utheris thingis neidfull to be tane of the reddiest unlawis and escheatis of the saidis courtis, ane band to be maid, suorne and subscryvit be all noblemen, baronis and landit men within the boundis of the saidis schirefdomes and stewartries, obleissand thame to seik the trew executioun of this present act for thair awin pertis and to concur aganis the saidis thevis, rebellis and sornaris, and to keip ordinar watching and warding and to contribute to that effect in sic sort as salbe thocht metast among thame selffis. Certefeing thame that salbe fund not to convene and further this gude wark, thay salbe haldin infamous and favoraris and partakaris with the saidis thevis and sornaris in thair evill deidis. And oure said soverane lord, with advise of his saidis estatis, declaris that this present act of parliament sall extend not onlie aganis all inhabitantis of the saidis speciall schirefdomes and stewartries bot aganis the landislordis, maisteris and baillies of all personis that ar or salbe suspectit and dilatit of thift, reif, oppressioun and sorning ower all pertis of the realme, and namelie aganis the heretouris and lyfrentaris of landis within townis and suburbis thairoff quhilkis salbe haldin to enter and present to justice personis duelland within thair tenementis and houses suspectit to be harlottis, thevis, ressettaris of thift or vagabundis; siclyk as landislordis in hielandis or borderis for thair men and tennentis that ar thevis and sorneris. And thairfoir that the saidis heretouris or lyfrentaris in townis or suburbis thairof tak souirtie of thair tennentis quhome unto thay sett thair houses, for thair releif at thair awin prell. And further, oure soverane lord, with avise of his saidis estaitis, ratifies and apprevis and for his hienes and his successouris perpetuallie confirmes all former lawis and actis maid be his hienes and his maist noble progenitouris in ony tymes bygane anent punischement of thift, reif, sorning and oppressioun, not rising and following to effray, sitting under assurance of thevis, or taking or paying of blak maill, and ordanis the same actis to be put to executioun with diligence efter the forme and tennour thairof. And finallie that as thevis and sornaris concurris, assistis and mantenis utheris in wickit deidis aganis trew men without feir of God, the king or the lawes, sua it salbe lauchtfull to trew and honest men to concur and joyne thame selffis in counsaillis and actionis for defence of the lyves and guidis of thame selffis and thair tennentis aganis thevis and sornaris, and to follow and persew thame and all of thair races, clannis and names duelland within the boundis of the hielandis and bordouris (not subject be guid and sufficient souirties and pleigis to be answerable to the lawes and redress of parties skaithit), and to tak and apprehend thair personis and guidis, keip thame selffis in prisone or execute thame to the deathe, makand all oure soverane lordis officiaris and ministeris of justice to burgh or land and all his frehaldaris remaning at his hienes faith, peace and obedience conjunctlie or severallie his hienes justice to that effect, with power to hald courtis, creat memberis thairof, summond assys, ilk persoun under the pane of ten pund, als oft as neid beis. And incace ony of the saidis thevis, sornaris of the saidis clannis or thair assistaris duelland in the hielandis or bordouris (quhilkis sall not be under guid souirtie and plegeing as said is, betuix and the first day of August nixtocum) happynnis to be tane hurt, slayne or mutilat, thair guidis to be taken and intromettit with, thair houses to be brunt, distroyit or cassin to the ground, oure soverane lord, with avise of his said estaitis in this present parliament, willis, grantis and declaris that the same sall nevir be impute as ony cryme or offence to quhatsumevir trew men, authouris or executouris thairof, nor thay nor nane of thame salbe callit nor accusit thairfoir criminallie nor civilie be ony maner of way in tyme cuming, axonerand and dischargeand thame of the same for evir.
